Como parte de dicho convenio, se\nincluyó el financiamiento de la ejecución de operaciones individuales de la red\nvial cantonal por la suma de doscientos millones de dólares estadounidenses\n(USD 200.000.000,00).\n\nll.-Que la primera etapa del referido financiamiento,\npor sesenta millones de dólares estadounidenses (USD 60.000.000,00), se\nconcretó por medio del Contrato de Préstamo 2098/OC-CR Programa Red Vial\nCantonal PRVC-I, que fue aprobado por la Asamblea Legislativa mediante la Ley\nNº 8982, etapa que se completó al 31 de diciembre de 2017.\n\nIII.-Que de conformidad con la Ley N° 8757 y el\nartículo 3 de la Ley N° 8982, el contrato individual de préstamo que financiará\nel Segundo Programa de la Red Vial Cantonal (PRVC II), derivado del Convenio de\nCooperación para el Financiamiento de Proyectos de Inversión (CR-X1007), no\ndeberá someterse al trámite ni a la eventual aprobación de la Asamblea\nLegislativa. En virtud de lo anterior, el Ministerio de Hacienda formuló\nsolicitud para la segunda etapa del Programa por los restantes ciento cuarenta\nmillones de dólares estadounidenses (USD 140.000.000,00), siendo que entonces\nel Gobierno de la República y el BID suscribieron el Contrato de Préstamo\n4507/0C-CR, Resolución DE-8/18, de fecha 20 de setiembre de 2018 que ha contado\ncon las aprobaciones por parte del Banco Central de Costa Rica, de la Autoridad\nPresupuestaria, Crédito Público y del Ministerio de Planificación Nacional y\nPolítica Económica (MIDEPLAN).\n\nIV.-Que de conformidad con el numeral (b) de [a\ncláusula 3.01 de las Estipulaciones Especiales del Contrato de Préstamo\n4507/OC-CR, corno parte de las condiciones especiales previas al primer\ndesembolso de los recursos del Préstamo se incluye el que haya formalizado la\nUnidad Ejecutora del Programa dentro de la estructura del Ministerio de Obras\nPúblicas y Transportes y el que cuente con la formalización del procedimiento\nespecial de adquisiciones para la ejecución de los procesos de contratación.\n\nV.-Que mediante la resolución del Ministerio de Obras\nPúblicas y Transportes Nº 002125 de las 13:15 horas del 12 de noviembre del\n2018, se formalizó la Unidad Ejecutora y de Coordinación del Programa Red Vial\nCantonal II (PRVC-II).\n\nVI.-Que lo transcrito implica la necesidad de\nestablecer coordinación y colaboración con los gobiernos locales, dado que los\nrecursos provenientes del préstamo deberán ser invertidos por el MOPT en la red\nvial cantonal.\n\nVII.-Que conforme lo anterior y en aplicación de la\ncoordinación que debe imperar entre el Ministerio de Obras Públicas y\nTransportes y las Municipalidades para la ejecución de los recursos\nprovenientes del programa BID-Cantonal, resulta indispensable en primera\ninstancia, determinar las obras en las cuales se invertirán dichos recursos,\nobedeciendo tal definición a razones de conveniencia y razonabilidad.\n\nVIII.-Que conforme los\nantecedentes destacados en los acápites precedentes, dentro de los proyectos\nque se están ejecutando a través del Programa de la Red Vial Cantonal (PRVC\nII), -Municipalidad de San Rafael de Heredia- se incluye el proyecto:\n\"Construcción de alcantarilla de cuadro sobre Río Burío, código 4-05-037 De\n(Ent N502 Pulpería Enrique Rojas) Hasta (Ent N126 Ferretería San Roque, Calle\nMatasano)\".\n\nIX.-Que en la actualidad el camino con código C.4-\n05-037 cuenta con un puente de 6 metros de longitud, es un arco de piedra sobre\nel cual se apoyan vigas de concreto, la estructura posee un paso peatonal con\nun ancho que no cumple con la reglamentación. la estructura es deficiente a\nnivel estructural y cuenta únicamente con un carril y los accesos en ambos\nsentidos cuenta con dos carriles lo cual su estado funcional no cumple en\ncuanto a sus aproximaciones: con un señalamiento vial deficiente.\n\nX.-Que el proyecto beneficiará aproximadamente 2.130\npersonas directamente, con respecto a los beneficiarios indirectos ascienden\naproximadamente 15.252 personas, dedicados en su mayoría a actividades\nterciarias.\n\nXI.-Que el Proyecto denominado: \"Construcción de\nalcantarilla de cuadro sobre Río Burío, código 4-05-037 De (Ent N502 Pulpería\nEnrique Rojas) Hasta (Ent N126 Ferretería San Roque, Calle Matasano)\", al\namparo del artículo 17 de la Ley Orgánica del Ambiente N° 7554, cuenta con la\nrespectiva viabilidad ambiental emitida por la Secretaria Técnica Nacional\nAmbiental (SETENA): según resolución N° 1187-2021-SETENA de las 10:28 horas del\n04 de agosto del 2021 (expediente administrativo Nº D1-0386-2021-SETENA).\n\nXII.-Que de conformidad con el oficio Nº\nSINAC-ACC-OH-636 del 10 de mayo de 2022, emitido por el Área de Conservación\nCentral, Reserva de Biosfera Cordillera Volcánica Central (Oficina de Heredia)\ndel Sistema Nacional de Áreas de Conservación (SINAC), se hizo constar sobre el\nsitio del proyecto que: \".que la ubicación aportada se encuentra fuera de\nterritorio Patrimonio Natural del Estado\".\n\nXIII.-Que los artículos 19 inciso b) y 34 de la Ley\nForestal N° 7575 prohíben el cambio de uso de suelo y la colla de árboles en\nterrenos privados cubiertos de bosque, así como la corta de árboles en las\náreas de protección definidas en el numeral 33 del mismo cuerpo normativo,\nexceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo\ndeclare de Conveniencia Nacional, constituyéndose en estos, aquellos proyectos\ncuyos beneficios sociales son mayores a los costos socio ambientales.\n\nXIV.-Que en razón del Considerando anterior, el\ndesarrollador elaboró la evaluación económica-social del citado proyecto con el\ninforme número del MOPT-01-06-01- 035-2022 del mes de noviembre de 2022, la\ncual fue sometida por parte del Ministerio de Ambiente y Energía a valoración,\nen aras de ponderar que los beneficios sociales sean superiores a los costos\nsocio-ambientales, al amparo del inciso m) del artículo 03 de la Ley Forestal\nN° 7575, lo anterior a efecto de que se emitieran las recomendaciones\nrespectivas, mismas que en lo conducente, refirieron que el procedimiento\nutilizado por el desarrollador fue adecuado para la demostración del bienestar\nsocial, y de conformidad con el criterio técnico sin número de fecha 1 de\nfebrero de 2023 de la Economista Ambiental, se determinó que:\n\n\"En conclusión, el estudio presentado muestra que\nexiste un beneficio social positivo. Permite fortalecer la red vial en el sitio\ny agilizar el comercio y circulación de la población. Por tal motivo, el\nproyecto puede considerarse de conveniencia nacional.\n\n(.)\n\nPor tal motivo, considerando lo anterior y\ndebido a que los resultados del proyecto (TIRE Y VANE) fueron positivos, se\nconsidera que al proyecto puede otorgársele la declaratoria de conveniencia\nnacional\".\n\nXV.-Que, de conformidad con el Reglamento a la Ley de\nProtección al Ciudadano del Exceso de Requisitos y Trámites Administrativos,\nDecreto Ejecutivo N°37045-MP-MEIC del 22 de febrero de 2012 y sus reformas, se\ndeterminó que la presente propuesta no establece ni modifica trámites,\nrequisitos o procedimientos que el administrado deba cumplir, situación por la\nque no se procedió con el trámite de control previo. By virtue of the foregoing, the Ministry of Finance formulated a request for the second stage of the Program for the remaining one hundred forty million United States dollars (USD 140,000,000.00), and the Government of the Republic and the IDB then signed Loan Contract 4507/0C-CR, Resolution DE-8/18, dated September 20, 2018, which has received the approvals of the Central Bank of Costa Rica, the Budgetary Authority, Public Credit, and the Ministry of National Planning and Economic Policy (MIDEPLAN).\n\nIV.—That in accordance with numeral (b) of clause 3.01 of the Special Stipulations of Loan Contract 4507/OC-CR, as part of the special conditions prior to the first disbursement of the Loan resources, it is included that the Program Executing Unit has been formalized within the structure of the Ministry of Public Works and Transport and that it has the formalization of the special procurement procedure for the execution of the contracting processes.\n\nV.—That by means of resolution of the Ministry of Public Works and Transport No. 002125 of 1:15 p.m. on November 12, 2018, the Executing and Coordination Unit of the Cantonal Road Network Program II (PRVC-II) was formalized.\n\nVI.—That the foregoing implies the need to establish coordination and collaboration with local governments, given that the resources from the loan must be invested by the MOPT in the cantonal road network.\n\nVII.—That in accordance with the foregoing and in application of the coordination that must prevail between the Ministry of Public Works and Transport and the Municipalities for the execution of the resources from the BID-Cantonal program, it is essential in the first instance to determine the works in which said resources will be invested, such definition being based on reasons of convenience and reasonableness.\n\nVIII.—That according to the background highlighted in the preceding sections, among the projects being executed through the Cantonal Road Network Program (PRVC II), -Municipality of San Rafael de Heredia- the project: \"Construction of box culvert over Burío River, code 4-05-037 From (Ent N502 Pulpería Enrique Rojas) To (Ent N126 Ferretería San Roque, Calle Matasano)\" is included.\n\nIX.—That currently the road with code C.4-05-037 has a bridge 6 meters long; it is a stone arch on which concrete beams rest; the structure has a pedestrian walkway with a width that does not comply with regulations. The structure is deficient at a structural level and has only one lane, while the accesses in both directions have two lanes, meaning its functional condition does not comply in terms of its approaches, with deficient road signage.\n\nX.—That the project will directly benefit approximately 2,130 people; indirect beneficiaries amount to approximately 15,252 people, mostly engaged in tertiary activities.\n\nXI.—That the Project called: \"Construction of box culvert over Burío River, code 4-05-037 From (Ent N502 Pulpería Enrique Rojas) To (Ent N126 Ferretería San Roque, Calle Matasano)\", under Article 17 of the Organic Environmental Law No. 7554, has the respective environmental viability (viabilidad ambiental) issued by the National Environmental Technical Secretariat (Secretaría Técnica Nacional Ambiental, SETENA): according to resolution No. 1187-2021-SETENA of 10:28 a.m. on August 4, 2021 (administrative file No. D1-0386-2021-SETENA).\n\nXII.—That in accordance with official letter No. SINAC-ACC-OH-636 of May 10, 2022, issued by the Central Conservation Area, Cordillera Volcánica Central Biosphere Reserve (Heredia Office) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), it was certified regarding the project site that: \"...the provided location is outside of State Natural Heritage territory\".\n\nXIII.—That Articles 19 subsection b) and 34 of the Forestry Law No. 7575 prohibit land-use change (cambio de uso de suelo) and the felling of trees on private lands covered by forest, as well as the felling of trees in the protection areas defined in numeral 33 of the same regulatory body, excepting those state or private projects that the Executive Branch declares of National Convenience, these being those projects whose social benefits are greater than the socio-environmental costs.\n\nXIV.—That due to the preceding Considering, the developer prepared the social-economic evaluation of the cited project with report number MOPT-01-06-01-035-2022 of November 2022, which was submitted by the Ministry of Environment and Energy for assessment, in order to weigh whether the social benefits are superior to the socio-environmental costs, under subsection m) of Article 03 of the Forestry Law No. 7575, the foregoing so that the respective recommendations could be issued, which, as pertinent, indicated that the procedure used by the developer was adequate for demonstrating social welfare, and in accordance with the undated technical criterion of February 1, 2023, from the Environmental Economist, it was determined that:\n\n\"In conclusion, the study presented shows that there is a positive social benefit. It allows strengthening the road network at the site and expediting commerce and circulation for the population. For this reason, the project can be considered of national convenience.\n\n(.)\n\nFor this reason, considering the above and because the project results (IRR AND ENPV) were positive, it is considered that the project can be granted the declaration of national convenience.\"\n\nXV.—That, in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or formalities that the citizen must comply with, a situation for which the prior control procedure was not carried out. Therefore;\n\nDecree:\n\nDECLARATION OF NATIONAL CONVENIENCE\n\nOF THE PROJECT CALLED \"CONSTRUCTION\n\nOF BOX CULVERT OVER BURÍO RIVER,\n\nCODE 4-05-037 FROM (ENT N502 PULPERÍA ENRIQUE\n\nROJAS) TO (ENT N126 FERRETERÍA SAN ROQUE,\n\nCALLE MATASANO)\"\n\nArticle 1.—The public works project called: \"Construction of box culvert over Burío River, code 4-05-037 From (Ent N502 Pulpería Enrique Rojas) To (Ent N126 Ferretería San Roque, Calle Matasano)\" is declared of National Convenience, as well as the associated prevention, mitigation, and compensation works required by it within the project area, which shall be executed by the PRVC-II Coordination Executing Unit, MOPT/IDB, or by whomever is designated under the current legal framework.\n\nArticle 2.—By virtue of the declaration of National Convenience for the project called \"Construction of box culvert over Burío River, code 4-05-037 From (Ent N502 Pulpería Enrique Rojas) To (Ent N126 Ferretería San Roque, Calle Matasano)\", and in accordance with Articles 19 subsection b) and 34 of the Forestry Law No. 7575, the cutting or removal of trees located on lands covered by forest or in the protection areas defined in Article 33 of the Forestry Law No. 7575 is authorized, which must be carried out in a limited, proportional, and reasonable manner, after processing the respective permits before the pertinent Conservation Area (Área de Conservación) of the National System of Conservation Areas and provided that the trees are not located on State Natural Heritage lands.\n\nArticle 3.—The Ministry of Public Works and Transport, through the PRVC-II Coordination Executing Unit, MOPT/IDB, must comply with the requirements of the National Environmental Technical Secretariat, as well as with the obligations established in the Environmental Impact Study, the Sworn Declaration of Environmental Commitments, and the approved environmental mitigation and compensation measures.\n\nArticle 4.—In the event that the felled existing forest resource is usable, its delivery shall be coordinated with the Ministry of Environment and Energy (MINAE), in accordance with subsection q) of the article and numeral 65 of the Forestry Law No. 7575, amended by Law No. 9927 of December 18, 2020.\n\nArticle 5.—Effective as of its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.—San José, on the twenty-second day of the month of May of the year two thousand twenty-three."
