  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 0\n\n                        Reforma Manual de procedimientos para el programa de pago de servicios\nambientales\n\nFONDO NACIONAL DE\nFINANCIAMIENTO FORESTAL\n\nEn la sesión Ordinaria de la Junta Directiva del Fondo\nNacional de Financiamiento Forestal celebrada el día 17 de mayo de 2023, se\ntomó el Acuerdo Tercero.\n\nConsiderando\n\n1. Que mediante acuerdo número décimo\nsegundo tomado en la sesión ordinaria N º 01-2020 del día 24 de enero de 2020,\nla Junta Directiva del Fondo Nacional de Financiamiento Forestal, aprobó el\nManual de Procedimientos para el Pago de Servicios Ambientales publicado en el\nAlcance número 87 de la Gaceta N ° 80 del 14 de abril de 2020.\n\n2. Que mediante acuerdos noveno y décimo\nde las Sesiones Ordinarias 07-2020 y 08-2020 respectivamente, celebradas el 12\nde agosto y el 09 de setiembre del 2020, la Junta Directiva del Fondo Nacional\nde Financiamiento Forestal aprobó la modificación al Manual de Procedimiento\npara el Pago de Servicios Ambientales publicado en la Gaceta Nº 118 del 21 de\njunio del 2022.\n\n3. Que Mediante Decreto Ejecutivo Número\n43649-MINAE emitido el día 09 de agosto de 2022, se modificaron los artículos\n89 y 107 del Reglamento de la Ley Forestal 7575 número 25721-MINAE y sus\nreformas, que afectan aspectos del procedimiento general del Programa de Pago\npor Servicios Ambientales.\n\n4. Que mediante acuerdo número quinto\ntomado en la sesión ordinaria Nº 03-2023 del día 08 de marzo de 2023, la Junta\nDirectiva del Fondo Nacional de Financiamiento Forestal, aprobó una\nmodificación en la distribución del monto a girar en los contratos del proyecto\npiloto de reforestación entre FUNDECOR y Fonafifo.\n\n5. De conformidad con lo dispuesto en el\nReglamento a la Ley Forestal N° 7575, Decreto Ejecutivo Nº 215721-MINAE y sus\nreformas, la Junta Directiva del Fondo Nacional de Financiamiento Forestal es la\ncompetente para emitir los procedimientos para ejecutar el Programa de Pago por\nServicios Ambientales. Por lo tanto,\n\nLa Junta Directiva del Fondo Nacional de\nFinanciamiento Forestal emite la siguiente modificación al Manual de\nProcedimientos para el Programa de Pago de Servicios Ambientales:\n\nArtículo 1 º-Para que se modifique el artículo 8.2.y en lo\nsucesivo se lea de la siguiente forma:\n\n8.2. Los inmuebles sin inscribir.\n\nAdemás, de lo dispuesto en el artículo 9\nde la Ley N º 8640 y artículos 39 y 107 del Reglamento a la Ley Forestal, sus\nmodificaciones y el presente manual, las solicitudes de ingreso en fincas sin\ninscribir deberán cumplir con lo siguiente:\n\n8.2.1. La\nOficina Regional solicitará los documentos y declaraciones establecidos en el\nartículo 9 de la Ley N° 8640 de aquellas solicitudes que cumplan con los\nrequisitos establecidos, para lo cual otorgará un plazo de hasta 15 días\nhábiles, de no aportarse los mismos dentro del plazo conferido se procederá a\ndenegar la solicitud y proceder con el archivo.\n\n8.2.4.\nLas declaraciones juradas y documentos a las que refieren los incisos a), b),\nc) y d) del numeral 9 de la Ley N º 8640, deberán contener las especies\nfiscales y haberse expedido en el periodo de contratación correspondiente a la\nformulación de la solicitud de ingreso ante Fonafifo. Tratándose de documentos\nfotocopiados que se presenten para cumplir los requisitos de los incisos\nseñalados, deben encontrarse certificados notarialmente o por la entidad\nadministrativa o judicial que los expida.\n\n8.2.5. En\nel caso de presentar declaraciones de testigos, estos deberán, además de lo\nrequerido en la Ley N º 8640, indicar el tiempo que les consta la posesión del\ninmueble y las razones por las cuales conocen las circunstancias sobre las que\ndeclaran.\n\n8.2.6.\nPosterior a la autorización legal, el personal de Fonafifo, realizará una\ninspección al terreno y emitirá una recomendación que dará el aval o no para la\nsuscripción del contrato o el archivo de la gestión, según anexo 3.\n\n8.2.7. Si\nel inmueble objeto de la solicitud se ubica dentro de un Área Silvestre\nProtegida, la inspección de campo podrá ser coordinada con el Sistema Nacional\nde Áreas de Conservación.\n\nEn caso\nparticular de que el personal del SINAC no sea parte de la inspección de campo,\nel informe generado por Fonafifo será remitido al Área de Conservación\ncorrespondiente, a fin de que en un plazo no mayor a 10 días naturales exprese\nsu criterio, sobre el expediente que se le consulte por parte del Fondo\nNacional de Financiamiento Forestal; en el cual indicará si existen elementos\nrelacionados al solicitante, en cuanto a si el mismo se encuentra inscrito en\nalgún censo del Área de Conservación o haya colaborado en brigadas voluntarias\nde vigilancia o lucha contra incendios; si el terreno indicado en el expediente\nse encuentra en trámite de compra o expropiación por parte del MINAE; si el solicitante\nha sido denunciado administrativa o judicialmente por delitos en contra del\nmedio ambiente, a instancia del SINAC; si existen carriles u otros elementos de\ndelimitación de terreno y si en el mismo existen construcciones como casas,\ncorrales, caminos trochas, senderos, cultivos, ganado u otra actividad humana,\nagrícola, comercial y turística.\n\n8.2.8.\nPara el caso de solicitudes que se ubiquen en fincas INDER, además a lo\nestablecido en el artículo 9 inciso b) de la Ley Nº 8640, deberán presentar el\ndocumento emitido por esta Institución, que demuestre su condición de poseedor\ncensado, declarado beneficiario, adjudicatario y el tiempo de ostentarla.\n\n8.2.9.\nTratándose de proyectos SAF-PAF, si el inmueble se ubica fuera del Patrimonio\nNatural del Estado deberá cumplir con los siguientes requisitos: presentar\nplano catastrado, declaración jurada autenticada por notario público (que\ncontenga la descripción de la naturaleza del inmueble, ubicación por provincia,\ncantón, distrito, caserío o población local, indicación de los nombres\ncompletos de todos los colindantes actuales, número de plano catastrado,\nmedida, tiempo de poseerlo, modo de adquisición y descripción de los actos\nposesorios); constancia o certificación del INDER donde se tenga como poseedor\nadjudicatario o cualquier otra figura. Posterior a la autorización legal, el\npersonal de Fonafifo, realizará una inspección al terreno y emitirá una\nrecomendación que dará el aval o no de la suscripción del contrato o el archivo\nde la gestión, según anexo 3. Si el inmueble se ubica dentro del Patrimonio\nNatural del Estado, deberá cumplir con los requisitos establecidos en la Ley Nº\n8640.\n\n8.2.10 Tratándose de proyectos SAF sistemas mixtos, si el inmueble se ubica fuera del Patrimonio\nNatural del Estado deberá cumplir con los siguientes requisitos: presentar plano catastrado,\ndeclaración jurada autenticada por notario público (que contenga la descripción de la naturaleza del\ninmueble, ubicación por provincia, cantón, distrito, caserío o población local, indicación de los\nnombres completos de todos los colindantes actuales, número de plano catastrado, medida, tiempo de\nposeerlo, modo de adquisición y descripción de los actos posesorios); constancia o certificación del\nINDER donde se tenga como poseedor adjudicatario o cualquier otra figura. Posterior a la\nautorización legal, el personal de Fonafifo, realizará una inspección al terreno y emitirá una\nrecomendación que dará el aval o no de la suscripción del contrato o el archivo de la gestión, según\nanexo 3. Si el inmueble se ubica dentro del Patrimonio Natural del Estado, deberá cumplir con los\nrequisitos establecidos en la Ley N º 8640.\n\n8.2.11 En\nel supuesto en que el inmueble se llegue a inscribir en el Registro Nacional\ndeberá procederse con las afectaciones y limitaciones establecidas en la Ley\nForestal.\n\nArtículo 2°. -Para\nque se modifique el artículo 20.12 y en lo sucesivo se lea de la siguiente\nforma:\n\n 20.12. Mantener activo un\nnúmero de cuenta bancaria internacional (de acuerdo a sus siglas en inglés\nIBAN) en colones emitida por una entidad bancaria, financieras, mutual y/o\ncooperativa de ahorro y crédito. Excepcionalmente podrán emitirse los pagos a\nfavor de un tercero a quien el o los beneficiarios del contrato hayan cedido su\nderecho al pago mediante un documento de cesión autenticado por un notario\npúblico. Cuando existan co-propietarios, éstos\ndeberán de indicar al FONAFIFO en la solicitud, a nombre de quien se girarán\nlos recursos, lo cual estará consignado en el contrato respectivo.\n\nArtículo 3º· Para que se modifique el artículo 43 y en lo sucesivo se lea de\nla siguiente forma:\n\n43. Distribución de los montos de pago. La distribución del monto de PSA será en 6\ntractos anuales en los siguientes porcentajes: 11 %, 16%, 17%, 18%, 19% y 19%,\nque se entregará siempre y cuando el beneficiario haya consentido mediante\ndocumento formal que conste en el expediente. Con los recursos Fonafifo\ncancelara el interés anual generado por los proyectos del piloto y de quedar\nalgún saldo del PSA en la transacción, que este se utilice para amortizar la\ndeuda del principal.\n\nArtículo 4º· Para\nque se modifique la numeración del TÍTULO II, capítulo único para que en lo\nsucesivo se lea de la siguiente forma:\n\nArtículo 45. Convenios especiales; 45.1 y 45.2.\n\nArtículo 46.-Los proyectos asociados a la Estrategia REDO+;\n46.1, 46.2, y 46.3\n\nArticulo 47.-Disposiciones finales; 47.1 Disposiciones Finales\n\nArtículo 5º. Para\nque se modifique del anexo 10 la cláusula quinta, para que en lo sucesivo se\nlea de la siguiente forma:\n\nCLÁUSULA QUINTA: Del precio y forma de pago\n\nFONAFIFO, como contraprestación por la cesión establecida en este contrato, pagará por los servicios\nambientales adquiridos, una suma de ___ colones por cada hectárea de bosque comprometida en el\nprograma de protección. FONAFIFO según lo dispuesto en la Resolución Ministerial ___ _, realizará un\npago anual durante diez años. El primer pago se realizará después de que el regente forestal\ncertifique ante la Oficina Regional respectiva, el área de bosque, y que la misma se mantiene\ninalterada, cumpliendo a cabalidad las obligaciones adquiridas en el presente contrato. Los pagos de\nlos años siguientes serán programados y realizados tomando en consideración el trimestre de firma\ndel presente contrato y los recursos que al efecto otorgue el Ministerio de Hacienda a Fonafifo.\nEstos desembolsos estarán condicionados al cumplimiento de las obligaciones pactadas en este\ncontrato y a cualesquier otras establecidas en el Manual de Procedimiento.   "body_en_text": "throughout the text\n\n                    -\n\n                        Complete Text of Standard 0\n\n                        Reform of the Procedures Manual for the Payment for Environmental\nServices Program\n\nFONDO NACIONAL DE\nFINANCIAMIENTO FORESTAL\n\nIn the Ordinary Session of the Board of Directors of the Fondo\nNacional de Financiamiento Forestal held on May 17, 2023, the\nThird Agreement was taken.\n\nConsidering\n\n1. That through agreement number twelve\ntaken in ordinary session No. 01-2020 on January 24, 2020,\nthe Board of Directors of the Fondo Nacional de Financiamiento Forestal approved the\nProcedures Manual for the Payment for Environmental Services (Pago de Servicios Ambientales), published in\nScope number 87 of Gazette No. 80 of April 14, 2020.\n\n2. That through agreements nine and ten\nof Ordinary Sessions 07-2020 and 08-2020 respectively, held on August 12\nand September 09, 2020, the Board of Directors of the Fondo Nacional\nde Financiamiento Forestal approved the modification to the Procedures Manual\nfor the Payment for Environmental Services (Pago de Servicios Ambientales) published in Gazette No. 118 of June 21,\n2022.\n\n3. That through Executive Decree Number\n43649-MINAE issued on August 09, 2022, articles\n89 and 107 of the Regulation to the Forest Law (Reglamento de la Ley Forestal) 7575 number 25721-MINAE and its\nreforms were modified, which affect aspects of the general procedure of the Payment for\nEnvironmental Services Program (Programa de Pago por Servicios Ambientales).\n\n4. That through agreement number five\ntaken in ordinary session No. 03-2023 on March 08, 2023, the Board\nof Directors of the Fondo Nacional de Financiamiento Forestal approved a\nmodification in the distribution of the amount to be disbursed in the contracts of the pilot\nreforestation (reforestación) project between FUNDECOR and Fonafifo.\n\n5. Pursuant to the provisions of the\nRegulation to the Forest Law (Reglamento a la Ley Forestal) No. 7575, Executive Decree No. 215721-MINAE and its\nreforms, the Board of Directors of the Fondo Nacional de Financiamiento Forestal is the\ncompetent body to issue the procedures to execute the Payment for\nEnvironmental Services Program (Programa de Pago por Servicios Ambientales). Therefore,\n\nThe Board of Directors of the Fondo Nacional de\nFinanciamiento Forestal issues the following modification to the Procedures\nManual for the Payment for Environmental Services Program (Programa de Pago de Servicios Ambientales):\n\nArticle 1º—So that article 8.2.y shall be modified and henceforth read as follows:\n\n8.2. Unregistered properties (inmuebles sin inscribir).\n\nIn addition to the provisions of article 9\nof Law No. 8640 and articles 39 and 107 of the Regulation to the Forest Law (Reglamento a la Ley Forestal), its\nmodifications and this manual, applications for entry on unregistered farms (fincas sin\ninscribir) must comply with the following:\n\n8.2.1. The\napplication shall indicate the cadastral map (plano) number, the applicant's qualifications, and other\ninformation.\n\nLikewise,\na photocopy of the cadastral map (plano catastrado) must be submitted.\n\n8.2.2. The\ncadastral map (plano) that is the subject of the application must remain registered and in force in accordance\nwith article 71, subsection a) of the Regulation to the National Cadastre Law (Reglamento a la Ley de Catastro Nacional). In\nthe event the cadastral map (plano) is cancelled, the application shall be archived.\n\n8.2.3. The\nRegional Office shall request the documents and declarations established in\narticle 9 of Law No. 8640 for those applications that meet the\nestablished requirements, for which it shall grant a period of up to 15 business\ndays; if these are not provided within the conferred period, the\napplication shall be denied and archiving shall proceed.\n\n8.2.4.\nThe sworn declarations (declaraciones juradas) and documents referred to in subsections a), b),\nc), and d) of numeral 9 of Law No. 8640 must contain the fiscal\nstamps (especies fiscales) and have been issued in the contracting period corresponding to the\nformulation of the application for entry to Fonafifo. In the case of\nphotocopied documents submitted to meet the requirements of the aforementioned\nsubsections, they must be certified by a notary or by the\nadministrative or judicial entity that issued them.\n\n8.2.5. In\nthe case of submitting witness declarations, these witnesses must, in addition to what\nis required in Law No. 8640, indicate the length of time they have known of the possession (posesión) of the\nproperty and the reasons why they know the circumstances about which they\nare declaring.\n\n8.2.6.\nSubsequent to the legal authorization, Fonafifo personnel shall conduct a\nfield inspection and issue a recommendation that will endorse or not the\nsubscription of the contract or the archiving of the proceeding, according to Annex 3 (anexo 3).\n\n8.2.7. If\nthe property subject to the application is located within a Protected Wilderness Area (Área Silvestre\nProtegida), the field inspection may be coordinated with the National System\nof Conservation Areas (Sistema Nacional de Áreas de Conservación).\n\nIn the\nparticular case that SINAC personnel are not part of the field inspection,\nthe report generated by Fonafifo shall be sent to the corresponding Conservation Area (Área de Conservación),\nso that within a period not exceeding 10 calendar days it may express\nits opinion on the file consulted by the Fondo\nNacional de Financiamiento Forestal; in which it shall indicate if there are elements\nrelated to the applicant, as to whether the same is registered in\nany census of the Conservation Area (Área de Conservación) or has collaborated in volunteer brigades\nfor surveillance or firefighting; if the land indicated in the file\nis in the process of purchase or expropriation by MINAE; if the applicant\nhas been administratively or judicially denounced for crimes against\nthe environment, at the instance of SINAC; if there are firebreaks (carriles) or other land\ndelimitation elements and if there are constructions on it such as houses,\ncorrals, roads, trails, footpaths, crops, cattle, or other human, agricultural, commercial, and tourist activity.\n\n8.2.8.\nFor the case of applications located on INDER farms (fincas INDER), in addition to what is\nestablished in article 9, subsection b) of Law No. 8640, they must submit the\ndocument issued by this Institution that proves their status as a censused possessor (poseedor\ncensado), declared beneficiary, awardee (adjudicatario), and the length of time of holding it.\n\n8.2.9.\nIn the case of SAF-PAF projects, if the property is located outside the Natural\nHeritage of the State (Patrimonio Natural del Estado), it must comply with the following requirements: submit\na cadastral map (plano catastrado), a sworn declaration (declaración jurada) authenticated by a notary public (which\ncontains the description of the nature of the property, location by province,\ncanton, district, hamlet or local community, indication of the\nfull names of all current adjoining landowners, cadastral map (plano catastrado) number,\nmeasurement, length of time of possession, mode of acquisition, and description of the possessory\nacts (actos posesorios); certification from INDER where they are recognized as an awardee possessor (poseedor\nadjudicatario) or any other designation. Subsequent to legal authorization,\nFonafifo personnel shall conduct a field inspection and issue a\nrecommendation that will endorse or not the subscription of the contract or the archiving of the proceeding, according to Appendix 3 (anexo 3). If the property is located within the Natural Heritage of the State (Patrimonio\nNatural del Estado), it must comply with the requirements established in Law No.\n8640.\n\n8.2.10 In the case of SAF mixed system projects, if the property is located outside the Natural Heritage of the State (Patrimonio Natural del Estado), it must comply with the following requirements: submit a cadastral map (plano catastrado),\na sworn declaration (declaración jurada) authenticated by a notary public (which contains the description of the nature of the\nproperty, location by province, canton, district, hamlet or local community, indication of the\nfull names of all current adjoining landowners, cadastral map (plano catastrado) number, measurement, length of time of\npossession, mode of acquisition, and description of the possessory acts (actos posesorios)); certification from\nINDER where they are recognized as an awardee possessor (poseedor adjudicatario) or any other designation. Subsequent to\nlegal authorization, Fonafifo personnel shall conduct a field inspection and issue a\nrecommendation that will endorse or not the subscription of the contract or the archiving of the proceeding, according to\nAppendix 3 (anexo 3). If the property is located within the Natural Heritage of the State (Patrimonio Natural del Estado), it must comply with the\nrequirements established in Law No. 8640.\n\n8.2.11 In\nthe event that the property is ever registered in the National Registry (Registro Nacional),\nthe charges (afectaciones) and limitations established in the Forest Law (Ley Forestal) must be processed.\n\nArticle 2°. -So\nthat article 20.12 shall be modified and henceforth read as follows:\n\n 20.12. Maintain an active\ninternational bank account number (IBAN\naccording to its acronym in English) in colones issued by a banking, financial, mutual, and/or\nsavings and credit cooperative entity. Exceptionally, payments may be issued in\nfavor of a third party to whom the contract beneficiary or beneficiaries have assigned their\nright to payment through an assignment document authenticated by a notary\npublic. When there are co-owners, they\nmust indicate to FONAFIFO in the application the name of the person to whom\nthe funds shall be disbursed, which shall be recorded in the respective contract.\n\nArticle 3º· So that article 43 shall be modified and henceforth read as\nfollows:\n\n43. Distribution of payment amounts. The distribution of the PSA amount shall be in 6\nannual installments in the following percentages: 11%, 16%, 17%, 18%, 19%, and 19%,\nwhich shall be delivered provided that the beneficiary has consented through\na formal document recorded in the file. With the resources, Fonafifo\nwill cancel the annual interest generated by the pilot projects and if there is\nany PSA balance in the transaction, this shall be used to amortize the\nprincipal debt.\n\nArticle 4º· So\nthat the numbering of TITLE II, single chapter, shall be modified to henceforth read as follows:\n\nArticle 45. Special agreements; 45.1 and 45.2.\n\nArticle 46.-Projects associated with the REDD+ Strategy;\n46.1, 46.2, and 46.3\n\nArticle 47.-Final provisions; 47.1 Final Provisions\n\nArticle 5º. So\nthat clause five of Appendix 10 shall be modified, to henceforth read as follows:\n\nCLAUSE FIVE: Price and form of payment\n\nFONAFIFO, as consideration for the assignment (cesión) established in this contract, shall pay for the environmental\nservices acquired, a sum of ___ colones for each hectare of forest (bosque) committed in the\nprotection program. FONAFIFO, pursuant to the provisions of Ministerial Resolution ___ _, shall make an\nannual payment for ten years. The first payment shall be made after the forest regent (regente forestal)\ncertifies to the respective Regional Office the forest area, and that it remains\nunaltered, fully complying with the obligations acquired in this contract. The payments for\nthe following years shall be scheduled and made taking into consideration the quarter of signature\nof this contract and the resources granted for that purpose by the Ministry of Finance (Ministerio de Hacienda) to Fonafifo.\nThese disbursements shall be conditional on compliance with the obligations agreed upon in this\ncontract and any others established in the Procedures Manual (Manual de Procedimiento). As of the third\ndisbursement, the respective payment shall not be made if the regency report (informe de regencia) for the immediately preceding year has not been submitted to the satisfaction of Fonafifo.\n\nArticle 6°- In all other aspects not considered in this\nmodification, the Procedures Manual for the Payment\nof Environmental Services (Manual de Procedimientos para el Pago de los Servicios Ambientales) in force, published in Gazette No. 80, scope\n87 published on April 14, 2020, and its\nmodifications, remains unchanged."
