Y es bajo este marco que Costa Rica entregó su Compromiso\nNacionalmente Determinado (NDC) donde se encuentra el compromiso a realizar el\nPlan de Acción de Género y Cambio Climático.\n\nIII.-Que la formulación de la Política\nNacional de Cambio Climático fue un proceso pionero en Costa Rica,\nparticipativo e innovador, con una alta coordinación interinstitucional y\nmultisectorial que incorpora la perspectiva de género, el enfoque de Derechos\nHumanos y los conocimientos tradicionales para fortalecer las acciones\nclimáticas de adaptación de los procesos operativos anuales de las\ninstituciones públicas, los entes privados y la sociedad civil.\n\nIV.-Que la aspiración política para el\n2030 es ser un país que transforma las amenazas en oportunidades, fortalece sus\ncapacidades y condiciones para la resiliencia social, ambiental y económica,\npreviene y se recupera ante los efectos adversos del cambio climático de forma\nmedible, verificable y reportable.\n\nV.-Que Costa Rica ha ratificado y puesto\nen marcha acciones a favor de la igualdad entre mujeres y hombres y el avance\nde los derechos humanos de las mujeres, de acuerdo con lo establecido en\nnormativa supraconstitucional, principalmente la Convención para la Eliminación\nde todas las formas de Discriminación contra la Mujer-CEDAW y la Declaración y\nPlataforma de Acción de Beijing.\n\nVI.-Que Costa Rica, en una alianza\ntripartita entre la Facultad Latinoamericana de Ciencias Sociales-FLACSO, el\nMinisterio de Ambiente y Energía-MINAE y el Instituto Nacional de la\nMujeres-INAMU lideró la Coalición Feminismo por la Justicia Climática del Foro\nGeneración Igualdad, iniciativa mundial de revisión y actualización de la\nPlataforma de Acción de Beijing.\n\nVII.-Que los Objetivos de Desarrollo\nSostenible (ODS) constituyen las aspiraciones universales para poner fin a la\npobreza, proteger el planeta y garantizar la paz y prosperidad sin dejar a\nnadie atrás, siendo la igualdad entre los géneros (ODS 5) y la acción climática\n(ODS13) dos de los 17 objetivos que contribuyen a dicho propósito.\n\nVIII.-Que existen acuerdos y mandatos internacionales para la\nincorporación de la perspectiva de género en la acción climática emanados\nprincipalmente del Programa de Trabajo de Lima sobre Género acordado en la COP\n20 de 2014 y sus Planes de Acción de Género.\n\nIX.-Que en el marco de los compromisos\nglobales emanados del Acuerdo París (2015), Costa Rica presenta en el 2020 la\nactualización de sus Compromisos Nacionalmente Determinados, entre los que\ndestaca \"5.2 Al 2022 el país contará con un Plan de Acción en Género y Cambio\nClimático.\"\n\nX.-Que la\nperspectiva de género ha sido considerada como enfoque y eje transversal en las\npolíticas públicas en materia ambiental, cambio climático y gestión del riesgo,\nen especial, la Política Nacional de Adaptación al Cambio Climático y el Plan\nNacional de Descarbonización.\n\nXI.-Que la Política Nacional para la\nIgualdad Efectiva entre Mujeres y Hombres 2018-2030 contempla la perspectiva de\nsostenibilidad, así como resultados esperados vinculados a cambio climático en\nlos compromisos institucionales inscritos en sus Planes de Acción.\n\nXII.-Que la alianza interinstitucional\nentre el Ministerio de Ambiente y Energía y el Instituto Nacional de las\nMujeres en materia de igualdad de género y ambiente se consolida\nsignificativamente a través de la construcción, implementación y seguimiento\ndel presente Plan, así como del involucramiento proactivo de otras\ninstituciones públicas, gobiernos locales, organizaciones de sociedad civil y\ncooperación internacional a favor de la igualdad entre mujeres y hombres en\narmonía con la naturaleza.\n\nXIII.-Que, de conformidad con el\nReglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y\nTrámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC y sus reformas, se\ndeterminó que la presente propuesta no establece ni modifica trámites,\nrequisitos o procedimientos que el administrado deba cumplir, situación por la\ncual no se procedió con el trámite de control previo. Por tanto;\n\nDecretan:\n\nDECLARATORIA DE INTERÉS PÚBLICO\n\n\"PLAN DE ACCIÓN NACIONAL SOBRE IGUALDAD\n\nDE GÉNERO EN LA ACCIÓN CLIMÁTICA-PGCC\n\nCOMPROMISO NACIONALMENTE DETERMINADO\n\nACUERDO PARÍS\"\n\nArtículo 1º-Interés Público. Se\ndeclara de interés público el \"Plan De Acción Nacional Sobre Igualdad De Género\nEn La Acción Climática-PGCC Compromiso Nacionalmente Determinado Acuerdo París\"\nque crea el mecanismo de gobernanza y gestión para la promoción, impulso,\nejecución, seguimiento, rendición de cuentas, evaluación, actualización de los\nejes de trabajo y acciones de dicho Plan.\n\nArtículo 2º-Alcance. Se insta a la\nAdministración Central y Descentralizada para que, dentro del marco de sus\ncompetencias y en estricto apego al ordenamiento jurídico, brinden todas las\nfacilidades y cooperación requeridas para la correcta, exitosa, eficaz y\neficiente realización de los aspectos descritos en el artículo anterior.\n\nArtículo 3º-Mecanismo de Gobernanza.\nEl Ministerio de Ambiente y Energía-MINAE, como institución rectora nacional y\npunto focal internacional en materia de ambiente y acción climática, junto con\nel Instituto Nacional de las Mujeres- INAMU mecanismo nacional para el avance\nde los derechos humanos de las mujeres e institución rectora en materia de\nigualdad entre mujeres y hombres, serán las instituciones coordinadoras,\nvigilantes e informantes de los avances y actualizaciones del PGCC.\n\nDicha coordinación contará con la\nparticipación de instituciones rectoras en los sectores priorizados del PGCC:\nel Ministerio de Agricultura y Ganadería-MAG, el Instituto Costarricense de\nTurismo-ICT, el Ministerio de Obras Públicas y Transportes-MOPT, la Comisión\nNacional para la Prevención del Riesgo y Atención de Emergencias-CNE, sin ser\nexcluyente de otras instituciones que manifiesten explícitamente su interés en\nformar parte de esta alianza para la implementación de acciones estratégicas\nconsecuentes con los objetivos de este Plan.\n\nAsimismo, se insta\nel involucramiento y participación de los gobiernos locales y mecanismos de\nplanificación regional, en estrecha coordinación con el mecanismo de gobernanza\ndefinido en este decreto.\n\nMINAE e INAMU deberán coordinar la gestión de cooperación técnica\ny financiera especializada interinstitucional, internacional, de sociedad civil\ny/o público-privada, mediante la designación de los equipos técnicos\nespecializados que articulen iniciativas; pudiendo establecer convenios\nespecíficos de cooperación pública - pública y público-privada, incluyendo\ntriangular colaboraciones.\n\nArtículo 4º-Mecanismo de gestión,\nseguimiento y rendición de cuentas. El MINAE y el INAMU definirán y crearán\nuna Unidad de Gestión con apoyo y comunicación permanente con los Despachos\nMinisteriales y Municipales, que convoque un equipo técnico vinculado a las\ninstituciones contraparte del PGCC para conformar la Red Nacional de Igualdad\nEfectiva entre Mujeres y Hombres en la Acción Climática, la cual tendrá las\nsiguientes funciones:\n\na) Coordinar, dar seguimiento y monitoreo\na los avances en la implementación del presente Plan.\n\nb) Aumentar la generación de capacidades y\nla experticia temática a nivel nacional para la mejor implementación del plan.\n\nc) Promover la identificación constante de\nlos impactos y necesidades diferenciadas de los efectos de la crisis climática\nsobre las mujeres.\n\nd) Elaborar y divulgar material\ninformativo y formativo sobre las relaciones entre las metas de los ODS 5 y 13.\n\ne) Propiciar la participación y aportes de\nlas mujeres en la acción a favor del clima y conservación de la biodiversidad.\n\nEsta Red también podrá integrar la\nrepresentación de mecanismos regionales que incorporen en sus agendas de trabajo\ninterinstitucional e intersectorial objetivos y acciones afines a los\npropuestos por el Plan Nacional de Acción sobre Igualdad de Género en la Acción\nClimática.\n\nArtículo 5º-Periodicidad. And it is under this framework that Costa Rica submitted its Nationally\nDetermined Contribution (NDC) which includes the commitment to carry out the\nGender and Climate Change Action Plan.\n\nIII.—That the formulation of the National\nClimate Change Policy was a pioneering process in Costa Rica,\nparticipatory and innovative, with high inter-institutional and\nmultisectoral coordination that incorporates the gender perspective, the Human\nRights approach, and traditional knowledge to strengthen the climate adaptation\nactions of the annual operational processes of\npublic institutions, private entities, and civil society.\n\nIV.—That the political aspiration for\n2030 is to be a country that transforms threats into opportunities, strengthens its\ncapacities and conditions for social, environmental, and economic resilience,\nprevents and recovers from the adverse effects of climate change in a\nmeasurable, verifiable, and reportable manner.\n\nV.—That Costa Rica has ratified and\nimplemented actions in favor of equality between women and men and the advancement\nof women's human rights, in accordance with what is established in\nsupra-constitutional regulations, mainly the Convention on the Elimination of\nAll Forms of Discrimination against Women-CEDAW and the Beijing Declaration and\nPlatform for Action.\n\nVI.—That Costa Rica, in a tripartite\nalliance between the Latin American Faculty of Social Sciences-FLACSO, the\nMinistry of Environment and Energy-MINAE, and the National Institute for\nWomen-INAMU led the Feminism for Climate Justice Coalition of the Generation\nEquality Forum, a global initiative for the review and updating of the\nBeijing Platform for Action.\n\nVII.—That the Sustainable Development\nGoals (SDGs) constitute the universal aspirations to end\npoverty, protect the planet, and ensure peace and prosperity without leaving\nanyone behind, with gender equality (SDG 5) and climate action\n(SDG 13) being two of the 17 goals that contribute to this purpose.\n\nVIII.—That there exist international agreements and mandates for the\nincorporation of the gender perspective into climate action, emanating\nmainly from the Lima Work Programme on Gender agreed upon at COP\n20 in 2014 and its Gender Action Plans.\n\nIX.—That within the framework of the global\ncommitments emanating from the Paris Agreement (2015), Costa Rica presented in 2020 the\nupdate of its Nationally Determined Contributions, among which\nstands out \"5.2 By 2022 the country will have a Gender and Climate\nChange Action Plan.\"\n\nX.—That the\ngender perspective has been considered as an approach and cross-cutting axis in\npublic policies on environmental matters, climate change, and risk management,\nin particular, the National Climate Change Adaptation Policy and the National\nDecarbonization Plan.\n\nXI.—That the National Policy for\nEffective Equality between Women and Men 2018-2030 contemplates the perspective of\nsustainability, as well as expected results linked to climate change in\nthe institutional commitments registered in its Action Plans.\n\nXII.—That the inter-institutional alliance\nbetween the Ministry of Environment and Energy and the National Institute for\nWomen in matters of gender equality and the environment is significantly consolidated\nthrough the construction, implementation, and monitoring\nof this Plan, as well as through the proactive involvement of other\npublic institutions, local governments, civil society organizations, and\ninternational cooperation in favor of equality between women and men in\nharmony with nature.\n\nXIII.—That, in accordance with the\nRegulation to the Law for the Protection of Citizens from Excessive\nAdministrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC and its amendments, it was\ndetermined that this proposal does not establish or modify\nprocedures, requirements, or formalities that the citizen must comply with, a situation for\nwhich the prior control procedure was not carried out. Therefore;\n\nDecree:\n\nDECLARATION OF PUBLIC INTEREST\n\n\"NATIONAL ACTION PLAN ON GENDER EQUALITY\n\nIN CLIMATE ACTION-PGCC\n\nNATIONALLY DETERMINED CONTRIBUTION\n\nPARIS AGREEMENT\"\n\nArticle 1.—Public Interest. The\n\"National Action Plan on Gender Equality\nin Climate Action-PGCC Nationally Determined Contribution Paris Agreement\"\nis declared of public interest, which creates the governance and management mechanism for the promotion, advancement,\nexecution, monitoring, accountability, evaluation, and updating of the\nwork axes and actions of said Plan.\n\nArticle 2.—Scope. The Central and Decentralized\nAdministration is urged, within the framework of its\ncompetencies and in strict adherence to the legal order, to provide all\nthe facilities and cooperation required for the correct, successful, effective, and\nefficient realization of the aspects described in the previous article.\n\nArticle 3.—Governance Mechanism.\nThe Ministry of Environment and Energy-MINAE, as the national governing institution\nand international focal point on environment and climate action matters, together with\nthe National Institute for Women-INAMU, the national mechanism for the advancement\nof women's human rights and governing institution on\nequality between women and men, shall be the coordinating,\noverseeing, and reporting institutions for the progress and updates of the PGCC.\n\nSaid coordination shall include the\nparticipation of governing institutions in the prioritized sectors of the PGCC:\nthe Ministry of Agriculture and Livestock-MAG, the Costa Rican Institute of\nTourism-ICT, the Ministry of Public Works and Transport-MOPT, the National\nCommission for Risk Prevention and Emergency Response-CNE, without being\nexclusive of other institutions that explicitly express their interest in\nbeing part of this alliance for the implementation of strategic actions\nconsistent with the objectives of this Plan.\n\nLikewise, the\ninvolvement and participation of local governments and regional\nplanning mechanisms is urged, in close coordination with the governance mechanism\ndefined in this decree.\n\nMINAE and INAMU must coordinate the management of specialized technical\nand financial cooperation—inter-institutional, international, from civil society,\nand/or public-private—through the designation of the specialized technical\nteams that articulate initiatives; being able to establish\nspecific public-public and public-private cooperation agreements, including\ntriangular collaborations.\n\nArticle 4.—Management, Monitoring,\nand Accountability Mechanism. MINAE and INAMU shall define and create\na Management Unit with permanent support and communication with the Ministerial\nand Municipal Offices, which convenes a technical team linked to the\ncounterpart institutions of the PGCC to form the National Network for Effective\nEquality between Women and Men in Climate Action, which shall have the\nfollowing functions:\n\na) Coordinate, follow up on, and monitor\nthe progress in the implementation of this Plan.\n\nb) Increase capacity building and\nthematic expertise at the national level for the best implementation of the plan.\n\nc) Promote the constant identification of\nthe differentiated impacts and needs of the effects of the climate crisis\non women.\n\nd) Develop and disseminate informational\nand educational material on the relationships between the goals of SDG 5 and 13.\n\ne) Foster the participation and contributions of\nwomen in climate action and biodiversity conservation.\n\nThis Network may also integrate\nthe representation of regional mechanisms that incorporate into their inter-institutional\nand intersectoral work agendas objectives and actions related to those\nproposed by the National Action Plan on Gender Equality in Climate\nAction.\n\nArticle 5.—Periodicity. The PGCC\nshall be in force until 2025 and shall be updated every 5 years within the framework of\nthe national updates of the NDC.\n\nArticle 6.—Effective Date.
