  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Directive 007\n\n                        Cancellation of boundary markers numbered 01 through 13 of the delimitation of the public zone of the maritime-terrestrial zone in the Playa Guiones sector, District 06 Nosara, Canton 02 Nicoya, Province 05 Guanacaste\n\nNATIONAL GEOGRAPHIC INSTITUTE (INSTITUTO GEOGRÁFICO NACIONAL, IGN)\n\nTOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT\n\nNOTICE Nº 007-2023\n\nMARITIME-TERRESTRIAL ZONE (ZONA MARÍTIMO TERRESTRE)\n\nCANCELLATION OF BOUNDARY MARKERS NUMBERED 01\nTHROUGH 13 OF THE DELIMITATION OF THE PUBLIC ZONE\nOF THE MARITIME-TERRESTRIAL ZONE IN THE\nPLAYA GUIONES SECTOR, DISTRICT 06° NOSARA,\nCANTON 02° NICOYA, PROVINCE 05° GUANACASTE\n\nBased on the provisions of Articles 140 and 240 subsection 1 of Law N°6227, General Law of Public Administration, dated May 2, 1978, and its amendments; Law N°59, Law Creating the National Geographic Institute, of July 4, 1944, in effect since January 1, 1945, and its amendments; Law N°8905, Law Transferring the National Geographic Institute to the National Registry, dated December 7, 2010; Law Nº6043, Law on the Maritime-Terrestrial Zone, of March 2, 1977, and its amendments and its Regulation; and Articles 2 and 3 of Law N°5695, Law Creating the National Registry, dated May 28, 1975, and its amendments.\n\nConsidering:\n\n1º-That by means of the Notice published on page 20 of Official Gazette La Gaceta N° 74 of April 20, 1981, it is mentioned that the officialization of the boundary-marking of the public zone in the northern portion of Playa Guiones, district 01° (currently district 06) Nosara, canton 02° Nicoya, province 05° Guanacaste, was carried out, with the establishment of 13 boundary markers numbered 01 through 13.\n\n2º-That in accordance with Law N°59, the IGN Law, and in Article 62 of the Regulation to Law N°6043, the competence of the IGN is recognized for the delimitation of the public zone of the Maritime-Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that \"The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n3º-That Article 140 of Law N°6227, the General Law of Public Administration, states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted,\" a provision that must necessarily be related to numeral 204, subsection\n\n1) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: \"General acts shall be communicated by publication and specific ones, by notification.\"\n\nCOMMUNICATES:\n\n1º-That based on the demarcation published in Official Gazette La Gaceta N° 74 of April 20, 1981, page 20, boundary markers numbered 1 through 13 are hereby removed from the Maritime-Terrestrial Zone Registry.\n\n2º-The beach sectors located in Playa Guiones, district 06° Nosara, canton 02° Nicoya, province 05° Guanacaste, which to date have a delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette La Gaceta, maintain their official status.\n\n3º-This takes effect from its publication.\n\nIssued in Curridabat on the 22nd day of June of the year 2023."
