  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 187\n\n                        Establece el límite de gasto al Fondo Nacional de Financiamiento Forestal,\npara los contratos a formalizar en el año 2023, las actividades a financiar y los montos de pago por\nactividad\n\nMINISTERIO\nDE AMBIENTE Y ENERGÍA\n\nR-187-2023-MINAE MINISTERIO DE\nAMBIENTE Y ENERGÍA\n\nSan José, a las 07 horas 39 minutos del 23 de junio de\n2023.\n\nSe establece al Fondo Nacional de Financiamiento\nForestal la cantidad de hectáreas a financiar por actividad en el Programa de\nPago por Servicios Ambientales y el monto a pagar con base en los recursos\nasignados.\n\nRESULTANDO\nÚNICO.\n\nQue para el ejercicio 2023 el Presupuesto Nacional\ndispone un total de DIEZ MIL NOVECIENTOS TREINTA Y CUATRO MILLONES\nSETECIENTOS VEINTINUEVE MIL NOVECIENTOS NOVENTA COLONES CON 00/100 (¢\n10.934.729.990,00) para el Programa de Pago por Servicios Ambientales, los\ncuales serán utilizados para el pago de los compromisos de contratos PSA de\naños anteriores y la incorporación de nuevas hectáreas para el año 2023.\n\nCONSIDERANDO\n\nPRIMERO: Que el\nartículo 38 del Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo N°\n25721-MINAE, del 17 de octubre de 1996 y sus reformas, dispone que el Ministro\nde Ambiente y Energía como Jerarca del Ministerio de Ambiente y Energía, en\nfunciones de la Administración Forestal del Estado, emitirá anualmente mediante\nResolución Ministerial, las actividades a financiar en el Programa de Pago por\nServicios Ambientales y los montos a pagar con base en los recursos asignados\nen el Presupuesto Nacional para el ejercicio del año fiscal 2023.\n\nSEGUNDO: Que bajo\neste principio, los instrumentos financieros deben orientarse a apoyar los\npilares del Plan Nacional de Desarrollo y de Inversión Pública 2023-2026\n(Rogelio Fernández Güell) considerando los objetivos de la creación del Fondo\nNacional de Financiamiento Forestal según la citada Ley Forestal, sin dejar de\nlado los criterios de orden técnico establecidos.\n\nTERCERO: Que el Plan\nNacional de Desarrollo citado, considera como una de las metas nacionales el\nmantener bajo el Programa de Pago por Servicios Ambientales, al menos\ndoscientas cincuenta mil hectáreas (250.000 has), en sus diferentes\nactividades.\n\nCUADRO: Que, el\nMinisterio de Ambiente y Energía ha emitido los Principios Rectores del Sector\nForestal Productivo, mediante el Decreto Ejecutivo N°41772-MINAE, así como los\nlineamientos a considerar en las gestines\ninstitucionales para la reactivación y promoción de la reforestación en el\npaís.\n\nQUINTO: Que en\nvirtud de los esfuerzos para lograr el reconocimiento internacional del aporte\nde los bosques en la reducción de emisiones de gases de efecto invernadero, el\nGobierno de Costa Rica, suscribe un ERPA (contrato de compra venta de reducción\nde emisiones) con el Banco Internacional de Reconstrucción y Fomento, el 9 de\ndiciembre del año 2020, el cual en su plan de distribución de beneficios se\ndispuso la creación de un mecanismo de pago por servicios ambientales\nespecializado en la reducción de emisiones, el cual posee condiciones\ndiferenciadas, este instrumento es el CREF. (Contrato de Reducción de Emisiones\nForestales).\n\nEl citado instrumento\nse integra a el acuerdo suscrito por el Ministerio de Ambiente y Energía, el 10\nde febrero del 2021, con el Fondo Verde de las Naciones Unidas, a través de la\nagencia implementadora PNUD Programa de Naciones Unidas para el Desarrollo,\ndenominado cuyos recursos complementaran la negociación con el BIRF, antes\nindicado.\n\nSEXTO: Que, en virtud de la\npublicación del Decreto Ejecutivo N° 43665-MP-MEIC del 31 de agosto del 2022 y\ndel Decreto Ejecutivo N° 43649-MINAE del 31 de agosto del 2022, se realizó una\nrevisión de la presentación de los requisitos iniciales y documentos necesarios\nen las fincas en posesión, lo que facilita, simplifica y habilita la\nparticipación de los poseedores y poseedoras de bosque en el acceso a los\ndiferentes esquemas de financiamiento.\n\nPOR TANTO\n\nEL MINISTRO DE AMBIENTE\nY ENERGÍA\n\nRESUELVE\n\nArtículo 1°-Establecer el límite\nde gasto al Fondo Nacional de Financiamiento Forestal, para los contratos a\nformalizar en el año 2023, las actividades a financiar y los montos de pago por\nactividad.\n\n1.Actividades a financiar: Para el año 2023, se considerarán dos modalidades a\nfinanciar;a-Recuperación de la Cobertura Forestal, que incluye las actividades de\nReforestación,Regeneración y Sistemas Agroforestales y b-Mantenimiento de la Cobertura Forestal,\nqueincluye Protección de bosque y Manejo de bosque. Para tal fin, se establece la\nsiguientedistribución:\n\n| Modalidades de PSA | Actividad | Cantidad | | --- | --- | --- | | Recuperación de la Cobertura\nForestal* | Reforestación con especies de rápido crecimiento | 1.000 hectáreas | | Reforestación con\nespecies de mediano crecimiento | 3.000 hectáreas |  | | Plantaciones Forestales con Turnos de\nRotación Reducidos (PFTRR) | 1.000 hectáreas |  | | Regeneración Natural | 3.000 hectáreas |  |\n\n \n\n|  | Establecimiento de árboles en Sistemas Agroforestales | 500.000 árboles | | --- | --- | --- | |\nSistemas Agroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF) | 50.000\nárboles |  | | Sistemas Mixtos en Agroforestería para micro productores | 50.400 árboles |  | |\nMantenimiento de la Cobertura Forestal | Protección de Bosque | 55.833 hectáreas | | Protección de\nBosque para el resguardo del Recurso Hídrico | 5.000 hectáreas |  | | Manejo de bosque** | 450\nhectáreas |  |\n\n*: El Fonafifo dará trámite a todas las solicitudes de ingreso que se presenten en las sub\nactividades de Reforestación por 600 hectáreas y Sistemas Agroforestales, con especies contenidas en\nlos decretos ejecutivos de veda y especies amenazadas o en peligro de extinción (Decreto N°\n25663-MINAE y Decreto N° 25700-MINAE y sus reformas). **: Se refieren a todas las solicitudes de\ningreso con fincas en las cuales se ha finalizado el plan de manejo forestal a satisfacción de la\nAdministración Forestal del Estado (AFE). Para la ejecución del proyecto piloto de manejo de bosque\nse disponen de 154 hectáreas adicionales a contratar. Apartir del año 2022, se habilita un mecanismo\nderivado y financiado con recursos provenientes de contratos y acuerdos de Reducción de Emisiones\nproducidas por los bosques; con una cantidad de 450.000 hectáreas. Esta actividad reconoce\nprincipalmente el servicio ambiental de reducción de emisiones de gases de efecto invernadero, pero\nse puede complementar con el reconocimientos de otros servicios ambientales cuando hayan recursos\npara tal fin, en adelante, contratos CREF. El Fondo Nacional de Financiamiento Forestal, podrá\nvariar la distribución establecida en el cuadro anterior, de acuerdo con la disponibilidad del\npresupuesto aprobado para el Programa de Pago por Servicios Ambientales. Se faculta a Fonafifo para\nque redistribuya los recursos presupuestados de la modalidad de Recuperación de la Cobertura\nForestal no comprometidos al 26 de junio de cada año, para que se programen a la actividad de CREF.\nDe disponer de una mayor asignación de recursos, según el artículo 5 de la Ley de Simplificación y\nEficiencia Tributarias N° 8114 publicada en La Gaceta N° 131, del día 9 de julio de 2001 y otros\nrecursos financieros que capte el Fonafifo para el Pago por Servicios Ambientales, se distribuirán\nsegún el criterio de los financiadores y de las autoridades del Ministerio (o autoridades\ncorrespondientes). En todo caso, los recursos utilizados para estos fines, deberán ser incorporados\nen el presupuesto institucional o al Fideicomiso 544 Fonafifo/BNCR.\n\n            2.De\nlos montos de pago por actividad y otras condiciones:2.1. Actividad de\nReforestación: Las condiciones que regirán para el trámite de solicitudes,\npara el reconocimiento de los servicios ambientales en la actividad de\nReforestación, son las siguientes:\n\na)El monto a pagar para las especies de rápido crecimiento referidas a: Gmelina arborea,Acacia\nmangium, Vochysia guatemalensis y Vochysia hondurensis, será de setecientosochenta y tres mil seis\ncientos cuarenta y cuatro colones con 00/100 (¢783,644) porhectárea, desembolsados durante un\nperíodo de cinco años. Los pagos serán distribuidosde la siguiente forma: 50% el primer año, 20% el\nsegundo año, 15% el tercer año, 10% elcuarto año y 5% el quinto año.\n\nb)El monto a pagar para las especies de mediano crecimiento referidas a: Tectona grandis,Pinus sp,\nCordia alliodora, Vochysia ferruginea, Eucalyptus sp y Cedrela odorata, será deochocientos ochenta y\ntres mil quinientos cuarenta setenta y seis colones con 00/100(¢883,576) por hectárea, desembolsados\ndurante un período de cinco años. Los pagos serándistribuidos de la siguiente forma: 50% el primer\naño, 20% el segundo año, 15% el terceraño, 10% el cuarto año y 5% el quinto año.\n\nc)El monto a pagar para especies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8\nde octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, seráde un millón trescientos veinti\ncinco mil trescientos sesenta y seis colones con 00/100(¢1,325,366) por hectárea, desembolsados\ndurante un período de cinco años. Los pagosserán distribuidos de la siguiente forma: 50% el primer\naño, 20% el segundo año, 15% eltercer año, 10% el cuarto año y 5% el quinto año.\n\nd)El\nmonto a pagar para las Plantaciones Forestales con Turnos de Rotación\nReducidos(PFTRR) para especies de rápido crecimiento para embalaje, será de\ncuatrocientos veintiunmil seiscientos veinti ocho colones con 00/100 (¢421,628) por hectárea, Los\npagos serándistribuidos de la siguiente forma: 50% el\nprimer año, 25% el segundo año y 25% el cuartoaño.\n\ne)Las\ncondiciones que regirán para el trámite de solicitudes, para el reconocimiento\nde losservicios ambientales en la actividad de\nReforestación proyecto piloto PSA + Crédito, sonlas\nsiguientes:\n\ni.El monto a pagar para el proyecto piloto PSA + Crédito con la especie de rápidocrecimiento\nreferida a: Gmelina arborea, será de cuatrocientos veintiun mil seiscientosveinti ocho colones con\n00/100 (¢421,628) por hectárea, desembolsados en 6 tractosde acuerdo a la siguiente distribución\nprimer año 11%, segundo año 16%, tercer año17%, cuarto año 18%, quinto año 19% y el sexto año el 19%\nrestante que se girara,siempre y cuando el beneficiario haya consentido mediante documento formal.\n\nf)Plantaciones Forestales establecidas con recursos propios para pago por resultados. Losmontos a\npagar serán los establecidos, en los incisos a, b, y c anteriores. Los montos serán distribuidos de\nla siguiente forma: con la firma del contrato un 50%, doce, veinticuatro, treinta y seis y cuarenta\ny ocho meses después de dicha firma un 20%, 15%, 10% y 5% respectivamente. Los contratos tendrán la\nvigencia prevista en el artículo 2 incisos a y b de esta resolución, pero se reconocerán los años de\nexistencias de estas plantaciones; hasta un máximo de 3 años de establecidas.\n\ng)Las personas físicas o jurídicas que deseen reforestar en áreas mayores al tope establecidoen el\nReglamento a la Ley Forestal, Decreto N° 25721-MINAE y sus Reformas, podránaplicar en un esquema\nespecial de financiamiento, pudiendo duplicar el tope de 750hectáreas, siempre y cuando los recursos\ndisponibles no sean utilizados por los pequeñosproductores. Los montos a pagar serán los\nestablecidos, en los incisos a, b y c anteriores.\n\nh)Se instruye al Fondo Nacional de Financiamiento Forestal para que incorpore en loscontratos de\nPago por Servicios Ambientales en la actividad de Reforestación y SistemasAgroforestales en Bloque,\nlos valores mínimos aceptables para realizar los pagos. \n\nEl\nFondo Nacional de Financiamiento Forestal utilizará los siguientes valores de\nreferencia para tramitar los pagos correspondientes a cada año:\n\nCuadro 1. Dichos\npagos corresponden al total de años del plazo convenido; noobstante, a fin de permitir el\nestablecimiento de la plantación y su mantenimiento, seadelantará durante los primeros cinco años.\n\nc)El\nFonafifo podrá modificar cuando así se solicite,\naquellos contratos suscritos antesdel año 2013, que\ndemuestren haber alcanzado una producción mínima de 13 metroscúbicos\nde incremento medio anual por hectárea. Para tales efectos, el Fonafifo podrásolicitar la\ninformación que considere pertinente.\n\n2.2. Actividad de Regeneración Natural:\nLas condiciones que regirán para el trámite de solicitudes, para el\nreconocimiento de los servicios ambientales en la actividad de Regeneración\nNatural, que se desarrollen en áreas denudadas, sin cobertura forestal, con\nfuentes semilleras cercanas, en áreas en proceso de\nregeneración que no cumplen con la definición de bosque y libres de pastoreo;\nse detallan a continuación. \n\na)El monto a pagar en Regeneración Natural, será de ciento diecisiete mil novecientoscuarenta y ocho\ncolones con 00/100 (¢117.948) por hectárea, desembolsados en cincopagos anuales de 20% durante un\nperíodo de cinco años.\n\n2.3. Actividad de Sistemas Agroforestales: Las condiciones que regirán\npara el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Sistemas Agroforestales, se detallan a\ncontinuación.\n\na)El monto a pagar será de mil ochenta y cinco colones con 00/100 (¢1.085) por árbol,integrados a\nSistemas Agroforestales y desembolsados durante un período de cincoaños. Los pagos serán\ndistribuidos de la siguiente forma: 50% el primer año, 25% eltercero año y 25% el año quinto.\n\nb)El monto a pagar será de mil seiscientos ocho colones con\n00/100 (¢1.608) por árbol,integrados\na Sistemas Agroforestales, estrictamente con especies nativas contenidas\nen losDecretos Ejecutivos N° 25663-MINAE del 8 de\noctubre de 1996 y N° 25700-MINAE del15 de noviembre\nde 1996, desembolsados durante un período de cinco años. Los pagos\n\n \n\nserán distribuidos de la siguiente forma: 50% el primer\naño, 25% el tercero año y 25% el año quinto.\n\n \n\nc)El monto a pagar será de mil seiscientos ocho colones con 00/100 (¢1.608) por árbol, bajo la\nactividad de Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento Forestal\n(PPAF), financiados mediante el crédito forestal. Los pagos serán distribuidos dela siguiente forma:\n80% se girará una vez firmado el contrato y que los árboles hay analcanzado los 36 meses de edad; el\nrestante 20% se tramitará cuando los árboles tengan 60meses de edad, al quinto año del proyecto.\n\nd)Sistemas Mixtos en Agroforestería para pequeños productores: Las condiciones para esta modalidad\nson: Cuando realicen actividades de protección de bosque, un pago de treinta y seis mil ochocientos\nveintitrés colones con 00/100 (¢36.823) por hectárea por año, durante un período de cinco años,\n(aquí de ser necesario se calcularán las fracciones de hectáreas existentes, hasta el primer\ndecimal. Cuando sean áreas denudadas o en proceso de regeneración, se reconocerá un pago de\nveintitrés mil quinientos ochenta y nueve colones con 00/100 (¢23.589) por hectárea, por año durante\nun período de cinco años. Cuando realicen actividades de reforestación de especies maderables o de\nuso múltiple fuera del área boscosa un pago de trescientos veinte tres colones con 00/100 por árbol\n(¢323)por año durante un período de cinco años; se reconocerá una cantidad mínima de doscientos\nárboles plantados o árboles existentes identificados, hasta un máximo dedos mil doscientos árboles.\nEn esta sub actividad podrá realizarse un solo contrato que comprenda las diferentes actividades y\nel plazo será de cinco años contados a partir dela firma del contrato.\n\n2.4. Actividad de Protección de Bosque: Las\ncondiciones que regirán para el trámite de solicitudes, para el reconocimiento\nde los servicios ambientales en la actividad de Protección de Bosque, se\ndetallan a continuación:  \n\na)El\nmonto a pagar en Protección de Bosque será de trescientos sesenta y ocho mil doscientos\nveintinueve con 00/100 (¢368.229) desembolsados en un período de diez años.\nCuando se trate de solicitudes que se ubiquen dentro de las zonas de\nimportancia hídrica, identificadas por el Instituto Costarricense de Acueductos\ny Alcantarillados, la Dirección de Aguas y el Fonafifo,\nse reconocerá un monto adicional de noventa ydos mil\nsesenta y dos colones (¢92.062) colones por hectárea, desembolsados en diez pagos\nanuales de 10% durante un período de diez años. Este monto adicional se aplicará\nhasta agotar el presupuesto asignado en esta actividad.\n\n2.5 Actividad de Manejo de Bosque:  \n\na)El\nmonto a pagar en proyectos de Manejo de bosque será de ciento cuarenta y tres\nmil ochocientos cuarenta y un colones con 00/100 (¢143.841) por hectárea,\ndesembolsados en cinco pagos anuales de 20% durante un período de cinco años.\n\nb)El\nmonto a pagar en el proyecto piloto de Manejo de bosque será de cuatrocientos noventa\ny ocho mil colones con 00/100 (¢498.000) por hectárea, desembolsados en 10pagos\nanuales según la siguiente distribución: año 1 un 20%, año 2 un 20%, del año 3 al\n9 un 7% y un 11% en el año 10, durante un período de diez años.\n\n            2.6\nContratos de Reducción de Emisiones Forestales (CREF). Las condiciones que\nregirán para el trámite de solicitudes, para el reconocimiento de Reducción de\nemisiones forestales, se detallan a continuación:\n\na)El\nmonto en los proyectos CREF a pagar será de dieciocho dólares 00/100 ($18) por hectárea\npor año. Bajo este esquema el pago es retroactivo una vez que se haya verificado\nque efectivamente la reducción de emisiones se dio.\n\nb)El\nmáximo de hectáreas a contratar será de 450.000 has para bosques privados, este\nmonto podrá aumentar si existe disponibilidad de recursos de financiamiento\nexterno para este ese fin.\n\nc)El\nplazo de los contratos podrá ser retroactivo al año 2018, y su vigencia será\nhasta diciembre del 2024, pues así fue acordado con el Banco Internacional de Reconstrucción\ny Fomento (BIRF) financiador parcial de los proyectos. Con fundamento en lo\nindicado en el considerando quinto de la presente resolución.\n\nSe\nautoriza al Fondo Nacional de Financiamiento Forestal y al Fideicomiso 544\nBNCR-FONAIFFO, para que utilice los recursos del presupuesto nacional asignados\na este órgano, concretamente a la Modalidad de Recuperación de la Cobertura\nForestal no comprometidos para el año 2023, para complementar un pago por el\nservicio ambiental de protección de la biodiversidad a los CREF ya firmados y a\nlos que lleguen a firmarse. El manual de procedimientos de este instrumento\ndeterminará entre otros, el monto, los requisitos y el procedimiento para el\npago respectivo.\n\n3.Actualización de los montos a pagar. Los\nmontos establecidos por actividad dentro del Programa de Pago por Servicios\nAmbientales, se actualizarán anualmente con el Índice de Precios al Consumidor\n(IPC), calculado por el Instituto Nacional de Estadística y Censo(INEC), al\ncierre del período del año anterior. Para el caso de los CREF, como el pago se estima\nen dólares el monto a pagar está sujeto al tipo de cambio establecido por el\nBCCR a la fecha de pago correspondiente.\n\nArtículo 2°-Se instruye al Fondo Nacional de\nFinanciamiento Forestal para que incorpore en los contratos de Pago por\nServicios Ambientales las siguientes condiciones:\n\n1.De los plazos de vigencia de los contratos: Los plazos de\nvigencia de los contratos de Pago por Servicios Ambientales, generados por las\nactividades que corresponden a las modalidades de recuperación y/o\nmantenimiento de cobertura forestal serán los siguientes:\n\na)Los\ncontratos correspondientes a la actividad de Reforestación mediante el\nestablecimiento de las especies de rápido crecimiento, tendrán una vigencia de\ndiez años a partir de su firma. \n\nb)Los\ncontratos correspondientes a la actividad de Reforestación que incorporen\nespecies de mediano crecimiento y las especies nativas contenidas en los\nDecretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996,su vigencia será de dieciséis años, a partir de su firma;\nincluyendo los contratos dereforestación con recursos\npropios y los contratos de reforestación que superen el tope establecido.\n\nc)Los\ncontratos correspondientes a la sub actividad de Plantaciones Forestales con\nTurnos de Rotación Reducidos (PFTRR), tendrán una vigencia de seis años.\n\nd)Los\ncontratos correspondientes a la actividad de establecimiento de árboles en\nSistemas Agroforestales con especies de rápido, mediano y con las especies\nnativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N°\n25700-MINAE del 15 de noviembre de 1996, tendrán una vigencia de cinco años a\npartir de su firma.\n\ne)Los\ncontratos correspondientes a la sub actividad de Sistemas Agroforestales\nestablecidos en Plantaciones de Aprovechamiento Forestal (PPAF) tendrán una\nvigencia de 2 años a partir de su firma; dado que ya están plantados y por esto\nse les reconocerán retroactivamente tres años por su establecimiento previo.\n\nf)Los contratos correspondientes a la sub actividad de Sistemas Mixtos en Agroforestería para micro\nproductores tendrán una vigencia de cinco años a partir de su firma\n\ng)Los\ncontratos correspondientes a la actividad de establecimiento de árboles en\nSistemas Agroforestales relacionados a convenios u otros donantes o socios\ntendrán una vigencia de cinco años a partir de su firma.\n\nh)Los\ncontratos correspondientes a la actividad de Regeneración Natural tendrán una\nvigencia de cinco años a partir de su firma.\n\ni)Los\ncontratos correspondientes a la actividad de Manejo de bosque, tendrán una\nvigencia de 5 años a partir de su firma. De previo a la firma del contrato,\ndeberá constaren el expediente de PSA la certificación emitida por el SINAC del\ncierre técnico del plan de manejo, según los Estándares de Sostenibilidad para\nManejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de\nPrácticas y Manual de Procedimientos, Decreto Ejecutivo N° 27388-MINAE\npublicado el 2 de noviembre de1998, y el Decreto Ejecutivo N° 34559-MINAE\npublicado en La Gaceta N° 115, del día 16 de junio de 2008.\n\nj)Los\ncontratos correspondientes a la actividad de Protección de Bosque y Recurso\nHídrico tendrán una vigencia de diez años a partir de su firma.\n\n            2.Consideraciones Especiales. Condiciones\nestablecidas para los montos y actividades delas solicitudes PSA:2.1. Se\nfaculta al Fondo Nacional de Financiamiento Forestal a establecer actividades y\nmontos diferenciados a los señalados en esta resolución, de conformidad con\nacuerdos, convenios o contratos o proyectos específicos con entidades, que\naporten recursos financieros al Programa de Pago por Servicios Ambientales, que\nreconozcan montos y condiciones diferentes a los establecidos para los\ndiferentes servicios ambientales; para estos proyectos no aplicarán los\ncriterios de priorización que se detallaron anteriormente, sino los pactados en\ncada convenio, así como las normas especiales que correspondan de acuerdo a la\nnaturaleza de la actividad. Los pagos se realizarán siempre y cuando se tenga\ndisponibilidad presupuestaria para cubrir los compromisos adquiridos mediante\nel Programa de Pago por Servicios Ambientales.\n\n2.2. Los montos pendientes por\npagar para los contratos de años anteriores, se regirán según lo establecido en\nlos Decretos Ejecutivos y Resoluciones Administrativas correspondientes para\ncada año. Los montos no tramitados antes del año 2022 en forma oportuna;\ndependerán del mecanismo de reclamo y de que la institución disponga de los\nrecursos financieros requeridos para atender esos montos.\n\n2.3. Para cubrir el costo de\ninscripción del contrato ante el Registro Público, el Fondo Nacional de\nFinanciamiento Forestal retendrá en el primer desembolso del monto total del\ncontrato un 0,6%. Para el caso de los contratos CREF al ser un proyecto basado\nen resultados y retroactivo, no se les aplicará la deducción por cuanto no se\ninscriben en el Registro Público.\n\n2.4. Los recursos recuperados\nen virtud de los incumplimientos de contratos de pago por servicios ambientales\no las devoluciones o finiquitos, serán transferidos al Fideicomiso 544\nFONAFIFO/BNCR y serán presupuestados para la ejecución de nuevas actividades de\nfomento de pequeños y medianos productores.\n\n2.5. El proyecto deberá contar\ncon un regente durante toda la vigencia del contrato de pago por servicios\nambientales. El formulario de regencia podrá inscribirse ante el Colegio de\nIngenieros Agrónomos, por la totalidad del plazo del contrato de pago por\nservicios ambientales, o por períodos anuales o quinquenales según disponga la\npersona propietaria del inmueble. Cualquiera que sea la forma de pago, siempre\ndeberá aportarse el formulario de regencia debidamente inscrito y vigente durante\nel trámite de pago respectivo; salvo en aquellos casos que, se haya determinado\nque el proyecto será supervisado directamente por el Fondo Nacional de\nFinanciamiento Forestal; a través de su personal profesional o personal de\napoyo contratado.\n\n2.6. Sin perjuicio de otras\ndisposiciones, la persona o las personas beneficiarias deberán aportar un\ninforme de regencia anual emitido por un regente forestal para el trámite de\npago; o eventualmente un informe técnico emitido por un profesional forestal,\npara aquellos proyectos que no aplica la figura del regente forestal.\nAdicionalmente, para los contratos de Reforestación de Rápido Crecimiento,\ndeberá presentar los informes de visita, donde certifique el estado de los\nproyectos en los años 8 y 10 a partir de su fecha de plantación; para los\nproyectos de mediano crecimiento y otras especies deberán presentar dichos\ninformes al año 8, 12 y 16, a partir de su fecha de plantación.\n\n2.7. Sin perjuicio de otras acciones que representen\nincumplimiento a las obligaciones del contrato, para los contratos de\nReforestación de Rápido Crecimiento o Bloques a partir de los 12 meses y para\nlas plantaciones de Mediano Crecimiento o Bloques a partir de los 24 meses de\nestablecida la plantación, se considera incumplido el contrato si la plantación\nno presenta el crecimiento mínimo establecido en el artículo 1 inciso 2.1, o el\nindicado de previo en el estudio técnico respectivo para otras especies. Como\nconsecuencia de este incumplimiento, la persona productora no recibirá el pago\ncorrespondiente a este año, siendo que el Fondo Nacional de Financiamiento\nForestal debe suspender los pagos respectivos y dar por terminado el contrato\ncon responsabilidad para la persona beneficiaria previo cumplimiento del debido\nproceso. En casos muy calificados, basados en estudios y/o informes de las\npersonas encargadas de Oficinas Regionales de Fonafifo,\nse podría proceder con el pago respectivo y continuar con el contrato aun con\níndices de crecimiento menor, siempre y cuando estos no obedezcan a\nincumplimientos, por la mala selección del sitio, de la especie, o sea producto\nde un inadecuado manejo de la plantación.\n\n2.8. Como principio general,\nserán motivo de eximente de responsabilidad por incumplimiento del contrato, el\ncaso fortuito, la fuerza mayor, el hecho de un tercero como eximentes generales\ndebidamente comprobadas y valoradas a juicio del Fonafifo.\nDe igual forma, se procederá cuando la persona propietaria de la plantación\ndemuestre que una plaga o enfermedad afectó la plantación y que las acciones\noportunamente realizadas no lograron erradicarla, siempre y cuando estén\ndocumentadas en el expediente de PSA y tengan el aval de la Oficina Regional.\nSe procederá de igual manera cuando el daño sea producto de un incendio que no\npudo ser controlado a pesar de las medidas preventivas reportadas.\n\n2.9. No podrán ejecutarse\nproyectos en fincas que hayan sido objetos de plagas, enfermedades, o\nincendios; en tal supuesto la finca no podrá ser sujeto de contratos en\nReforestación y/o Sistemas Agroforestales en Bloque, en un plazo de 3 años, a\npartir del último contrato finalizado por esta causa.\n\n2.10. En relación a las plagas y enfermedades que afecten las plantaciones forestales, la Junta\nDirectiva de Fonafifo, determinará lineamientos para abordar y resolver estos supuestos.\n\n2.11. El Fonafifo,\nserá el responsable de monitorear las plantaciones forestales que ingresen al\nPrograma, debiendo no solo hacer un seguimiento a nivel regional, sino un\nprotocolo de control, mediante un mecanismo aleatorio de visitas según su\ncapacidad técnica y administrativa, de acuerdo a la disponibilidad de recursos\npresupuestados. De igual forma, deberá custodiar la información de las parcelas\npermanentes de mediciones de las plantaciones, a fin de sustentar los pagos y respaldar\nlas fijaciones de carbono y otros gases de efecto invernadero.\n\n2.12. Para uniformizar la\ninformación requerida de las parcelas permanentes de plantaciones y bloques, el\nFonafifo emitirá el formato del contenido de la base\nde datos en Excel, para que los regentes lo remitan anualmente con los datos\nindividuales de diámetros y alturas. El archivo se encuentra disponible en el\nsitio web de Fonafifo (www.fonafifo.go.cr)\npara su descarga.\n\n2.13. En el caso de solicitudes\nde ingreso en la actividad de protección que son valoradas según la Matriz de\nValoración y que presentan varias fincas; la calificación dependerá de la finca\nde mayor tamaño que se incluya en la solicitud.\n\n2.14. En caso de que en las solicitudes\npresentadas se determinara la existencia de traslapes o desplazamiento entre\nellas y/o con otras fincas, el Fonafifo valorará de\nacuerdo a criterios técnicos y legales la aprobación o no de las solicitudes de\ningreso.\n\n2.15. En el caso de las solicitudes de ingreso de Reforestación\nque involucren mezclas de especies de rápido, mediano y/o en vías de extinción,\nse deberá generar contratos separados, en virtud de las diferencias de\ncrecimiento que se presentan entre estos grupos de especies. Además, los\nproyectos que estén conformados por especies nativas contenidas en los Decretos\nN° 25663- MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15\nde noviembre de 1996, deberá contener el 100% de los árboles de las especies\ncontenidas en los mencionados decretos; de lo contrario tendrá un valor en\nfunción del monto menor establecido para Reforestación.\n\n2.16. En el caso de las\nsolicitudes de ingreso que se presenten para acceder al Programa de Pago por\nServicios Ambientales, deben de contener la información de contacto (correo\nelectrónico, número de teléfono, dirección) de la personas propietaria o\npropietarias del inmueble. Sin esta información la administración estimará como\nincompleta la solicitud y procederá a señalarla, para que la persona solicitante\nproceda a completarla, de no suministrar la información se procederá con su\narchivo. Dicha información es fundamental para el proceso de notificación del\nPrograma de PSA.\n\n2.17. Las plantaciones\nforestales y árboles individuales de especies en peligro de extinción sembrados\ncon el financiamiento de contratos de servicios ambientales podrán ser\naprovechados con fundamento en el artículo 28 de la Ley Forestal.\n\n2.18. Los proyectos de\nReforestación y SAF Bloques de los años 2016, 2017, 2018, 2019, 2020 y 2022\nserán valorados de acuerdo a los parámetros de crecimiento establecidos en la\nresolución ministerial R-167-2019-MINAE, publicados en La Gaceta N° 138 del 23\nde julio del 2019.\n\n2.19. El Fonafifo realizará el\ntrámite de pago de los contratos con morosidad según lo establecido en la Ley\nN°9686 y sus modificaciones; en donde, la CCSS estableció el procedimiento que\nlas instituciones del Estado deben de seguir ante personas beneficiarias que\nestán morosas con la CCSS.  \n\n3.Consideraciones Especiales de los proyectos CREF. \n\nLos\nProyectos de los contratos CREF serán tramitados y regulados según el Manual\nque será emitido a esos efectos.\n\nArtículo 3°- Fonafifo dispondrá de un área de 154 hectáreas para la implementación de un\nproyecto Piloto en fincas con planes de manejo autorizados por el SINAC donde\nse ejecuten tratamientos silviculturales en las áreas\nde bosques. Las fincas deberán estar ubicadas en la Zona Norte del país y\ngestionados a través de FUNDECOR y/o CODEFORSA organizaciones de base con\nexperiencia en el manejo de bosque.\n\nEl\nproyecto operaría bajo las siguientes condiciones especiales, sin perjuicios de\nlas aplicaciones de las disposiciones generales que rigen el Programa de Pago\npor Servicios Ambientales:\n\na)Las solicitudes deben de cumplir con los requisitos y requerimientos dispuesto por Fonafifo para\nacceder al PSA en la actividad de manejo de bosque.\n\nb)El\npiloto consideraría para el primer año un proyecto por organización.\n\nc)En\nel área de bosque sometida a manejo se reconocerá la aplicación de los\nsiguientes tratamientos  silviculturales:aprovechamiento maderable, -corta de lianas;\n-liberación de líderes deseables; -eliminación de árboles y\ntroncos defectuosos; -refinamiento. Pudiendo ser todos o al menos 3 de los\nindicados.\n\nd)Todas\nlas solicitudes que apliquen del proyecto piloto deberán presentar los\ndocumentos de autorización emitidos por el SINAC para la aplicación de los\ntratamientos silviculturales.\n\ne)FUNDECOR\ny CODEFORSA deberán proponer un plan de seguimiento para el monitoreo de los\nresultados de la aplicación de los tratamientos silviculturales\na la masa forestal, a satisfacción de Fonafifo y el\nSINAC.\n\nf)En\ncaso de no recibir aplicaciones de posibles interesados, o si estas no\ncompletan los recursos destinados para el Proyecto Piloto, serán distribuidos\nentre la actividad de Manejo de Bosque tradicional.\n\ng)Si\ndurante el primer año de ejecución del Proyecto Piloto no se reciben\naplicaciones o no se logre formalizar un contrato de PSA, el mismo quedará sin\nefecto y se procederá a su cancelación.\n\nArtículo 4°-Rige a partir de su publicación.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Rule 187\n\n                        Establishes the spending limit for the National Forest Financing Fund,\nfor the contracts to be formalized in the year 2023, the activities to be financed, and the payment amounts per\nactivity\n\nMINISTRY\nOF ENVIRONMENT AND ENERGY\n\nR-187-2023-MINAE MINISTRY OF\nENVIRONMENT AND ENERGY\n\nSan José, at 07 hours 39 minutes on June 23,\n2023.\n\nThe amount of hectares to be financed per activity in the Payment for Environmental Services Program and the amount to be paid based on the allocated resources are established for the National Forest Financing Fund.\n\nWHEREAS\nSOLE.\n\nThat for the 2023 fiscal year, the National Budget allocates a total of TEN BILLION NINE HUNDRED THIRTY-FOUR MILLION SEVEN HUNDRED TWENTY-NINE THOUSAND NINE HUNDRED NINETY COLONES WITH 00/100 (¢ 10,934,729,990.00) for the Payment for Environmental Services Program, which will be used for the payment of commitments from PSA contracts from previous years and the incorporation of new hectares for the year 2023.\n\nCONSIDERING\n\nFIRST: That article 38 of the Regulation to the Forest Law No. 7575, Executive Decree No. 25721-MINAE, of October 17, 1996, and its amendments, provides that the Minister of Environment and Energy, as Head of the Ministry of Environment and Energy, acting as the State Forest Administration, shall annually issue, by Ministerial Resolution, the activities to be financed in the Payment for Environmental Services Program and the amounts to be paid based on the resources allocated in the National Budget for the 2023 fiscal year.\n\nSECOND: That under this principle, financial instruments must be oriented to support the pillars of the National Development and Public Investment Plan 2023-2026 (Rogelio Fernández Güell), considering the objectives of the creation of the National Forest Financing Fund according to the cited Forest Law, without neglecting the established technical criteria.\n\nTHIRD: That the cited National Development Plan considers as one of the national goals the maintenance, under the Payment for Environmental Services Program, of at least two hundred fifty thousand hectares (250,000 ha), in its different activities.\n\nFOURTH: That the Ministry of Environment and Energy has issued the Guiding Principles of the Productive Forest Sector, through Executive Decree No. 41772-MINAE, as well as the guidelines to be considered in institutional efforts for the reactivation and promotion of reforestation in the country.\n\nFIFTH: That by virtue of the efforts to achieve international recognition of the contribution of forests to the reduction of greenhouse gas emissions, the Government of Costa Rica signed an ERPA (Emission Reductions Purchase Agreement) with the International Bank for Reconstruction and Development, on December 9, 2020, which, in its benefit distribution plan, provided for the creation of a payment for environmental services (pago por servicios ambientales) mechanism specialized in emission reductions, which has differentiated conditions; this instrument is the CREF (Forest Emission Reductions Contract).\n\nThe cited instrument is integrated into the agreement signed by the Ministry of Environment and Energy, on February 10, 2021, with the Green Climate Fund of the United Nations, through the implementing agency UNDP United Nations Development Programme, whose resources will complement the negotiation with the IBRD, previously indicated.\n\nSIXTH: That, by virtue of the publication of Executive Decree No. 43665-MP-MEIC of August 31, 2022, and Executive Decree No. 43649-MINAE of August 31, 2022, a review was carried out of the presentation of the initial requirements and necessary documents for farms in possession, which facilitates, simplifies, and enables the participation of forest possessors in accessing the different financing schemes.\n\nTHEREFORE\n\nTHE MINISTER OF ENVIRONMENT\nAND ENERGY\n\nRESOLVES\n\nArticle 1°-To establish the spending limit for the National Forest Financing Fund, for the contracts to be formalized in the year 2023, the activities to be financed, and the payment amounts per activity.\n\n1. Activities to be financed: For the year 2023, two modalities to be financed will be considered; a-Recovery of Forest Cover (Recuperación de la Cobertura Forestal), which includes the activities of Reforestation, Regeneration, and Agroforestry Systems, and b-Maintenance of Forest Cover (Mantenimiento de la Cobertura Forestal), which includes Forest Protection and Forest Management. For the execution of the forest management pilot project, an additional 154 hectares are available for contracting. Starting in the year 2022, a derived mechanism, financed with resources from contracts and agreements for Emission Reductions produced by forests, is enabled; with an amount of 450,000 hectares. This activity primarily recognizes the environmental service of reducing greenhouse gas emissions, but it can be complemented with the recognition of other environmental services when resources are available for that purpose, hereinafter, CREF contracts. The National Forest Financing Fund may vary the distribution established in the previous table, in accordance with the availability of the approved budget for the Payment for Environmental Services Program. Fonafifo is authorized to redistribute the budgeted resources of the Recovery of Forest Cover modality not committed by June 26 of each year, to be allocated to the CREF activity. If there is a greater allocation of resources available, according to article 5 of the Law on Tax Simplification and Efficiency No. 8114 published in La Gaceta No. 131, of July 9, 2001, and other financial resources that Fonafifo obtains for Payment for Environmental Services, they will be distributed according to the criteria of the financiers and the authorities of the Ministry (or corresponding authorities). In any case, the resources used for these purposes must be incorporated into the institutional budget or into Trust 544 Fonafifo/BNCR.\n\n2. Of the payment amounts per activity and other conditions: 2.1. Reforestation Activity: The conditions that will govern the processing of applications for the recognition of environmental services in the Reforestation activity are as follows:\n\na) The amount to be paid for fast-growing species referred to as: Gmelina arborea, Acacia mangium, Vochysia guatemalensis, and Vochysia hondurensis, will be seven hundred eighty-three thousand six hundred forty-four colones with 00/100 (¢783,644) per hectare, disbursed over a period of five years. Payments will be distributed as follows: 50% in the first year, 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year.\n\nb) The amount to be paid for medium-growing species referred to as: Tectona grandis, Pinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp, and Cedrela odorata, will be eight hundred eighty-three thousand five hundred seventy-six colones with 00/100 (¢883,576) per hectare, disbursed over a period of five years. Payments will be distributed as follows: 50% in the first year, 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year.\n\nc) The amount to be paid for native species contained in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, will be one million three hundred twenty-five thousand three hundred sixty-six colones with 00/100 (¢1,325,366) per hectare, disbursed over a period of five years. Payments will be distributed as follows: 50% in the first year, 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year.\n\nd) The amount to be paid for Forest Plantations with Reduced Rotation Cycles (PFTRR) for fast-growing species for packaging will be four hundred twenty-one thousand six hundred twenty-eight colones with 00/100 (¢421,628) per hectare. Payments will be distributed as follows: 50% the first year, 25% the second year, and 25% the fourth year.\n\ne) The conditions that will govern the processing of applications for the recognition of environmental services in the Reforestation PSA + Credit pilot project activity are as follows:\n\ni. The amount to be paid for the PSA + Credit pilot project with the fast-growing species referred to as: Gmelina arborea, will be four hundred twenty-one thousand six hundred twenty-eight colones with 00/100 (¢421,628) per hectare, disbursed in 6 installments according to the following distribution: first year 11%, second year 16%, third year 17%, fourth year 18%, fifth year 19%, and the sixth year the remaining 19% which will be paid provided the beneficiary has consented through a formal document.\n\nf) Forest Plantations established with own resources for payment by results. The amounts to be paid will be those established in subsections a, b, and c above. The amounts will be distributed as follows: 50% upon signing the contract, and at twelve, twenty-four, thirty-six, and forty-eight months after said signing, 20%, 15%, 10%, and 5% respectively. The contracts will have the term provided for in article 2, subsections a and b of this resolution, but the years of existence of these plantations will be recognized; up to a maximum of 3 years from establishment.\n\ng) Individuals or legal entities wishing to reforest areas larger than the limit established in the Regulation to the Forest Law, Decree No. 25721-MINAE and its Amendments, may apply under a special financing scheme, and may double the 750-hectare limit, provided that the available resources are not used by small producers. The amounts to be paid will be those established in subsections a, b, and c above.\n\nh) The National Forest Financing Fund is instructed to incorporate, into Payment for Environmental Services contracts for the activity of Reforestation and Agroforestry Systems en Bloque, the minimum acceptable values for making payments.\n\nThe National Forest Financing Fund will use the following reference values to process the payments corresponding to each year:\n\nTable 1. Said payments correspond to the total number of years of the agreed term; however, in order to allow the establishment of the plantation and its maintenance, payment will be advanced during the first five years.\n\nc) Fonafifo may modify, when so requested, those contracts signed before the year 2013 that demonstrate having reached a minimum production of 13 cubic meters of mean annual increment per hectare. For such purposes, Fonafifo may request the information it deems pertinent.\n\n2.2. Natural Regeneration Activity:\nThe conditions that will govern the processing of applications for the recognition of environmental services in the Natural Regeneration activity, carried out on denuded areas, without forest cover (cobertura boscosa), with nearby seed sources, in areas in the process of regeneration that do not meet the definition of forest and are free from grazing; are detailed below.\n\na) The amount to be paid for Natural Regeneration will be one hundred seventeen thousand nine hundred forty-eight colones with 00/100 (¢117,948) per hectare, disbursed in five annual payments of 20% over a period of five years.\n\n2.3. Agroforestry Systems Activity: The conditions that will govern the processing of applications for the recognition of environmental services in the Agroforestry Systems activity are detailed below.\n\na) The amount to be paid will be one thousand eighty-five colones with 00/100 (¢1,085) per tree, integrated into Agroforestry Systems and disbursed over a period of five years. Payments will be distributed as follows: 50% in the first year, 25% in the third year, and 25% in the fifth year.\n\nb) The amount to be paid will be one thousand six hundred eight colones with 00/100 (¢1,608) per tree, integrated into Agroforestry Systems, strictly with native species contained in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, disbursed over a period of five years. The payments\n\nwill be distributed as follows: 50% in the first year, 25% in the third year, and 25% in the fifth year.\n\nc) The amount to be paid will be one thousand six hundred eight colones with 00/100 (¢1,608) per tree, under the activity of Agroforestry Systems established in Forest Harvest Plantations (PPAF), financed through forest credit. Payments will be distributed as follows: 80% will be paid once the contract is signed and the trees have reached 36 months of age; the remaining 20% will be processed when the trees are 60 months of age, in the fifth year of the project.\n\nd) Mixed Systems in Agroforestry for small producers: The conditions for this modality are: When carrying out forest protection activities, a payment of thirty-six thousand eight hundred twenty-three colones with 00/100 (¢36,823) per hectare per year, over a period of five years (here, if necessary, the existing fractions of hectares will be calculated, up to the first decimal). When dealing with denuded areas or areas in the process of regeneration, a payment of twenty-three thousand five hundred eighty-nine colones with 00/100 (¢23,589) per hectare per year will be recognized, over a period of five years. When carrying out reforestation activities with timber or multi-use species outside the forested area, a payment of three hundred twenty-three colones with 00/100 per tree (¢323) per year will be recognized, over a period of five years; a minimum quantity of two hundred planted trees or identified existing trees will be recognized, up to a maximum of two thousand two hundred trees. In this sub-activity, a single contract may be made covering the different activities, and the term shall be five years counted from the signing of the contract.\n\n2.4. Forest Protection Activity: The conditions that will govern the processing of applications for the recognition of environmental services in the Forest Protection activity are detailed below:\n\na) The amount to be paid for Forest Protection will be three hundred sixty-eight thousand two hundred twenty-nine with 00/100 (¢368,229) disbursed over a period of ten years. In the case of applications located within water importance zones, identified by the Instituto Costarricense de Acueductos y Alcantarillados, the Dirección de Aguas, and Fonafifo, an additional amount of ninety-two thousand sixty-two colones (¢92,062) per hectare will be recognized, disbursed in ten annual payments of 10% over a period of ten years. This additional amount will be applied until the budget allocated for this activity is exhausted.\n\n2.5 Forest Management Activity:\n\na) The amount to be paid in Forest Management projects will be one hundred forty-three thousand eight hundred forty-one colones with 00/100 (¢143,841) per hectare, disbursed in five annual payments of 20% over a period of five years.\n\nb) The amount to be paid in the Forest Management pilot project will be four hundred ninety-eight thousand colones with 00/100 (¢498,000) per hectare, disbursed in 10 annual payments according to the following distribution: year 1 20%, year 2 20%, from year 3 to 9 7%, and 11% in year 10, over a period of ten years.\n\n2.6 Forest Emission Reductions Contracts (CREF). The conditions that will govern the processing of applications for the recognition of forest emission reductions are detailed below:\n\na) The amount to be paid in CREF projects will be eighteen dollars 00/100 ($18) per hectare per year. Under this scheme, the payment is retroactive once it has been verified that the emission reduction actually occurred.\n\nb) The maximum number of hectares to be contracted will be 450,000 ha for private forests; this amount may increase if there is availability of external financing resources for this purpose.\n\nc) The term of the contracts may be retroactive to the year 2018, and their validity will be until December 2024, as was agreed with the International Bank for Reconstruction and Development (IBRD), partial financier of the projects. Based on what is indicated in the fifth considering of this resolution.\n\nThe National Forest Financing Fund and Trust 544 BNCR-FONAIFFO are authorized to use resources from the national budget allocated to this body, specifically from the Recovery of Forest Cover Modality that are not committed for the year 2023, to complement a payment for the environmental service of biodiversity protection to CREFs already signed and those that may be signed. The procedures manual for this instrument will determine, among other things, the amount, requirements, and procedure for the respective payment.\n\n3. Updating of amounts to be paid. The amounts established per activity within the Payment for Environmental Services Program will be updated annually using the Consumer Price Index (IPC), calculated by the Instituto Nacional de Estadística y Censo (INEC), at the close of the previous year's period. In the case of CREFs, since the payment is estimated in dollars, the amount to be paid is subject to the exchange rate established by the BCCR on the corresponding payment date.\n\nArticle 2°-The National Forest Financing Fund is instructed to incorporate the following conditions into the Payment for Environmental Services contracts:\n\n1. Of the validity terms of the contracts: The validity terms of the Payment for Environmental Services contracts generated by the activities corresponding to the modalities of recovery and/or maintenance of forest cover (cobertura boscosa) will be as follows:\n\na) Contracts corresponding to the Reforestation activity through the establishment of fast-growing species will have a validity of ten years from their signing.\n\nb) Contracts corresponding to the Reforestation activity that incorporate medium-growing species and native species contained in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, will have a validity of sixteen years from their signing; including reforestation contracts with own resources and reforestation contracts that exceed the established limit.\n\nc) Contracts corresponding to the sub-activity of Forest Plantations with Reduced Rotation Cycles (PFTRR) will have a validity of six years.\n\nd) Contracts corresponding to the activity of establishing trees in Agroforestry Systems with fast-growing, medium-growing species, and with native species contained in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, will have a validity of five years from their signing.\n\ne) Contracts corresponding to the sub-activity of Agroforestry Systems established in Forest Harvest Plantations (PPAF) will have a validity of 2 years from their signing; given that they are already planted, and for this reason, three years will be recognized retroactively for their prior establishment.\n\nf) Contracts corresponding to the sub-activity of Mixed Systems in Agroforestry for micro-producers will have a validity of five years from their signing.\n\ng) Contracts corresponding to the activity of establishing trees in Agroforestry Systems related to agreements or other donors or partners will have a validity of five years from their signing.\n\nh) Contracts corresponding to the Natural Regeneration activity will have a validity of five years from their signing.\n\ni) Contracts corresponding to the Forest Management activity will have a validity of 5 years from their signing. Prior to the signing of the contract, the PSA file must contain the certification issued by SINAC of the technical closure of the management plan, according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decree No. 27388-MINAE published on November 2, 1998, and Executive Decree No. 34559-MINAE published in La Gaceta No. 115, of June 16, 2008.\n\nj) Contracts corresponding to the activity of Protection of Forest and Water Resources will have a validity of ten years from their signing.\n\n2. Special Considerations. Conditions established for the amounts and activities of PSA applications: 2.1. The National Forest Financing Fund is authorized to establish activities and amounts differentiated from those indicated in this resolution, in accordance with agreements, covenants, or specific contracts or projects with entities that contribute financial resources to the Payment for Environmental Services Program, which recognize amounts and conditions different from those established for the different environmental services; for these projects, the prioritization criteria detailed above will not apply, but rather those agreed upon in each covenant, as well as the special rules that correspond according to the nature of the activity. Payments will be made provided there is budget availability to cover the commitments acquired through the Payment for Environmental Services Program.\n\n2.2. The pending amounts to be paid for contracts from previous years will be governed as established in the corresponding Executive Decrees and Administrative Resolutions for each year. Amounts not processed in a timely manner before the year 2022 will depend on the claim mechanism and the institution having the financial resources required to address those amounts.\n\n2.3. To cover the cost of registering the contract with the Public Registry, the National Forest Financing Fund will withhold 0.6% from the first disbursement of the total contract amount. In the case of CREF contracts, as it is a results-based and retroactive project, the deduction will not be applied since they are not registered in the Public Registry.\n\n2.4. Resources recovered by virtue of non-compliance with payment for environmental services (pago por servicios ambientales) contracts, or from refunds or settlements, will be transferred to Trust 544 FONAFIFO/BNCR and will be budgeted for the execution of new activities promoting small and medium producers.\n\n2.5. The project must have a regent throughout the entire validity of the payment for environmental services (pago por servicios ambientales) contract. The regency form may be registered with the Colegio de Ingenieros Agrónomos for the entire term of the payment for environmental services contract, or for annual or five-year periods as determined by the property owner. Regardless of the form of payment, the duly registered and valid regency form must always be provided during the respective payment process; except in those cases where it has been determined that the project will be supervised directly by the National Forest Financing Fund, through its professional staff or contracted support staff.\n\n2.6. Without prejudice to other provisions, the beneficiary person(s) must provide an annual regency report issued by a forest regent for the payment process; or eventually a technical report issued by a forestry professional, for those projects where the figure of the forest regent does not apply. Additionally, for Fast-Growing Reforestation contracts, they must present visit reports certifying the status of the projects in years 8 and 10 from their planting date; for medium-growing and other species projects, they must present said reports at year 8, 12, and 16 from their planting date.\n\n2.7. Without prejudice to other actions that represent non-compliance with the contract obligations, for Fast-Growing or Bloc Reforestation contracts starting at 12 months, and for Medium-Growing or Bloc plantations starting at 24 months after the plantation is established, the contract is considered breached if the plantation does not present the minimum growth established in article 1, subsection 2.1, or that previously indicated in the respective technical study for other species. As a consequence of this non-compliance, the producer will not receive the payment corresponding to that year, and the National Forest Financing Fund must suspend the respective payments and terminate the contract with responsibility for the beneficiary person, after due process. In highly qualified cases, based on studies and/or reports from the persons in charge of Fonafifo's Regional Offices, proceeding with the respective payment and continuing with the contract may be possible even with lower growth rates, provided these do not result from non-compliance due to poor site selection, species selection, or are a product of inadequate plantation management.\n\n2.8. As a general principle, the following shall be grounds for exemption from liability for breach of contract: act of God (caso fortuito), force majeure (fuerza mayor), and the act of a third party (hecho de un tercero), as general exemptions, duly proven and assessed at the discretion of Fonafifo.\nLikewise, the same shall apply when the plantation owner (persona propietaria) demonstrates that a pest or disease affected the plantation and that the timely actions taken failed to eradicate it, provided these are documented in the PSA case file and endorsed by the Regional Office.\nThe same procedure shall apply when the damage results from a fire that could not be controlled despite the reported preventive measures.\n\n2.9. Projects may not be carried out on farms that have been subject to pests, diseases, or fires; in such cases, the farm may not be subject to contracts in Reforestation (Reforestación) and/or Agroforestry Systems in Blocks (Sistemas Agroforestales en Bloque) for a period of 3 years, starting from the last contract terminated for this reason.\n\n2.10. Regarding pests and diseases affecting forest plantations, the Board of Directors of Fonafifo shall determine guidelines to address and resolve these scenarios.\n\n2.11. Fonafifo shall be responsible for monitoring the forest plantations entering the Program, and must not only conduct regional follow-up but also implement a control protocol, through a random mechanism of visits according to its technical and administrative capacity, subject to the availability of budgeted resources. Likewise, it must safeguard the information from the permanent measurement plots (parcelas permanentes) of the plantations, in order to support the payments and underpin the carbon and other greenhouse gas fixation determinations.\n\n2.12. To standardize the required information from the permanent plots of plantations and blocks, Fonafifo shall issue the content format for the Excel database, so that the regents (regentes) submit it annually with the individual diameter and height data. The file is available on the Fonafifo website (www.fonafifo.go.cr) for download.\n\n2.13. In the case of applications for entry into the protection activity that are assessed according to the Assessment Matrix (Matriz de Valoración) and that present several farms, the classification shall depend on the largest farm included in the application.\n\n2.14. Should it be determined that overlaps or displacement exist among the submitted applications and/or with other farms, Fonafifo shall assess the approval or denial of the entry applications according to technical and legal criteria.\n\n2.15. In the case of Reforestation entry applications involving mixtures of fast-growing, medium-growing, and/or endangered species, separate contracts must be generated, due to the growth differences occurring among these groups of species. Furthermore, projects composed of native species listed in Decrees N° 25663-MINAE of October 8, 1996, and N° 25700-MINAE of November 15, 1996, must contain 100% of the trees of the species listed in said decrees; otherwise, the value shall be based on the lower amount established for Reforestation.\n\n2.16. In the case of entry applications submitted to access the Payment for Environmental Services Program (Programa de Pago por Servicios Ambientales), they must contain the contact information (email address, telephone number, address) of the property owner(s). Without this information, the administration shall deem the application incomplete and proceed to flag it so that the applicant may complete it; if the information is not provided, it shall be archived. This information is essential for the notification process of the PSA Program.\n\n2.17. Forest plantations and individual trees of endangered species planted with financing from environmental services contracts may be harvested (aprovechados) based on Article 28 of the Forestry Law (Ley Forestal).\n\n2.18. Reforestation and SAF Block projects from the years 2016, 2017, 2018, 2019, 2020, and 2022 shall be assessed according to the growth parameters established in Ministerial Resolution R-167-2019-MINAE, published in La Gaceta N° 138 of July 23, 2019.\n\n2.19. Fonafifo shall carry out the payment processing for contracts in arrears as established in Law N° 9686 and its amendments; wherein, the CCSS established the procedure that State institutions must follow for beneficiaries who are in arrears with the CCSS.\n\n3. Special Considerations for CREF Projects.\n\nCREF contract Projects shall be processed and regulated according to the Manual to be issued for these purposes.\n\nArticle 3 - Fonafifo shall allocate an area of 154 hectares for the implementation of a Pilot Project (Proyecto Piloto) on farms with management plans authorized by SINAC where silvicultural treatments (tratamientos silviculturales) are carried out in forest areas. The farms must be located in the Northern Zone of the country and managed through FUNDECOR and/or CODEFORSA, grassroots organizations with experience in forest management.\n\nThe project would operate under the following special conditions, without prejudice to the application of the general provisions governing the Payment for Environmental Services Program:\n\na) Applications must meet the requirements and conditions established by Fonafifo to access PSA in the forest management activity.\n\nb) The pilot would consider one project per organization for the first year.\n\nc) In the forest area under management, the application of the following silvicultural treatments shall be recognized: timber harvesting (aprovechamiento maderable), -liana cutting (corta de lianas); -liberation of desirable leaders (liberación de líderes deseables); -elimination of defective trees and trunks; -refinement (refinamiento). These may be all or at least 3 of those indicated.\n\nd) All applications submitted for the pilot project must present the authorization documents issued by SINAC for the application of the silvicultural treatments.\n\ne) FUNDECOR and CODEFORSA must propose a monitoring plan (plan de seguimiento) for tracking the results of the application of silvicultural treatments to the forest stand (masa forestal), to the satisfaction of Fonafifo and SINAC.\n\nf) Should no applications be received from potential interested parties, or if these do not exhaust the resources allocated for the Pilot Project, the resources shall be distributed among the traditional Forest Management activity.\n\ng) If during the first year of execution of the Pilot Project no applications are received or a PSA contract cannot be formalized, the Pilot Project shall become void and shall be cancelled.\n\nArticle 4 - It shall become effective upon its publication."
