Las\ndisposiciones de este reglamento son de aplicación y acatamiento obligatorio para\nlos propietarios o acompañantes de los perros que hagan uso de las\ninstalaciones de los parques caninos municipales ubicados en el cantón de\nMoravia.\n\nArtículo 3°-Definición. Para efectos del\npresente reglamento, se establecen los siguientes conceptos:\n\na) Acompañante: que acompaña en todo momento,\nsea que se encuentre en una situación de riesgo o no.\n\nb) Bozales: Aparato que se coloca alrededor del\nhocico de ciertos animales, especialmente los perros, para que no puedan\nmorder.\n\nc) Conflicto: pelea, disputa o discrepancia que\nse da entre dos o más individuos.\n\nd) Mascota potencialmente peligrosa: Animal que\npuede tener carácter agresivo o la capacidad de causar la muerte o lesiones a\nlas personas o a otros animales y daños a las cosas.\n\ne) Parques caninos municipales: Aquellos\nespacios propiedad de la Municipalidad de Moravia, destinados para el recreo\ncanino donde, bajo la supervisión y control de sus propietarios o acompañantes,\nlos perros pueden disfrutar, correr y jugar sin riesgos.\n\nf) Perro enfermo: es un adjetivo de tipo\ncalificativo que se utiliza para designar el estado de salud de un individuo\nque se ve alterado por la presencia de alguna enfermedad, patología o dolencia.\n\ng) Propietario: El propietario es aquella\npersona física que ejerce la acción de propiedad o dominio de un activo, ejerce\nposesión y control sobre un bien en particular.\n\nCAPÍTULO II\n\nSobre los parques\n\nArtículo 4.-Objetivo de los parques. Estos\nespacios han sido concebidos con el objetivo de ofrecer a las personas vecinas\ndel cantón de Moravia, así como a sus visitantes, de áreas públicas donde se\npromueva el ejercicio, el juego y una sana convivencia de los caninos con otros\nde su misma especie, teniendo como resultado perros más sanos, socializados y\nequilibrados. Asimismo, mejorar la convivencia entre las personas y los\ncaninos.\n\nArtículo 5°-Usuarios de los parques. Se\nconsiderarán usuarios a los propietarios o acompañantes de los perros que\nvisiten los parques caninos municipales. También podrá acceder a estas áreas,\ncualquier persona mayor de edad que quiera disfrutar viendo a los animales, las\nactividades y/o eventos que pudieran organizarse en dichos parques con el perro\ncomo principal protagonista, siempre y cuando no se ponga en riesgo a los animales\nque se encuentran en el interior. En este caso, las personas que deseen\ninteractuar con los perros deberán contar siempre con el permiso correspondiente\ndel propietario. Los menores de 12 años deberán ir siempre acompañados de su\npadre, madre, tutor o persona mayor de edad que se haga responsable en todo momento\ndel menor.\n\nArtículo 6°-Mantenimiento. La Municipalidad de Moravia\ndará el mantenimiento adecuado de los parques mediante la realización de las\nobras y labores de mantenimiento necesarias, que garanticen su mejor y más\nadecuado uso.\n\nArtículo 7°-Actividades. Toda actividad fuera\ndel uso ordinario del parque, debe ser de interés general y previamente autorizada\npor la Municipalidad.\n\nCAPÍTULO III\n\nDel uso\n\nArtículo 8°-Horarios y gratuidad. Los parques\ncaninos municipales estarán abiertos al público de forma permanente y serán de\nuso gratuito.\n\nArtículo 9°-Normas obligatorias de uso. Los\npropietarios o acompañantes de los perros estarán obligados a respetar las\nnormas de uso del parque, siendo responsables legales por cualquier tipo de\ndaños que se puedan ocasionar en la infraestructura pública, así como de\ncumplir la normativa vigente en materia de protección de animales domésticos, tenencia\nde animales potencialmente peligrosos y ordenanza municipal relativas al\nmedioambiente, quedando liberada la Municipalidad de este tipo de\nresponsabilidad.\n\nCAPÍTULO IV\n\nDisposiciones sobre maltrato animal\n\ny difusión de reglamento\n\nArtículo 12.-Denuncias por maltrato animal. These regulations have the\npurpose of regulating the conditions for the use of existing municipal dog parks,\nand those that may be created in the future in the canton of Moravia.\n\nArticle 2—Scope of application. The\nprovisions of these regulations are of mandatory application and observance for\nthe owners or companions of dogs who make use of the\nfacilities of the municipal dog parks located in the canton of\nMoravia.\n\nArticle 3—Definitions. For the purposes of\nthese regulations, the following concepts are established:\n\na) Companion: one who accompanies at all times,\nwhether in a risk situation or not.\n\nb) Muzzles: Device placed around the\nsnout of certain animals, especially dogs, so they cannot\nbite.\n\nc) Conflict: fight, dispute, or disagreement that\noccurs between two or more individuals.\n\nd) Potentially dangerous pet: Animal that\nmay have an aggressive nature or the capacity to cause death or injury to\npersons or other animals and damage to property.\n\ne) Municipal dog parks: Those\nspaces owned by the Municipalidad de Moravia, intended for canine\nrecreation where, under the supervision and control of their owners or companions,\ndogs can enjoy, run, and play without risks.\n\nf) Sick dog: is a qualifying\nadjective used to designate the health status of an individual\nthat is altered by the presence of an illness, pathology, or ailment.\n\ng) Owner: The owner is that\nnatural person who exercises the action of ownership or dominion over an asset, exercises\npossession and control over a particular good.\n\nCHAPTER II\n\nOn the parks\n\nArticle 4.—Objective of the parks. These\nspaces have been conceived with the objective of offering residents\nof the canton of Moravia, as well as its visitors, public areas where\nexercise, play, and healthy coexistence of canines with others\nof their same species are promoted, resulting in healthier, socialized, and\nbalanced dogs. Likewise, to improve coexistence between people and\ncanines.\n\nArticle 5—Users of the parks.\nOwners or companions of dogs who\nvisit the municipal dog parks shall be considered users. Any person of legal age who wants to enjoy watching the animals, the\nactivities, and/or events that may be organized in said parks with the dog\nas the main protagonist may also access these areas,\nas long as the animals\ninside are not put at risk. In this case, persons who wish\nto interact with the dogs must always have the corresponding permission\nof the owner. Minors under 12 years of age must always be accompanied by their\nfather, mother, guardian, or a person of legal age who takes responsibility at all times\nfor the minor.\n\nArticle 6—Maintenance. The Municipalidad de Moravia\nshall provide adequate maintenance of the parks by carrying out the\nnecessary works and maintenance tasks that guarantee their best and most\nappropriate use.\n\nArticle 7—Activities. Any activity outside\nthe ordinary use of the park must be of general interest and previously authorized\nby the Municipalidad.\n\nCHAPTER III\n\nOn use\n\nArticle 8—Hours and gratuity. The municipal dog\nparks shall be open to the public permanently and shall be\nfree of charge.\n\nArticle 9—Mandatory rules of use. For the\nuse of the parks, the following mandatory and strictly\nenforced rules are established:\n\na) The park is for the exclusive\nuse of dogs, their owners, or companions.\n\nb) The animals must\nbe accompanied at all times, whether by their owner or whoever acts as a\ncompanion.\n\nc) It is the obligation of the\nowner or companion to pick up the excrement generated by their dogs; for\nthis purpose, they must carry their bags and deposit them completely closed in the\ncontainers installed for this purpose.\n\nd) The park door\nmust remain closed at all times.\n\ne) Dogs must\nenter and exit the park on a leash; their owners or companions\nmust not release their leashes until after closing the park door.\n\nf) Dogs must\nwear a collar at all times to facilitate their separation in case of a\nconfrontation.\n\ng) Those pets\nthat are classified as potentially dangerous or with characteristics that\nso advise (strong musculature, large jaws, aggressiveness) must\npermanently be on a leash and muzzled.\n\nh) If an animal\nbecomes aggressive, it must leave the park immediately.\n\ni) At the slightest sign\nof aggressiveness, the owner or companion of the dog shall secure it with the leash\nand must leave the park for a prudent time until the dog has\ncalmed down.\n\nj) Dogs may\nremain in the enclosure for as long as they wish, within the permitted hours,\nas long as no conflicts arise.\n\nk) Smoking and consuming alcoholic beverages are strictly\nprohibited.\n\nl) Park\nusers shall ensure that the tranquility and rest of the municipality's\nneighbors are respected, preventing excessive noise from being made, both by\nthe dogs and by the people.\n\nCHAPTER IV\n\nProhibitions and responsibilities\n\nArticle 10.—Prohibitions.\n\na) The entry\nof dogs in heat, sick, or unvaccinated, and those wearing prong or teeth collars, is prohibited.\n\nb) The dog must be\nwatched at all times; therefore, leaving them\nalone in the park is absolutely prohibited.\n\nc) Bathing\npets inside the park is strictly prohibited.\n\nd) Entering\nthe park with solid foods is strictly prohibited, as well as the consumption of\nalcoholic beverages on the premises.\n\ne) Feeding\nthe animals in the park is strictly prohibited.\n\nArticle 11.—Responsibilities. The\nowners or companions of the dogs shall be obligated to respect the\npark's rules of use, being legally responsible for any type of\ndamages that may be caused to the public infrastructure, as well as for\ncomplying with current regulations on the protection of domestic animals, ownership\nof potentially dangerous animals, and municipal ordinances relating to the\nenvironment, the Municipalidad being released from this type of\nresponsibility.\n\nCHAPTER IV\n\nProvisions on animal abuse\n\nand dissemination of regulations\n\nArticle 12.—Complaints for animal abuse. When\na visitor to the dog parks witnesses conduct that\nmay constitute animal abuse in light of the Animal Welfare\nLaw, No. 7451 and its amendments, as well as any other rule that regulates the\nmatter, they must file the complaint before the Environmental Management Office of the\nMunicipalidad de Moravia, for which an official mechanism for\nhandling will be available.\n\nArticle 13.—Information and dissemination. The\nInstitutional Communication Department shall be responsible for promoting\nthe dissemination of the rules set forth in these Regulations.\n\nLikewise, the Municipalidad de Moravia shall endeavor\nto have sufficient resources to maintain adequate signage on these\nmeasures in the dog parks.\n\nIt shall take effect upon its publication." }
