el artículo\n22 de la Ley de Biodiversidad N° 2/788, publicada en La Gaceta N° 101\ndel 27 de mayo de 1998; el artículo 32 de la Ley Orgánica del Ambiente N° 7554,\npublicada en La Gaceta N° 215 del 13 de noviembre de 1995, y los\nartículos I y 2 de la Ley Orgánica del Ministerio de Ambiente y Energía N°\n7152, publicada en La Gaceta N° 117 del 21 de junio de 1990.\n\nConsiderando:\n\nI.-Que es interés del Gobierno fortalecer\nlas estructuras administrativas en el campo de los recursos naturales, a fin dg\ncontar con políticas definidas que garanticen el uso racional de dichos\nrecursos.\n\nII.-Que la Reserva Nogal fue creada como\nRefugio de Vida Silvestre Privado mediante el Decreto Ejecutivo N° 32818-MINAE,\nel cual fue publicado en La Gaceta N° 11 del dieciséis de enero de 2006,\npor un período de 10 años.\n\nIII.-Que en noviembre de 2019 el señor\nJosé Luis Gómez Solano, cédula residencial\" de identidad 172400251121, en su\nentonces, representante legal de la empresa Chiquita Brands Costa Rica Sociedad\nde Responsabilidad Limitada, cédula jurídica N° 3-102009490, mediante nota\nescrita; presentó ante la oficina subregional de Sarapiquí del Sistema Nacional\nde Áreas de Conservación, solicitud de renovar la categoría de manejo de la\nReserva Nogal como Refugio Nacional de Vida Silvestre Privado.\n\nIV.-Que mediante criterio legal N°\nSINAC-AJ-CJ-001-2021, la Asesoría Jurídica de la Secretaría Ejecutiva del\nSistema Nacional de Áreas de Conservación, considera que existe viabilidad\njurídica para la renovación de Categoría de manejo de la Reserva Nogal como\nRefugio Nacional de Vida Silvestre Privado.\n\nV.-Que la Reserva Nogal, propiedad de\nChiquita Brands Costa Rica Sociedad de Responsabilidad Limitada, cédula\njurídica N° 3-102-009490, ubicada en la provincia de Heredia, cantón décimo,\nSarapiquí, distrito primero, Puerto Viejo; abarca los inmuebles inscritos bajo\nlas matrícula 4: N° 4-263623-000, con el plano N° 4-20822972018 con un área de\n584892 m2, la finca bajo matrícula 4-263621-000, con el plano\n04-2073856-2018, con un área de 310997m2 la finca bajo matrícula\n4-263622-000, con el plano 4-2076825-2018, con un área de 4084m2 y\nla finca bajo matrícula N° 4-263624- 000 con el plano N° 4-2078801-2018, con un\nárea de 20361 m2, es decir, un área total de 92,0334\nhectáreas.\n\nVI.-Que el área de la Reserva Nogal que\nactualmente se pretende renovar como Refugio Nacional de Vida Silvestre\nPrivado, se localiza a 8 kilómetros de la Estación Biológica La Selva entre el\nRío Sucio y una plantación de banano; se compone de tres fragmentos de bosque\nconectados por el Corredor Biológico Local Nogal-La Selva y un fragmento de\nárea ocupada por infraestructura y jardines que en total suman 92.0334\nhectáreas. Sus pendientes van de 0 a 5%, se inunda anualmente por las crecidas\nde dicho río y se encuentra a 45 m.s.n.m. Aparte de estar incluida en la\npropuesta del Corredor Biológico Mesoamericano, su área está incluida dentro de\nlas prioridades de protección para el pago de servicios ambientales, así como\nla perpetuación y protección de especies con poblaciones amenazadas y reducidas\nde flora y fauna.\n\nVII.-Que la naturaleza del área que se\ndesea renovar la categoría de manejo como Refugio de Vida Silvestre Privado es\nen su mayoría bosque secundario en diferentes etapas de sucesiones natural y no\nexisten evidencias de trochas ni claros producidos por aprovechamientos\nanteriores, ya que fueron colonizados por especies heliófilas. Que la flora y\nfauna que lo componen es variada y concordante con la que se establece en el\nPlan General de Manejo, como: Desmopsis schippii, Pseudobombax septenatum,\nVirola koschnyi, Cecropia sp, Bursera simaruba, Bauhinia sp, entre otras.\nTambién se encuentran gran variedad de especies de fauna algunas consideradas\ncon poblaciones reducidas y otras como en peligro de extinción: como Tapirus\nbairdii (danta), Leopardus pardalis (manigordo), Leopardus weidii (caucel),\nOdocoileus virginianus (venado cola blanca), Eira barbara tolomuco, Agouli paca\n(tepezcuintle), Canis latrans (coyote), Choloepus hoffmanni (perezoso de dos\ndedos), Galictis vitiata (grisón), además de Ateles geoffroyi (mono araña),\nCebus imitator (mono cara blanca) y Alouatta palliata (mono aullador). Que\nrespecto a aves se encuentran varias especies de psittacidos con poblaciones\nreducidas y dos especies con peligro de extinción como Ara ambiguus (lapa\nverde) y Ara macao (lapa roja), especies de la familia stringidae, de la cual\ndos especies son consideradas con poblaciones reducidas Megascops guatemalae y\nLophostrix cristata, gran variedad de especies de la familia trochilidae,\ntrogonidae, picidae, furnaridae, tirannidae, parulidae, thraupidae y\naccipifridae. Que en cuanto a anfibios abunda la especie Oophagu pumilio y está\npresente la Agalychnis callidryas, ambas especies consideradas con poblaciones\nreducidas, así como lo está una especie de reptil, el Crocodylus acutus\n(cocodrilo), presente en el Río Sucio, ecosistema inmediato y directamente\nasociado a la Reserva en el sector norte y este.\n\nVIII.-Que el área descrita, constituye un\nnúcleo muy importante para la conservación de la Vida Silvestre dentro de la\ncategoría de manejo de Refugio Nacional de Vida Silvestre Privado por las\ncaracterísticas propias del medio ambiente presente en la zona. Por continuar\ndesapareciendo de nuestro medio y por ende, de nuestro planeta los bosques y\nlas especies de vida silvestre esta categoría de manejo permite conservarlas y\nmanejarlas dentro de un desarrollo sostenible sirviendo a la vez como regulador\nambiental.\n\nIX.-Que, en el Plan General de Manejo\npresentado como parte de los requisitos para la renovación de la categoría como\nRefugio Nacional de Vida Silvestre Privado, se demuestra que es un área\nsilvestre creada con el objetivo primordial de conservación del bosque y la\nbiodiversidad, promover la conectividad boscosa, la educación ambiental,\nparticipación ciudadana y la investigación científica, así como el de\nestablecer y desarrollar las estrategias y programas de manejo que permitan el\ncumplimiento de los objetivos de creación de esta área silvestre protegida.\n\nX.-Que el propietario de los inmuebles\nantes mencionados accedió voluntariamente a incorporar nuevamente sus\npropiedades antes descritas, a la categoría de manejo de Refugio Nacional de\nVida Silvestre Privado.\n\nXI.-Que, partiendo del proceso de\nrenovación de Categoría de Manejo, se presenta y aprueba un nuevo Plan General\nde Manejo por parte del CONAC en acuerdo N° 15 de la Sesión Ordinaria N°\n23-2022, celebrada el 11 de octubre de 2022.\n\nXII.-Que, de conformidad con el Reglamento\na la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites\nAdministrativos, Decreto Ejecutivo N° 37045-MP-MEIC y sus reformas, se\ndeterminó que la presente propuesta no establece ni modifica trámites.\nrequisitos o procedimientos, que el administrado deba cumplir, situación por la\nque no se procedió con el trámite de control previo. Por tanto;\n\nDecretan:\n\n\"RENOVAR EL REFUGIO DE VIDA SILVESTRE\nPRIVADO NOGAL, CREADO MEDIANTE EL DECRETO\n\nEJECUTIVO N° 32818-MIIVAE\"\n\nArtículo 1º-Renuévese la categoría de\nmanejo para -la Reserva Nogal, como \"Refugio Nacional de Vida Silvestre Privado\nNogal\", creado mediante Decreto Ejecutivo N° 32818-MINAE, el cual fue publicado\nen la Gaceta N° 11 del dieciséis de enero de 2006; comprendido por los\ntres fragmentos de bosque y el área de infraestructura que suman noventa y dos\nhectáreas trescientos treinta y cuatro metros cuadrados (92,0334 hectáreas),\nubicados en la hoja cartográfica río Sucio 3 447 III, coordenadas geográficas\n(Datum WGS84) en la provincia de Heredia, cantón décimo, Sarapiquí, distrito primero\nPuerto Viejo, que forman parte de los inmuebles matrículas: N° 4-263623-000,\ncon el plano N 04-20822972018 con un área de 584892m2, la\nfinca bajo matrícula 4-263621-000, con el plano N° 42073856-2018, con un área\nde 310997m2, la finca bajo matrícula con el plano 4-2076825-2018,\ncon un área de 4084m2 y la finca bajo matrícula N°\n4-263624-000 con el plano N° 4-2078801-2018, con un área de 20361m2;\npropiedad de Chiquita Brands Costa Rica Sociedad de Responsabilidad Limitada,\ncédula jurídica N° 3-102-009490.\n\nArtículo 2º-El propietario de dichos\ninmuebles se compromete a no desarrollar ninguna actividad que no se encuentre\nestipulada en el respectivo plan general de manejo o sus adendum y que\ncomprometa la existencia o afecte negativamente la biodiversidad sin la debida\nautorización de las autoridades competentes.\n\nTambién se compromete a brindar toda la\ncolaboración necesaria a los funcionarios del Sistema Nacional de Áreas de\nConservación, para las labores de control y verificación de las políticas ambientales\nmediante el Área de Conservación Arenal Huetar Norte, así como a los\ninvestigadores e inspectores de recursos naturales, estudiantes y otros que\nesporádicamente visiten dicha área en las funciones propias de sus respectivos\ncargos, estudios e investigaciones. Asimismo, se compromete a cumplir con las\ndisposiciones que al efecto señalan la normativa jurídica ambiental vigente.\n\nArtículo 3º-Dicho inmueble estará sometido\na la categoría de Refugio Nacional de Vida Silvestre Privado. durante un periodo\nde diez años, prorrogables en periodos iguales en forma automática si el\npropietario no manifiesta dentro del término de tres meses antes del\nvencimiento del plazo, su deseo de no sometimiento de Su propiedad a la\ncategoría de Refugio Nacional de Vida Silvestre Privado.\n\nArtículo 4º-La administración del Refugio\nle compete al dueño de la propiedad, pero el MINAE, a través del SINAC\nsupervisará las actividades desarrolladas en el mismo, dictando las políticas\nen cuanto al manejo y uso de los recursos naturales y medio ambiente, de\nconformidad con los principios de desarrollo sostenible planteados en el plan\nde manejo.\n\nArtículo 5º-La presente declaratoria será\nderogada por la Administración, en caso de comprobarse incumplimiento del plan\nde manejo aprobado y la normativa jurídica ambiental que rige para los refugios\nnacionales de vida silvestre. De igual forma, se derogará la presente\ndeclaratoria en caso de desacato por parte del propietario, a las disposiciones\ntécnicas y recomendaciones que gire el Área de Conservación Arenal Huetar Norte\ny el Ministerio de Ambiente y Energía.\n\nArtículo 6º-Rige a partir de su\npublicación en el Diario Oficial La Gaceta.\n\nDado en la\nPresidencia de la República.-San José, el día veinticuatro del mes de abril del\naño dos mil veintitrés.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 44023\n\n Renew the Nogal Private Wildlife Refuge created by executive decree No. 32818-MINAE\n\nNo.\n44023-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn the exercise of\nthe powers conferred by articles 140, subsections 3) and 18), 146 of the\nPolitical Constitution of November 7, 1949; articles 27 subsection 1) and\n28 subsection 2) subparagraph b) of the General Law of Public Administration No. 6227,\npublished in La Gaceta No. 102 of May 30, 1978; article 1 of\nLey Forestal No. 7575, published in La Gaceta No. 72 of April 16,\n1996; articles 82 and 87 of the Wildlife Conservation Law No.\n7317, published in La Gaceta No. 235 of December 7, 1992;\narticles 150 and following of the Regulation to the Wildlife Conservation Law\nfor Fishing and National Wildlife Refuges No. 32633,\npublished in La Gaceta No. 180 of September 20, 2005; article\n22 of the Biodiversity Law No. 7788, published in La Gaceta No. 101\nof May 27, 1998; article 32 of the Organic Law of the Environment No. 7554,\npublished in La Gaceta No. 215 of November 13, 1995, and articles\n1 and 2 of the Organic Law of the Ministry of Environment and Energy No.\n7152, published in La Gaceta No. 117 of June 21, 1990.\n\nWhereas:\n\nI.—That it is in the Government's interest to strengthen\nthe administrative structures in the field of natural resources, in order to\nhave defined policies that guarantee the rational use of said\nresources.\n\nII.—That the Nogal Reserve was created as a\nPrivate Wildlife Refuge (Refugio de Vida Silvestre Privado) by Executive Decree No. 32818-MINAE,\nwhich was published in La Gaceta No. 11 of January sixteen, 2006,\nfor a period of 10 years.\n\nIII.—That in November 2019, Mr.\nJosé Luis Gómez Solano, residential identity card 172400251121, at that\ntime, legal representative of the company Chiquita Brands Costa Rica Sociedad\nde Responsabilidad Limitada, legal ID No. 3-102009490, by written\nnote; submitted to the Sarapiquí subregional office of the Sistema Nacional\nde Áreas de Conservación, a request to renew the management category of the\nNogal Reserve as a Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado).\n\nIV.—That by legal opinion No.\nSINAC-AJ-CJ-001-2021, the Legal Advisory Office of the Executive Secretariat of the\nSistema Nacional de Áreas de Conservación, considers that there is legal\nviability for the renewal of the management category of the Nogal Reserve as\na Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado).\n\nV.—That the Nogal Reserve, property of\nChiquita Brands Costa Rica Sociedad de Responsabilidad Limitada, legal\nID No. 3-102-009490, located in the province of Heredia, tenth canton,\nSarapiquí, first district, Puerto Viejo; encompasses the properties registered under\nthe registration numbers 4: No. 4-263623-000, with survey plan No. 4-20822972018 with an area of\n584892 m2, the farm under registration 4-263621-000, with survey plan\n04-2073856-2018, with an area of 310997m2 the farm under registration\n4-263622-000, with survey plan 4-2076825-2018, with an area of 4084m2 and\nthe farm under registration No. 4-263624-000 with survey plan No. 4-2078801-2018, with an\narea of 20361 m2, that is, a total area of 92.0334\nhectares.\n\nVI.—That the area of the Nogal Reserve that\nis currently intended to be renewed as a Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre\nPrivado), is located 8 kilometers from La Selva Biological Station between the\nRío Sucio and a banana plantation; it is composed of three forest fragments\nconnected by the Nogal-La Selva Local Biological Corridor (Corredor Biológico Local Nogal-La Selva) and a fragment of\nan area occupied by infrastructure and gardens that together total 92.0334\nhectares. Its slopes range from 0 to 5%, it is flooded annually by the floods\nof said river and it is located at 45 m.a.s.l. Apart from being included in the\nproposed Mesoamerican Biological Corridor (Corredor Biológico Mesoamericano), its area is included within\nthe protection priorities for the payment of environmental services (pago de servicios ambientales), as well as\nthe perpetuation and protection of species with threatened and reduced\npopulations of flora and fauna.\n\nVII.—That the nature of the area whose\nmanagement category is desired to be renewed as a Private Wildlife Refuge (Refugio de Vida Silvestre Privado) is\nmostly secondary forest in different stages of natural succession and there\nare no signs of skid trails or clearings produced by previous\nharvesting, since they were colonized by heliophilous species. That the flora and\nfauna that compose it are varied and consistent with that established in the\nGeneral Management Plan (Plan General de Manejo), such as: Desmopsis schippii, Pseudobombax septenatum,\nVirola koschnyi, Cecropia sp, Bursera simaruba, Bauhinia sp, among others.\nThere is also a great variety of fauna species, some considered\nto have reduced populations and others as endangered: such as Tapirus\nbairdii (tapir), Leopardus pardalis (ocelot), Leopardus weidii (margay),\nOdocoileus virginianus (white-tailed deer), Eira barbara (tayra), Agouli paca\n(lowland paca), Canis latrans (coyote), Choloepus hoffmanni (two-toed\nsloth), Galictis vitiata (grison), in addition to Ateles geoffroyi (spider monkey),\nCebus imitator (white-faced capuchin) and Alouatta palliata (mantled howler). That\nregarding birds, there are several psittacid species with reduced\npopulations and two endangered species such as Ara ambiguus (great green\nmacaw) and Ara macao (scarlet macaw), species of the stringidae family, of which\ntwo species are considered with reduced populations Megascops guatemalae and\nLophostrix cristata, a great variety of species of the trochilidae,\ntrogonidae, picidae, furnaridae, tirannidae, parulidae, thraupidae and\naccipifridae families. That as for amphibians, the species Oophagu pumilio abounds and\nAgalychnis callidryas is present, both species considered with reduced\npopulations, as is a reptile species, Crocodylus acutus\n(crocodile), present in the Río Sucio, an immediate ecosystem directly\nassociated with the Reserve in the north and east sector.\n\nVIII.—That the described area constitutes a\nvery important nucleus for the conservation of Wildlife within the\nmanagement category of Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado) due to the\nspecific characteristics of the environment present in the zone. Because\nforests and wildlife species continue to disappear from our environment and, therefore, from our planet, this management category allows for their conservation and\nmanagement within a framework of sustainable development, serving at the same time as an environmental\nregulator.\n\nIX.—That in the General Management Plan (Plan General de Manejo)\nsubmitted as part of the requirements for the renewal of the category as\na Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado), it is demonstrated that it is a wild\narea created with the primary objective of forest and\nbiodiversity conservation, promoting forest cover (boscosa) connectivity, environmental education,\ncitizen participation, and scientific research, as well as\nestablishing and developing the management strategies and programs that allow the\nfulfillment of the creation objectives of this protected wild area.\n\nX.—That the owner of the aforementioned\nproperties voluntarily agreed to once again incorporate his\nproperties described above, into the management category of Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado).\n\nXI.—That, based on the management category\nrenewal process, a new General Management Plan (Plan General de Manejo)\nis presented and approved by the CONAC in Agreement No. 15 of the Ordinary Session No.\n23-2022, held on October 11, 2022.\n\nXII.—That, in accordance with the Regulation\nto the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures,\nExecutive Decree No. 37045-MP-MEIC and its amendments, it was\ndetermined that this proposal does not establish or modify procedures,\nrequirements, or formalities that the administered party must comply with, a circumstance for\nwhich the prior review procedure was not carried out. Therefore;\n\nThey decree:\n\n\"RENEW THE NOGAL PRIVATE WILDLIFE\nREFUGE, CREATED BY EXECUTIVE\n\nDECREE No. 32818-MINAE\"\n\nArticle 1.—The management\ncategory for the Nogal Reserve is hereby renewed, as \"Nogal Private National Wildlife Refuge\n(Refugio Nacional de Vida Silvestre Privado Nogal)\", created by Executive Decree No. 32818-MINAE, which was published\nin La Gaceta No. 11 of January sixteen, 2006; comprised of the\nthree forest fragments and the infrastructure area totaling ninety-two\nhectares and three hundred thirty-four square meters (92.0334 hectares),\nlocated on the Río Sucio 3447 III cartographic sheet, geographic coordinates\n(Datum WGS84) in the province of Heredia, tenth canton, Sarapiquí, first district\nPuerto Viejo, which form part of the properties registered under: No. 4-263623-000,\nwith survey plan No. 04-20822972018 with an area of 584892m2, the\nfarm under registration 4-263621-000, with survey plan No. 42073856-2018, with an area\nof 310997m2, the farm under registration with survey plan 4-2076825-2018,\nwith an area of 4084m2 and the farm under registration No.\n4-263624-000 with survey plan No. 4-2078801-2018, with an area of 20361m2;\nproperty of Chiquita Brands Costa Rica Sociedad de Responsabilidad Limitada,\nlegal ID No. 3-102-009490.\n\nArticle 2.—The owner of said\nproperties undertakes not to develop any activity that is not\nstipulated in the respective general management plan (plan general de manejo) or its addenda and that\njeopardizes the existence of or negatively affects biodiversity without the due\nauthorization of the competent authorities.\n\nThey also undertake to provide all\nnecessary collaboration to the officials of the Sistema Nacional de Áreas de\nConservación, for the control and verification tasks of the environmental policies\nthrough the Área de Conservación Arenal Huetar Norte, as well as to\nnatural resource researchers and inspectors, students, and others who\nsporadically visit said area in the functions inherent to their respective\npositions, studies, and research. Likewise, they undertake to comply with the\nprovisions indicated for this purpose by the current environmental legal regulations.\n\nArticle 3.—Said property will be subject\nto the category of Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado) for a period\nof ten years, automatically renewable for equal periods if\nthe owner does not express, within three months before the\nexpiration of the term, their desire to not subject their property to the\ncategory of Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado).\n\nArticle 4.—The administration of the Refuge\nfalls to the owner of the property, but the MINAE, through the SINAC\nwill supervise the activities developed therein, dictating the policies\nregarding the management and use of natural resources and the environment, in\naccordance with the principles of sustainable development set forth in the management\nplan (plan de manejo).\n\nArticle 5.—This declaration shall be\nrevoked by the Administration, in case of proven non-compliance with the\napproved management plan (plan de manejo) and the environmental legal regulations governing national\nwildlife refuges. Likewise, this declaration shall be revoked\nin case of disregard by the owner of the\ntechnical provisions and recommendations issued by the Área de Conservación Arenal Huetar Norte\nand the Ministry of Environment and Energy.\n\nArticle 6.—It becomes effective upon its\npublication in the Official Gazette La Gaceta.\n\nGiven at the\nPresidency of the Republic.—San José, on the twenty-fourth day of April\ntwo thousand twenty-three." }
