  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 0214\n\n                        Requisitos técnicos para autorizar la navegación de embarcaciones de clase\n\"pesca artesanal o pequeña escala\" en una autonomía de hasta doce millas náuticas en aguas\ncostarricenses\n\nMINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES\n\nDIVISIÓN MARÍTIMO PORTUARIA\n\nDIRECCIÓN DE NAVEGACIÓN Y SEGURIDAD\n\nResolución administrativa DVMP-DNS-2023-0214.-\nMinisterio de Obras Públicas y Transportes.-División Marítimo\nPortuaria.-Dirección de Navegación y Seguridad.- San José, al ser las nueve\nhoras del 22 de mayo del año 2023.\n\nProcede la División Marítimo Portuaria y la Dirección\nde Navegación y Seguridad dentro de sus atribuciones y facultades a dictar la\nresolución pertinente para establecer los requisitos técnicos para autorizar la\nnavegación de embarcaciones de clase \"pesca artesanal o pequeña escala\" en\nuna autonomía de hasta doce millas náuticas en aguas costarricenses.\n\nResultando:\n\n1º-Que la Ley de Creación del MOPT N° 3155 de 5 de\nagosto de 1963 y sus reformas, establece en su artículo 2°, siguientes y\nconcordantes, la competencia material que asiste al Ministerio, consignándose\nen su inciso c), la obligación ineludible de planificar, construir, mejorar y\nmantener los puertos de altura y cabotaje, las vías y terminales de navegación\ninterior, los sistemas de transbordadores y similares; así como regular y controlar\nel transporte marítimo internacional, de cabotaje y por vías de navegación\ninterior.\n\n2º-Que conforme al Decreto Ejecutivo N° 40803- MOPT,\npublicado en el Alcance N° 47 del Periódico Oficial La Gaceta del día 2\nde marzo del 2018, le corresponde a la División Marítimo Portuaria y sus\ndependencias competentes, velar por la seguridad de la navegación y por la\nprotección de la vida en el mar, por medio de la inspección técnica a\nembarcaciones nacionales, para la obtención del Certificado de Navegabilidad.\n\n3º-Que conforme al Decreto Ejecutivo N° 19081-MOPT del\n28 de abril de 1989 de Inspección de Embarcaciones Nacionales, los\nreconocimientos, inspecciones o revisiones a que se refiere dicho reglamento,\ntiene por objeto verificar las condiciones mínimas de conservación del buque,\nsalvaguardar la vida humana en el mar, comprobar el estado de funcionamiento\ndel equipo y cantidad según su autonomía.\n\n4º-Que el Decreto N° 19801, en su artículo 4° señala\nlo siguiente:\n\n\"Artículo 4º-Los buques podrán ser objeto de las\ninspecciones que a continuación se detallan:\n\nmargin-right:0cm;margin-bottom:0cm; margin-left:72.0pt;margin-bottom:.0001pt;text-align:justify'>4.1\nUn reconocimiento inicial antes de que el buque entre en servicio:\n\nComprenderá una inspección completa de la estructura,\nestabilidad, maquinaria, disposición estructural y materiales. Esta se\nrealizará de modo que garantice que la disposición, materiales y los\nescantillones de la estructura, recipientes a presión y sus accesorios,\nmáquinas principales y auxiliares, instalaciones eléctricas, radioeléctricas, radiotelegráficas,\nlos botes salvavidas a motor, los aparatos radioeléctricos portátiles de las\nembarcaciones de supervivencia, las radiobalizas de localización de siniestros\n(EPIRB), los dispositivos de salvamento, detección y extinción de incendios, el\nradar, los ecosondas, los girocompases y\ndemás equipos y accesorios; cumplan las disposiciones emitidas por la Dirección\nGeneral de Transporte Marítimo.\" (El destacado no corresponde al original).\n\n5º-Que para establecer los requerimientos técnicos que\nse exigen a las embarcaciones nacionales referidos en el Decreto N° 19801-MOPT\ny \"demás equipos y accesorios\" que cumplan las disposiciones emitidas\npor la Dirección de Navegación y Seguridad, se deben considerar, entre otros\nfactores, la denominada autonomía,\nque conforme al Decreto Ejecutivo N° 28742-MOPT del 19 de junio de 2000\n\"Reglamento a Emisión de Zarpe a las Embarcaciones de Bandera Nacional\", se\nentiende como \"aquella distancia que el buque puede recorrer desde un puerto\nbase hasta el próximo puerto de refugio así como la distancia que puede existir\nentre el buque y la costa\", resultando reconocidas administrativamente tres\ntipos: hasta tres millas náuticas -reconocida en el Decreto N° 28742, hasta\ncuarenta millas náuticas y más de cuarenta millas náuticas.\n\n6º-Que por medio de la Ley N° 10.155, la cual modifica varios artículos de la Ley de Pesca y\nAcuicultura (N° 8436), se faculta al Instituto Costarricense de Pesca y Acuicultura (Incopesca) la\nrealización de investigaciones en asocio con organizaciones de pescadores legalmente constituidos,\nlo que permitirá la recopilación de datos necesarios para nuevas licencias de pequeña escala, y\npromover además del desarrollo del sector pesquero, la generación de buenas prácticas para\nfortalecer las capacidades empresariales y organizativas para grupos de pescadores, acuicultores y\nlas áreas marinas de pesca responsable, con el objetivo de aprovechar sosteniblemente los recursos\npesqueros del país y su potencial para impulsar el crecimiento económico en las costas ( Ref.\nhttps://www.presidencia.go.cr/ comunicados/2022/03/ejecutivo-sanciona-ley-quefacilitara-\ninvestigacion-y-formalizacion-de-pescadores/).\n\n7º-Que en reunión sostenida el día 20 de febrero de\n2023 con representantes del sector pesquero nacional, del Instituto\nCostarricense de Pesca y Acuicultura, y el Ministerio de Obras Públicas y\nTransportes, y a solicitud de la Presidencia de la República, se analizó el\ntema sobre la necesidad de crear \"autonomías intermedias\",\nconcretamente para el sector pesquero para lograr desarrollar actividades más\nallá de las tres millas náuticas, ante las limitaciones que los procesos\nnaturales y otros han provocado en la captura de producto pesquero, que obliga\nla búsqueda de otras zonas de pesca que superan las actuales, y que coincide\ncon parte del objetivo de la investigación que se consignó en el considerando\nanterior, para lo que igual se requiere de la participación del sector de pesca\nde pequeña escala o artesanal.\n\n8º-Que conforme al oficio DVMP-DNS-2023-133 del Departamento\nde Control de la Navegación, en el año 2018 (mediante oficio\nDVMP-DNS-2018-1368) dicha dependencia procedió con el análisis de dicha\nnecesidad, en la que se valoraron distintos aspectos, entre los cuales están:\ncondiciones oceanográficas y meteorológicas, potencia de motores, diferencias\nde las condiciones del litoral Pacífico y Caribe costarricense, consumo de\ncombustible, y recomendó el análisis de los aspectos constructivos y se detalló\nel equipo mínimo básico de seguridad que debía considerarse para tales efectos.\n\n9º-Que el punto A de dicho informe emitido por oficio\nDVMP-DNS-2023-133, se sometió a una revisión de los Capitanes de Puerto,\ngenerando una serie de observaciones y recomendaciones sobre las propuestas de\nequipamiento para la protección de la vida humana en el mar, donde se valoraron\naspectos de seguridad marítima, supervivencia y salvamento marítimo,\ncomunicaciones efectivas, que se consideraron en la elaboración de la presente\nresolución, así como aspectos generales comentados por el equipo del\nDepartamento de Seguridad y Protección de la Dirección de Navegación y\nSeguridad, igualmente valorados, que constan en el expediente administrativo\nconformado para tales efectos.\n\nConsiderando:\n\nQue la División Marítimo Portuaria y la Dirección de\nNavegación y Seguridad, en apego a las facultades que le otorga el Decreto\nEjecutivo N° 19081-MOPT sobre la determinación de los \"demás equipos y\naccesorios\" que deben portar las embarcaciones nacionales, y conforme a los\nprincipios y reglas unívocas de la ciencia o de la técnica, en el presente caso\npara velar por la protección de la vida humana en el mar, se considera viable\nla autorización provisional de una autonomía de navegación marítima de hasta\ndoce millas náuticas dentro del espacio marino costarricense, en virtud de las\nlimitaciones, afectaciones naturales y necesidades expuestas por el sector\npesquero de pequeña escala o artesanal, que ha obligado al Estado inclusive a\ngenerar procesos de investigación científica, determinado por Ley, sin afectación\nde las autonomías ya reconocidas vigentes de hasta Tres Millas náuticas, hasta\nCuarenta Millas Náuticas y Más de Cuarenta Millas Náuticas. Por tanto,\n\nCon asidero legal en la Ley de Creación del MOPT N°\n3155 de 5 de agosto de 1963, el Decreto Ejecutivo N° 40803- MOPT Reforma\nOrganizativa y Funcional de la División Marítimo Portuaria, y el Decreto\nEjecutivo N° 19081-MOPT:\n\nRESUELVE:\n\n1º-Autorizar provisionalmente una autonomía de\nnavegación intermedia de \"Hasta 12 Millas Náuticas\" para las embarcaciones de\npesca artesanales o pequeña escala.\n\n2º-Que los propietarios de embarcaciones de pesca\nartesanal o pequeña escala que pretendan navegar bajo la autonomía de doce\nmillas náuticas, deberán cumplir con la totalidad de los requisitos ya\nestablecidos para la autonomía de tres millas náuticas y, además, deberán\ncumplir sin excepción las siguientes condiciones:\n\n1.\nPresentar un extintor de fuego tipo ABC de 2 kg.\n\n2. Un Sistema de Posicionamiento Global portátil (GPS)\nde uso marino.\n\n3. Un Radio VHF de frecuencia marina.\n\n4. Tabla de Mareas del periodo vigente, la cual podrá\nser solicitado en capitanía de puerto por el usuario.\n\n5. Un ancla de peso mínimo de 30 kilogramos, con\ncuatro metros de cadena y doscientos metros de mecate.\n\n6. Pitoreta fija o de aire comprimido.\n\n7. Binoculares diurnos 7x50 al menos.\n\n8. Luces de Navegación conforme a los estándares\ninternacionales reconocidos (de costado y de fondeo) en caso de pretender\nrealizar navegación nocturna. (Se recomienda utilizar como referencia el\nReglamento Internacional para Prevenir Abordajes (RIPA).\n\n9. Al menos un aro salvavidas.\n\n10. Tres señales de socorro (cohetes con paracaídas).\n\n11. Bomba de achique.\n\n12. Toldilla, la cual puede ser removible o fija.\n\n3º-Las embarcaciones que pretendan trasladarse de la\nautonomía de \"Hasta 3 Millas Náuticas\" a la autonomía de \"Hasta 12 Millas\nNáuticas\" deberán solicitar formalmente y conforme a los procedimientos\nordinarios, la inspección a la Capitanía de Puerto de su jurisdicción para la\nverificación de las condiciones técnicas, considerando las obligaciones\nordinarias de dichas oficinas locales.\n\n4º-El propietario o armador, deberá respetar la\ncapacidad ya autorizada de transporte de combustible consignado para uso propio\n(no como carga) en el Certificado de Navegabilidad, y en caso de requerir un\naumento de capacidad para uso propio, deberá someterse a los procedimientos\nestablecidos en la Ley N° 9096 Ley para Regular la Comercialización, el\nAlmacenamiento y el Transporte de Combustible por las Zonas Marinas y Fluviales\nsometidas a la Jurisdicción del Estado Costarricense.\n\n5º-Toda embarcación que obtenga un Certificado de\nNavegabilidad con una autonomía de \"Hasta 12 Millas Náuticas\", deberá solicitar\nel respectivo Zarpe Nacional, bajo las condiciones establecidas en el Decreto\nde Emisión de Zarpe Nacional, incluidos los requisitos técnicos para su\nobtención.\n\n6º-Toda embarcación que pretenda someterse a\nnavegación de \"Hasta 12 Millas Náuticas\", que requiera modificaciones de su\nestructura, deberá someterse a los procesos constructivos establecidos por la\nDirección de Navegación y Seguridad.\n\n7º-La Dirección de Navegación y Seguridad deberá\ngenerar los estudios para crear otras autonomías intermedias que apliquen a\notros sectores de navegación nacional (pesca, turismo, cabotaje, pasajeros,\nentre otros) en un plazo de seis meses a partir de la publicación de la\npresente resolución.\n\n8º-La autonomía de \"Hasta 12\nMillas Náuticas\" para embarcaciones pesqueras artesanales o pequeña escala, se\nmantendrá vigente hasta tanto se emita la nueva normativa que regule de forme\nintegral las autonomías de navegación en aguas costarricenses.-Publíquese.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 0214\n\n                        Technical requirements for authorizing the navigation of vessels of the\n\"small-scale or artisanal fishing\" class within an operating range (autonomía) of up to twelve nautical miles in Costa Rican\nwaters\n\nMINISTRY OF PUBLIC WORKS AND TRANSPORT\n\nMARITIME PORT DIVISION\n\nDIRECTORATE OF NAVIGATION AND SAFETY\n\nAdministrative Resolution DVMP-DNS-2023-0214.—\nMinistry of Public Works and Transport.—Maritime Port\nDivision.—Directorate of Navigation and Safety.— San José, at nine o'clock\na.m. on May 22, 2023.\n\nThe Maritime Port Division and the Directorate\nof Navigation and Safety, within their powers and authority, proceed to issue the\npertinent resolution to establish the technical requirements for authorizing the\nnavigation of vessels of the \"small-scale or artisanal fishing\" class within\nan operating range (autonomía) of up to twelve nautical miles in Costa Rican\nwaters.\n\nWhereas (Resultando):\n\n1.—That the Law Creating the MOPT No. 3155 of August 5,\n1963 and its amendments, establishes in its Article 2, subsequent and\nconcordant articles, the material competence vested in the Ministry, stipulating\nin subsection c), the unavoidable obligation to plan, build, improve and\nmaintain deep-sea and coastal ports, inland navigation waterways and terminals,\nferry systems and the like; as well as to regulate and control\ninternational maritime transport, coastal shipping, and transport via inland navigation\nwaterways.\n\n2.—That pursuant to Executive Decree No. 40803-MOPT,\npublished in Supplement No. 47 to the Official Gazette La Gaceta on March 2,\n2018, the Maritime Port Division and its competent dependencies are responsible for ensuring the safety of navigation and the\nprotection of life at sea, through the technical inspection of\nnational vessels, for obtaining the Certificate of Seaworthiness (Certificado de Navegabilidad).\n\n3.—That pursuant to Executive Decree No. 19081-MOPT of\nApril 28, 1989 on the Inspection of National Vessels, the\nsurveys, inspections, or examinations referred to in said regulation,\nare intended to verify the minimum conditions of preservation of the vessel,\nsafeguard human life at sea, and check the operational status\nof the equipment and its quantity according to its operating range (autonomía).\n\n4.—That Decree No. 19801, in its Article 4, states\nthe following:\n\n\"Article 4.—Vessels may be subject to the\ninspections detailed below:\n\n4.1 An initial survey before the vessel enters service:\n\nIt shall comprise a complete inspection of the structure,\nstability, machinery, structural arrangement, and materials. This survey shall\nbe carried out in such a way as to ensure that the arrangement, materials, and\nscantlings of the structure, pressure vessels and their accessories,\nmain and auxiliary engines, electrical installations, radio, radiotelegraphic installations,\nmotor lifeboats, portable radio apparatus for survival craft,\nEmergency Position Indicating Radio Beacons (EPIRB),\nlife-saving appliances, fire detection and extinguishing equipment, radar,\necho sounders, gyrocompasses, and\nother equipment and accessories; comply with the provisions issued by the\nGeneral Directorate of Maritime Transport.\" (Emphasis not in the original).\n\n5.—That in order to establish the technical requirements\nrequired of national vessels referred to in Decree No. 19801-MOPT\nand \"other equipment and accessories\" that comply with the provisions issued\nby the Directorate of Navigation and Safety, consideration must be given, among other\nfactors, to the so-called operating range (autonomía),\nwhich pursuant to Executive Decree No. 28742-MOPT of June 19, 2000,\n\"Regulations for the Issuance of Departure Clearance (Zarpe) to National Flag Vessels,\" is\nunderstood as \"that distance that the vessel can travel from a home\nport to the next port of refuge as well as the distance that may exist\nbetween the vessel and the coast,\" three types being administratively recognized:\nup to three nautical miles —recognized in Decree No. 28742—, up to\nforty nautical miles, and more than forty nautical miles.\n\n6.—That through Law No. 10,155, which amends several articles of the Fisheries and\nAquaculture Law (No. 8436), the Costa Rican Institute of Fisheries and Aquaculture (Incopesca) is empowered to\ncarry out research in partnership with legally constituted fishermen's organizations,\nwhich will allow the collection of data necessary for new small-scale licenses, and\nfurther promote, in addition to the development of the fishing sector, the generation of good practices to\nstrengthen the entrepreneurial and organizational capacities of groups of fishermen, aquaculturists, and\nmarine areas of responsible fishing, with the objective of sustainably utilizing the country's fishery\nresources and their potential to drive economic growth on the coasts ( Ref.\nhttps://www.presidencia.go.cr/ comunicados/2022/03/ejecutivo-sanciona-ley-quefacilitara-\ninvestigacion-y-formalizacion-de-pescadores/).\n\n7.—That at a meeting held on February 20,\n2023, with representatives of the national fishing sector, the\nCosta Rican Institute of Fisheries and Aquaculture, and the Ministry of Public Works and\nTransport, and at the request of the Presidency of the Republic, the\nissue of the need to create \"intermediate operating ranges (autonomías intermedias)\" was discussed,\nspecifically for the fishing sector, in order to develop activities beyond three nautical miles, given the limitations that natural\nprocesses and other factors have caused in the capture of fishery products,\nnecessitating the search for other fishing zones beyond the current ones, which coincides\nwith part of the research objective set forth in the preceding\nconsideration, for which the participation of the small-scale or artisanal fishing\nsector is also required.\n\n8.—That according to official communication DVMP-DNS-2023-133 from the Department\nof Navigation Control, in 2018 (via official communication\nDVMP-DNS-2018-1368), said department proceeded with the analysis of said\nneed, in which various aspects were assessed, including:\noceanographic and meteorological conditions, engine power, differences\nin the conditions of the Costa Rican Pacific and Caribbean coastline, fuel\nconsumption, and recommended the analysis of construction aspects and detailed\nthe minimum basic safety equipment that should be considered for such purposes.\n\n9.—That point A of said report issued by official communication\nDVMP-DNS-2023-133, was subjected to a review by the Harbor Masters (Capitanes de Puerto),\ngenerating a series of observations and recommendations on the proposed\nequipment for the protection of human life at sea, where\nmaritime safety, survival and maritime rescue aspects,\nand effective communications were assessed, which were considered in the drafting of this\nresolution, as well as general aspects commented on by the team of the\nDepartment of Safety and Protection of the Directorate of Navigation and\nSafety, likewise assessed, which are contained in the administrative file\nformed for such purposes.\n\nConsidering:\n\nThat the Maritime Port Division and the Directorate of\nNavigation and Safety, in accordance with the powers granted by\nExecutive Decree No. 19081-MOPT regarding the determination of the \"other\nequipment and accessories\" that national vessels must carry, and in accordance with\nthe unequivocal principles and rules of science or technique, in this case\nto ensure the protection of human life at sea, consider the provisional authorization\nviable for a maritime navigation operating range (autonomía) of up to\ntwelve nautical miles within the Costa Rican marine space, by virtue of the\nlimitations, natural impacts, and needs expressed by the small-scale\nor artisanal fishing sector, which has compelled the State even to\ngenerate scientific research processes, determined by Law, without affecting\nthe already recognized current operating ranges (autonomías) of up to Three\nNautical miles, up to Forty Nautical Miles, and More than Forty Nautical Miles. Therefore (Por tanto),\n\nWith legal basis in the Law Creating the MOPT No.\n3155 of August 5, 1963, Executive Decree No. 40803-MOPT Organizational\nand Functional Reform of the Maritime Port Division, and Executive\nDecree No. 19081-MOPT:\n\nIT IS RESOLVED:\n\n1.—To provisionally authorize an intermediate navigation\noperating range (autonomía) of \"Up to 12 Nautical Miles\" for artisanal\nor small-scale fishing vessels.\n\n2.—That the owners of artisanal or small-scale fishing\nvessels seeking to navigate under the twelve-nautical-mile\noperating range (autonomía) must comply with all the requirements already\nestablished for the three-nautical-mile operating range (autonomía) and, in addition, must\ncomply without exception with the following conditions:\n\n1. Present a 2 kg ABC type fire extinguisher.\n\n2. A portable Global Positioning System (GPS)\nfor marine use.\n\n3. A VHF Radio with marine frequency.\n\n4. Tide Table for the current period, which may\nbe requested by the user at the harbor master's office (capitanía de puerto).\n\n5. An anchor with a minimum weight of 30 kilograms, with\nfour meters of chain and two hundred meters of rope.\n\n6. Fixed or compressed air whistle.\n\n7. Daytime binoculars 7x50 at least.\n\n8. Navigation Lights in accordance with recognized\ninternational standards (side lights and anchor light) if intending\nto navigate at night. (It is recommended to use the\nInternational Regulations for Preventing Collisions at Sea (RIPA) as a reference).\n\n9. At least one lifebuoy.\n\n10. Three distress signals (rocket parachute flares).\n\n11. Bilge pump.\n\n12. Awning/sunshade (toldilla), which may be removable or fixed.\n\n3.—Vessels seeking to move from the operating range (autonomía) of \"Up to 3 Nautical Miles\" to the operating range (autonomía) of \"Up to 12 Nautical Miles\" must formally request, in accordance with ordinary\nprocedures, an inspection by the Harbor Master's Office (Capitanía de Puerto) of their jurisdiction for the\nverification of technical conditions, considering the ordinary\nobligations of said local offices.\n\n4.—The owner or shipowner must respect the\nalready authorized transport capacity of fuel designated for own use\n(not as cargo) in the Certificate of Seaworthiness (Certificado de Navegabilidad), and if an\nincrease in capacity for own use is required, they must submit to the\nprocedures established in Law No. 9096, Law to Regulate the Marketing,\nStorage, and Transport of Fuel in Marine and Fluvial Zones\nSubject to the Jurisdiction of the Costa Rican State.\n\n5.—Every vessel that obtains a Certificate of\nSeaworthiness (Certificado de Navegabilidad) with an operating range (autonomía) of \"Up to 12 Nautical Miles,\" must request\nthe respective National Departure Clearance (Zarpe Nacional), under the conditions established in the\nDecree on the Issuance of National Departure Clearance (Zarpe Nacional), including the technical requirements for its\nobtainment.\n\n6.—Every vessel seeking to undertake\nnavigation of \"Up to 12 Nautical Miles,\" requiring modifications to its\nstructure, must submit to the construction processes established by the\nDirectorate of Navigation and Safety.\n\n7.—The Directorate of Navigation and Safety must\ngenerate studies to create other intermediate operating ranges (autonomías) applicable to\nother national navigation sectors (fishing, tourism, coastal shipping, passengers,\namong others) within a period of six months from the publication of this\nresolution.\n\n8.—The operating range (autonomía) of \"Up to 12\nNautical Miles\" for artisanal or small-scale fishing vessels shall\nremain in force until the new regulation that comprehensively\nregulates navigation operating ranges (autonomías) in Costa Rican waters is issued.—Publish."
