240\nde la Ley Nº 6227 Ley General de la Administración Pública de fecha 2 de\nmayo de 1978 y sus reformas; Ley Nº 59 Ley de Creación y Organización\ndel Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas;\nLey Nº 8905 Reforma del artículo 2 de la Ley N° 5695, Creación del\nRegistro Nacional, y sus reformas; y modificación de la Ley N° 59,\nCreación y Organización del Instituto Geográfico Nacional, de 4 de julio de\n1944, y sus reformas de fecha 7 de diciembre del 2010; Ley Nº 6043 Ley\nsobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo\nreglamento y; artículos 2 y 3 de la Ley Nº 5695 Ley de Creación del Registro\nNacional de fecha 28 de mayo de 1975 y sus reformas.\n\nConsiderando:\n\n1°-Que mediante Ley Nº 8905 se establece el Instituto\nGeográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional,\nquien suscribirá los contratos y convenios necesarios para el ejercicio de sus\nfunciones. Asimismo, de conformidad con la Ley Nº 59, el IGN es la\ndependencia científica y técnica rectora de la cartografía nacional,\ndestinada a la ejecución del Mapa básico oficial y la Descripción básica\ngeográfica de la República de Costa Rica y a los estudios, las investigaciones\no labores y el desarrollo de políticas nacionales de carácter\ncartográfico, geográfico, geodésico, geofísico y de índole similar que\ntenga relación con dichas obras, con el fin de apoyar los procesos de\nplanificación.\n\n2°-Que la Ley Nº 59 constituye al IGN de manera permanente\ny en representación del Estado, como la autoridad oficial en materia geodésica\ny de la representación espacial de la geografía de la República de Costa Rica,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con el artículo 62 del Decreto Ejecutivo\nN°7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del\n16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para\nla delimitación de la zona pública de la Zona Marítimo Terrestre, y su\noficialización a través de publicación en el Diario Oficial La Gaceta; el\nartículo 63 del Decreto Ejecutivo N°7841-P señala que \"El Instituto Geográfico\nNacional deberá publicar aviso en el Diario Oficial, de cada porción de\nla zona marítimo-terrestre en que haya demarcado la zona pública.\"\n\n4°-Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET Reglamento\nde Especificaciones para la Delimitación de la zona pública de la Zona\nMarítimo Terrestre del 28 de junio del 2011, se establece en el artículo 18\nque para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN\npodrá acudir a dos metodologías de ejecución, mismas que se indican en los\nartículos 19 y 20, correspondientes a la delimitación de la zona pública de la\nZona Marítimo Terrestre a través de la colocación de mojones y/o a la\ndelimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT Declara\ncomo datum horizontal oficial para Costa Rica, el CR05, enlazado al\nMarco Internacional de Referencia Terrestre (ITRF2000) del Servicio\nInternacional de Rotación de la Tierra (IERS) para la época de medición 2005.83\ndel 30 de marzo del 2007, el cual, entre otros aspectos determina a la Red\nGeodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica\nasociada CRTM05, como el sistema oficial al cual deben estar referidas las\ncoordenadas de todos los trabajos geodésicos, cartográficos y catastrales que\nse ejecuten en nuestro país, señalando específicamente en artículo 11 que: \"La\nRed Geodésica Nacional de Referencia Horizontal CR05 y el sistema de\nproyección cartográfica CRTM05, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica a partir del cual se debe\nreferenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia\npública, persona o entidad privada nacional o extranjera.\"; mientras que\nel artículo 7 indica que \"Conforme se produzcan datos cartográficos en\nel nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico\nNacional publicará por los medios adecuados aquella información que se\nha oficializado.\".\n\n6°-Que el Decreto Ejecutivo Nº 40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que \"El sistema geodésico de referencia horizontal\noficial para Costa Rica, denominado como CR05 y su materialización\nmediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como\nsistema de referencia horizontal oficial para la República de Costa\nRica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008\n(IGb08), para la época de medición 2014.59, y en adelante, los cambios y\nsu actualización, se regirán de acuerdo a las nuevas definiciones del\nITRF que se implementen en la red continental del Sistema de Referencia\nGeocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON\"; mientras\nque el artículo 2 establece que \"El sistema de proyección cartográfica\nCRTM05 seguirá siendo el oficial para la representación cartográfica del\nterritorio nacional continental, extendido para efectos de aplicación de\nesta proyección cartográfica, hasta la línea de base del mar territorial\nen el océano Pacífico y el mar Caribe, definida esta línea conforme a\nlos artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\"\n\nPor su parte, el artículo 12 del decreto de cita,\nrefuerza la aplicación de la proyección cartográfica CRTM05 como el sistema\nnacional de coordenadas oficial a la cual se deben referenciar en el territorio\ncontinental de nuestro país, al señalar que \"El sistema de referencia\nhorizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el\nterritorio continental extendido hasta la línea de base del mar territorial\ny, la proyección cartográfica \"Universal Transversal de Mercator\" (UTM),\nzonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano\nPacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas\npara la República de Costa Rica, a partir del cual, se deben referenciar\ntodos los levantamientos y actividades cartográficos y geodésicos que desarrollen\nen el territorio nacional toda dependencia pública, persona o entidad\nprivada, nacional o extranjera, que emprendan o contraten trabajos\ngeodésicos y cartográficos, contribuyéndose a evitar el gasto público y\nobteniendo, por otra parte, información geográfica confiable, uniforme\ny comparable, que sea de utilidad general y que apoye la toma de\ndecisiones en los distintos niveles del Estado.\"\n\n7°-Que la georreferenciación al sistema nacional de\ncoordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo\nTerrestre, posibilita la correcta delimitación de la zona pública a los efectos\nde la elaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento\nterritorial costero.\n\n8°-Que la información digital georreferenciada sobre delimitación\nde la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le\ndenomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional\n(IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\n9°-Que la Geodatabase Digital Georreferenciada (GDG)\ndel Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT)\nse fundamenta técnicamente en aplicación de la regulación establecida por: a)\nel Decreto Ejecutivo N°7841-P Reglamento a la Ley N° 6043 sobre la Zona\nMarítimo Terrestre, b) el Decreto Ejecutivo N°33797-MJMOPT Declara como\ndatum horizontal oficial para Costa Rica, el CR05, y su proyección\ncartográfica asociada, CRTM05, y c) el Decreto Ejecutivo N°\n36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de\nla zona pública de la Zona Marítimo Terrestre.\n\n10.-Que el artículo 16 de la Ley Forestal, Ley N°7575 del\n13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente\ny Energía (MINAE) delimitará en el terreno los linderos de las áreas que\nconforman el Patrimonio Natural del Estado.\n\n11.-Que el artículo 11 del Capítulo I, Disposiciones Generales\nde la Ley N° 6043, establece que la \"Zona pública es también, sea\ncual fuere su extensión, la ocupada por todos los manglares de los\nlitorales continentales e insulares y esteros del territorio nacional.\"\n\n12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual\npara la clasificación de tierras dedicadas a la conservación de los recursos\nnaturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La\nGaceta Nº 217 del 11 de noviembre del 2011, establece entre sus\nobjetivos \"Identificar dentro de la Zona Marítimo Terrestre aquellos\nterrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y\nVIII), humedales (manglares, esteros, rías, marismas, lagunas costeras,\npantanos, bosques anegados, salitrales), para certificarlos e incorporarlos\ncomo parte del Patrimonio Natural del Estado (PNE).\"\n\n13.-Que el Decreto Ejecutivo N° 36786-MINAET en el Punto\nIII.-Competencias para la delimitación y certificación establece que\n\"La clasificación de los terrenos dentro de la ZMT corresponderá a las\nÁreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación\n(SINAC) y a profesionales privados debidamente acreditados por los Colegios\nProfesionales respectivos para que clasifiquen los bosques, terrenos de\naptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías,\nmarismas, lagunas costeras, pantanos, bosques anegados, salitrales) y\nhumedales.\n\nLa validez de los documentos de clasificación emitidos\npor profesionales privados quedará sujeta a la aprobación que emita el AC que\npor competencia territorial le corresponda. A las AC del SINAC con jurisdicción\nen la ZMT les competerá, además, la verificación, fiscalización, deslinde y\ncertificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.\n\nLa ubicación y delimitación de las áreas del\nPatrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse\ncomo parte del proceso de aprobación del Plan Regulador Costero (PRC), definido\npor la Ley 6043, ya que el Plan Regulador Costero es el instrumento de\nordenamiento territorial, que define y ubica todas las zonas a concesionar dentro\nde la ZMT y para la clasificación de ésta a nivel de los planos de catastro.\nPor tanto, el Plan Regulador Costero debe indicar clara y expresamente, las\náreas del PNE para no contabilizarlas en el área total a concesionar.\"\n\n14.-Que el artículo 69 de la Ley N°276 Ley de Aguas del\n27 de agosto de 1942 y sus reformas, dispone en lo de interés que: \"Por zona\nmarítima se entiende el espacio de las costas de la República que baña\nel mar en su flujo y reflujo y los terrenos inmediatos hasta la\ndistancia de una milla, o sean mil seiscientos setenta y dos metros,\ncontados desde la línea que marque la marea alta. Esta zona marítima se\nextiende también por las márgenes de los ríos hasta el sitio en que\nsean navegables o se hagan sensibles las mareas, con un ancho de\ndoscientos metros desde cada orilla, contados desde la línea que marque\nla marea alta.\"\n\n15.-El Instituto Geográfico Nacional utilizó la metodología\nde Delimitación de Digital Georreferenciada, para delimitar la zona pública de\nla Zona Marítimo Terrestre correspondiente a la Ría del Río Cabo Blanco, en el\ndistrito 05º Paquera y el distrito 04º Lepanto, cantón 01º Puntarenas, provincia\n06º Puntarenas.\n\n16.-Que mediante el oficio ACT-OR-DR-086-2023 de\nfecha 25 de enero de 2023 suscrito por el Nelson Marín Mora, Director\ndel Área de Conservación Tempisque (ACT) se hace entrega del el alcance\nde la Ría del Río Cabo province 06º Puntarenas\n\nNATIONAL GEOGRAPHIC INSTITUTE\n\nTOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT\n\nMARITIME TERRESTRIAL ZONE\n\nNotice No. 008-2023.—Delimitation of the public zone corresponding to the Ría of the Cabo Blanco River in districts 05º Paquera and 04º Lepanto, canton 01º Puntarenas, province 06º Puntarenas.\n\nBased on the provisions of Articles 140 and 240 of Law No. 6227, the General Public Administration Law of May 2, 1978, and its amendments; Law No. 59, the Law for the Creation and Organization of the National Geographic Institute of July 4, 1944, and its amendments; Law No. 8905, Amendment of Article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and modification of Law No. 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its amendments of December 7, 2010; Law No. 6043, the Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulation; and Articles 2 and 3 of Law No. 5695, the Law for the Creation of the National Registry of May 28, 1975, and its amendments.\n\nConsidering:\n\n1°—That Law No. 8905 establishes the National Geographic Institute, hereinafter IGN, as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical body governing national cartography, intended for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, investigations or work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\n2°—That Law No. 59 permanently constitutes the IGN, on behalf of the State, as the official authority in geodetic matters and for the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order originating from the work entrusted to it.\n\n3°—That in accordance with Article 62 of Executive Decree No. 7841-P, Regulation to the Law on the Maritime Terrestrial Zone of December 16, 1977, and its amendments, the competence of the IGN is recognized for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree No. 7841-P states that \"The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4°—That Executive Decree No. 36642-MP-MOPTMINAET, Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone of June 28, 2011, establishes in Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\n5°—That Executive Decree No. 33797-MJ-MOPT, Declares CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for measurement epoch 2005.83, of March 30, 2007, which, among other aspects, determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person, or private entity, national or foreign, must be referenced.\"; while Article 7 indicates that \"As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, by appropriate means, that information which has been officialized.\"\n\n6°—That Executive Decree No. 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, declares in its Article 1 that \"The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for measurement epoch 2014.59, and henceforth, changes and its updating shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON\"; while Article 2 establishes that \"The cartographic projection system CRTM05 shall continue to be the official one for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection, up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum breadth of all jurisdictional marine areas of the Costa Rican State.\"\n\nIn turn, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which referencing must be made in the continental territory of our country, stating that \"The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea and, the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which, all cartographic and geodetic surveys and activities developed in the national territory by any public agency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic works must be referenced, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State.\"\n\n7°—That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), approval of survey plans, granting of concessions in the Restricted Zone, and other aspects of coastal territorial planning.\n\n8°—That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9°—That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P, Regulation to Law No. 6043 on the Maritime Terrestrial Zone, b) Executive Decree No. 33797-MJ-MOPT, Declares CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05, and c) Executive Decree No. 36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone.\n\n10.—That Article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, and its amendments, establishes that the Ministry of Environment and Energy (MINAE) shall delimit on the ground the boundaries of the areas that make up the Natural Heritage of the State.\n\n11.—That Article 11 of Chapter I, General Provisions of Law No. 6043, establishes that the \"Public zone is also, whatever its extension, that occupied by all mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.\"\n\n12.—That Executive Decree No. 36786-MINAET, Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives \"To identify within the Maritime Terrestrial Zone those lands that classify as forests, of forestry aptitude (suelos Clase VII y VIII), wetlands (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), to certify them and incorporate them as part of the Natural Heritage of the State (PNE).\"\n\n13.—That Executive Decree No. 36786-MINAET in Point III.—Competencies for delimitation and certification establishes that \"The classification of lands within the ZMT shall correspond to the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations to classify forests, lands of forestry aptitude (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), and wetlands.\n\nThe validity of classification documents issued by private professionals shall be subject to the approval issued by the AC with corresponding territorial competence. The AC of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation, and certification of the lands of the Natural Heritage of the State and the protection zones.\n\nThe location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all the zones to be concessioned within the ZMT and for its classification at the level of cadastral plans. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the areas of the PNE so as not to count them in the total area to be concessioned.\"\n\n14.—That Article 69 of Law No. 276, Water Law of August 27, 1942, and its amendments, provides in relevant part that: \"Maritime zone is understood to mean the space of the coasts of the Republic bathed by the sea in its flow and ebb and the immediate lands up to the distance of one mile, that is, one thousand six hundred seventy-two meters, counted from the line marking the high tide. This maritime zone also extends along the banks of rivers up to the point where they are navigable or the tides become noticeable, with a width of two hundred meters from each bank, counted from the line marking the high tide.\"\n\n15.—The National Geographic Institute used the Digital Georeferenced Delimitation methodology to delimit the public zone of the Maritime Terrestrial Zone corresponding to the Ría of the Cabo Blanco River, in district 05º Paquera and district 04º Lepanto, canton 01º Puntarenas, province 06º Puntarenas.\n\n16.—That through official communication ACT-OR-DR-086-2023 of January 25, 2023, signed by Nelson Marín Mora, Director of the Tempisque Conservation Area (ACT), the extent of the Ría of the Cabo Blanco River is delivered, located in district 05º Paquera and district 04º Lepanto, canton 01º Puntarenas, province 06º Puntarenas, according to official communication ACT-OSRPL-050-2023 of January 16, 2023, which presents the delimitation of the Ría of the Cabo Blanco River, the object of this Notice.\n\n18.—That the National Geographic Institute carried out the delimitation of both banks of the estuarine system determined by ACT, through the report called TECHNICAL REVIEW REPORT FOR THE PUBLICATION OF GEOREFERENCED DELIMITATION OF THE PUBLIC ZONE OF THE RÍA OF THE CABO BLANCO RIVER under report number DIG-TOT-INF-069-2023 of March 28, 2023, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.\n\n17.—That the delimitation has internal technical approval according to the Technical Review report through the report called TECHNICAL REVIEW REPORT FOR THE PUBLICATION OF GEOREFERENCED DELIMITATION OF THE PUBLIC ZONE OF THE RÍA OF THE CABO BLANCO RIVER under report number DIG-TOT-INF-069-2023 of March 28, 2023, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute and, in accordance with what was delimited according to official communication ACT-OSRPL-050-2023 of January 16, 2023, signed by Mr. Pedro Andrey Rojas Chaves, Acting Head of the Paquera-Lepanto Subregional Office of the Tempisque Conservation Area.\n\n18.—That Article 140 of Law No. 6227, the General Public Administration Law, states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted,\" a provision that must necessarily be related to numeral 204, subsection 1) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature, stating: \"General acts shall be communicated by publication and specific acts by notification.\"\n\nCOMMUNICATES:\n\n1º—The National Geographic Institute used the \"Digital Georeferenced Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in the Ría of the Cabo Blanco River, located in districts 05º Paquera and 04º Lepanto, canton 01º Puntarenas, province 06º Puntarenas, based on official communication ACT-OR-DR-086-2023 of January 25, 2023, signed by Nelson Marín Mora, Director of the Tempisque Conservation Area (ACT).\n\n2º—The public zone of the Maritime Terrestrial Zone corresponding to the Ría of the Cabo Blanco River corresponds to the tidal affectation, whose approximate coordinates of the \"upstream\" end point defined by ACT are indicated in the official cartographic projection system of Costa Rica, CRTM05, as follows:\n\nRía Cabo Blanco River\n\n \n\n| Ría End Point | EAST | NORTH |\n| --- | --- | --- |\n| Ría | 391732.65 | 1098807.66 |\n\n \n\n3º—That the sectors in the vicinity of the Cabo Blanco River that currently have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.\n\n4º—The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, delimitation of the public zone corresponding to the Ría of the Cabo Blanco River, districts 05º Paquera and 04º Lepanto, canton 01º Puntarenas, province 06º Puntarenas, have been recorded in the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a vector shape format file, under the coding: RN/IGN_GDGIGN-ZMT_CR_Rías.\n\n5º—Effective as of its publication.\n\nGiven in Curridabat, San José, June 28, 2023." }
