  "body_es_text": "Dictamen : 153 del 18/06/2015   \n\n\n\n18 de junio del 2015\n\n\n\n\nC-153-2015\n\n\n\n\n \n\n\n\n\nSeñor\n\n\n\n\nAlfonso Duarte Marín\n\n\n\n\nDirector\n\n\n\n\nÁrea de Conservación Pacífico Central\n\n\n\n\nSistema Nacional de Áreas de Conservación\n\n\n\n\n \n\n\n\n\nEstimado señor:\n\n\n\n\n \n\n\n\n             Con la aprobación de la señora Procuradora General, me refiero a su Oficio N° SINAC-\nACOPAC-D-367-2015 del 26 de marzo del 2015, según el cual se consulta:\n\n\n\n\n \n\n\n\n “- ¿Cuál es la naturaleza jurídica de la Junta Directiva del Parque Recreativo Nacional Playas de\nManuel Antonio creada mediante la Ley N° 8133 reforma del inciso a) del artículo 3 de la Ley N°\n5100, y sus reformas y creación de la Junta Directiva del Fideicomiso del Parque Recreativo Nacional\nde Playas Manuel Antonio.\n\n\n\n - Según las funciones que le asigna la ley, ¿puede la Junta de cita ejercer funciones relacionadas\ncon la administración y operación del Parque Nacional Manuel Antonio?.”\n\n\n\n\n \n\n\n\n Se adjunta además criterio legal emitido por la Licda. Carolina Muñoz Solís, Asesora Legal de ésa\nÁrea de Conservación.\n\n\n\n\n \n\n\n\n\nI.                   LA CONSULTA NO CUMPLE CON LOS REQUISITOS DE ADMISIBILIDAD ESTABLECIDOS\n\n\n\n\n \n\n\n\nEl artículo 4 de la Ley N° 6815 “Ley Orgánica de la Procuraduría General de la República” señala\nclaramente quienes se encuentran facultados para realizar consultas a este Órgano Asesor: los\njerarcas de las dependencias administrativas o los auditores internos.  Lo anterior en los\nsiguientes términos:\n\n \n\n\n\n “Consultas: Los órganos de la Administración Pública, por medio de los jerarcas de los diferentes\nniveles administrativos, podrán consultar el criterio técnico-jurídico de la Procuraduría; en cada\ncaso, deberán acompañar la opinión de la asesoría legal respectiva, salvo el caso de los auditores\ninternos, quienes podrán realizar la consulta directamente.” (la negrita y el subrayado no es del\noriginal).\n\n\n\n\n \n\n\n\n\nSobre el tema, hemos señalado:\n\n\n\n\n \n\n\n\n “Por jerarca debe entenderse el superior jerárquico correspondiente del respectivo órgano o entidad\nque consulta. Debe tomarse en cuenta el efecto que tienen los dictámenes de la Procuraduría. En\nvirtud de ese efecto, resulta improcedente que la Procuraduría proceda a emitir pronunciamiento\nvinculante respecto de un punto que atañe a un organismo cuando la consulta proviene de un órgano\ninferior. Es el superior jerárquico quien debe valorar la pertinencia de sujetar el reparto\nadministrativo al criterio vinculante de la Procuraduría.” Dictamen N° C-263-2005 del 20 de julio,\ncitado en el Dictamen N° 390 del 14 de noviembre del 2005 (la negrita y el subrayado no es del\noriginal).\n\n\n\n\n \n\n\n\n En la especie consta que usted realiza la consulta en su condición de Director del Área de\nConservación Pacífico Central, por lo que de conformidad con el artículo 4 de nuestra Ley Orgánica,\nno se encuentra legitimado para realizar tal consulta, pues de conformidad al artículo 26 de la ley\nN° 7788 “Ley de Biodiversidad” el Director Ejecutivo del SINAC es quien ostenta el cargo de superior\njerárquico de ese Órgano.\n\n\n\n\n \n\n\n\n En apoyo de lo anterior, en el dictamen N° C-239-2007 del 18 de julio del 2007, éste Órgano Asesor\nindicó:\n\n\n\n\n \n\n\n\n “En el caso que nos ocupa, se observa que la consulta es planteada por su persona, en carácter de\nJefe de la Subregión Pital- La Cureña, lo que permite concluir que se incumple el requisito de\nadmisibilidad previsto en el artículo 4 supra citado, relativo a que la consulta debe ser\ninterpuesta por el jerarca del órgano o institución pública, siendo en este caso el Director General\ndel Sistema Nacional de Áreas de Conservación.” (la negrita y el subrayado no son del original).\n\n\n\n\n \n\n\n\n\nII.                CONCLUSIÓN\n\n\n\n En virtud de no cumplir la consulta planteada con los requisitos de admisibilidad establecidos, nos\nencontramos legalmente imposibilitados para brindar respuesta a tal gestión.\n\n\n\n\nAtentamente,\n\n\n\n\n \n\n\n\n\n \n\n\n\n\n \n\n\n\n\nMSc. Carolina Muñoz Solís, Legal Advisor of that Conservation Area.\n\nI. THE CONSULTATION DOES NOT MEET THE ESTABLISHED ADMISSIBILITY REQUIREMENTS\n\nArticle 4 of Law No. 6815, \"Organic Law of the Attorney General's Office (Ley Orgánica de la Procuraduría General de la República),\" clearly states who is authorized to make inquiries to this Advisory Body: the heads (jerarcas) of administrative units or the internal auditors. The foregoing is set forth in the following terms:\n\n\"Inquiries: The organs (órganos) of the Public Administration, through the heads of the different administrative levels, may consult the technical-legal opinion of the Attorney General's Office; in each case, they must include the opinion of the respective legal advisory office, except in the case of internal auditors, who may submit the inquiry directly.\" (the bold and underlining are not from the original).\n\nOn this matter, we have stated:\n\n\"By head (jerarca) must be understood the corresponding hierarchical superior of the respective organ or entity making the inquiry. The effect that the opinions (dictámenes) of the Attorney General's Office have must be taken into account. By virtue of that effect, it is inappropriate for the Attorney General's Office to issue a binding pronouncement regarding a point that concerns an agency when the inquiry comes from a lower organ. It is the hierarchical superior who must assess the pertinence of subjecting the administrative distribution to the binding opinion of the Attorney General's Office.\" Opinion No. C-263-2005 of July 20, cited in Opinion No. 390 of November 14, 2005 (the bold and underlining are not from the original).\n\nIn the instant case, it is apparent that you make the inquiry in your capacity as Director of the Pacífico Central Conservation Area; therefore, in accordance with Article 4 of our Organic Law, you are not authorized to make such an inquiry, since, according to Article 26 of Law No. 7788, \"Biodiversity Law (Ley de Biodiversidad),\" the Executive Director of SINAC is the one who holds the position of hierarchical superior of that Organ.\n\nIn support of the foregoing, this Advisory Body stated in Opinion No. C-239-2007 of July 18, 2007:\n\n\"In the case before us, it is observed that the inquiry is posed by you, in your capacity as Head of the Pital-La Cureña Subregion, which leads to the conclusion that the admissibility requirement provided for in Article 4, cited above, is not met, which requires that the inquiry must be submitted by the head (jerarca) of the public organ or institution, which in this case is the Director General of the National System of Conservation Areas.\" (the bold and underlining are not from the original).\n\nII.
