AL-CPEAM-4457-2026 de 23 de abril de 2026, por medio del cual se nos comunica que la Comisión Permanente Especial de Ambiente acordó requerir nuestro criterio sobre el proyecto de ley no. 25033, denominado “LEY DE SEGURO AMBIENTAL”.\n\nI. CARÁCTER DE ESTE PRONUNCIAMIENTO.\n\nDe conformidad con los artículos 1°, 2° y 3° inciso b) de nuestra Ley Orgánica (no. 6815 de 27 de setiembre de 1982) la Procuraduría General de la República es el órgano superior consultivo, técnico jurídico, de la Administración Pública, y, en esa condición, cumple su función rindiendo los criterios legales que le solicite la Administración Pública.\n\n Para esos efectos, la Asamblea Legislativa podrá ser considerada como Administración Pública cuando nos consulte un tema en el ejercicio de la función administrativa, no así cuando requiere nuestro criterio sobre algún tema de interés para el ejercicio de la función legislativa.\n\n Pese a lo anterior y a que no existe previsión legal al efecto, la Procuraduría ha acostumbrado atender las consultas que formulan la Asamblea Legislativa y sus Diputados, con el afán de colaborar con el ejercicio de las importantes funciones que la Constitución Política les atribuye. De ahí que se rinden criterios jurídicos no vinculantes sobre determinados proyectos de ley en trámite o en relación con aspectos jurídicos que pueden considerarse cubiertos por la función de control político y que razonablemente puedan estimarse de interés general.\n\nEn vista de que el trámite de consulta de la Asamblea Legislativa a la Procuraduría no se encuentra regulado legalmente, la admisibilidad de las consultas formuladas se resuelve vía interpretación de este órgano asesor.\n\n De tal modo, como hemos dispuesto en otras ocasiones, esta forma de colaboración no dispuesta en la Ley tiene como objeto coadyuvar en la satisfacción de las funciones parlamentarias y ello mediante un asesoramiento de índole estrictamente jurídico.\n\n En virtud de ello, los criterios emanados de este órgano asesor en cuanto a los alcances y contenido de un proyecto de ley o de reforma constitucional, no poseen la obligatoriedad propia de aquellos referidos a asuntos surgidos del ejercicio de la función administrativa y, por esa razón, este criterio es vertido por medio de una opinión jurídica no vinculante que pretende ser un insumo en el ejercicio de la importante labor de la Asamblea Legislativa.\n\nPor otra parte, al no encontrarnos en los supuestos establecidos por el artículo 157 del Reglamento de la Asamblea Legislativa, este pronunciamiento no se encuentra sujeto al plazo de ocho días en él establecido. (Véanse al respecto, entre otros muchos, los pronunciamientos OJ-009-2020, de 13 de enero de 2020, OJ-055-2021, 8 de marzo de 2021, OJ-122-2021 de 30 de julio de 2021, PGR-OJ-031-2022 de 22 de febrero de 2022 y PGR-OJ-129-2022 de 6 de octubre de 2022).\n\n II. CONSIDERACIONES SOBRE EL PROYECTO DE LEY.\n\n Tal y como se indica en la exposición de motivos, el proyecto de ley parte de la premisa de fortalecer el régimen de responsabilidad ambiental en Costa Rica mediante la incorporación del seguro ambiental como instrumento de carácter preventivo, reparador y disuasorio, orientado a garantizar la disponibilidad de recursos económicos para atender los daños derivados de actividades que puedan generar impactos sobre el ambiente.\n\n La iniciativa parte de considerar que el ordenamiento jurídico costarricense, aunque contempla mecanismos dirigidos a garantizar la responsabilidad ambiental, presenta limitaciones respecto de los instrumentos financieros disponibles para asegurar la reparación efectiva de los daños. En particular, se señala que la garantía de cumplimiento prevista en el artículo 21 de la Ley Orgánica del Ambiente, Ley no. 7554, se encuentra vinculada principalmente al valor de la inversión y no necesariamente a la magnitud del riesgo ambiental, por lo que podría resultar insuficiente para afrontar los costos derivados de daños ambientales de especial gravedad.\n\n En ese contexto, el proyecto propone establecer un sistema mixto de seguro ambiental, es decir, de carácter obligatorio para aquellas actividades calificadas técnicamente como de alto riesgo ambiental, y, voluntario, acompañado de eventuales incentivos, para actividades de riesgo medio o bajo. La cobertura comprendería, entre otros aspectos, los costos relacionados con la prevención de daños inminentes, la reparación del daño y cuando corresponda, la indemnización de terceros.\n\n La propuesta pretende que este instrumento complemente los mecanismos existentes de evaluación y gestión ambiental, procurando que los costos asociados al riesgo y al eventual daño sean asumidos por quienes desarrollan las actividades susceptibles de generarlos. Asimismo, pretende incorporar un enfoque de gestión del riesgo financiero asociado al deterioro ambiental, bajo la consideración de que los daños ambientales pueden generar pasivos, afectar activos y repercutir en la estabilidad económica de las empresas.\n\n Se expone que se procura articular el nuevo régimen con la Ley Orgánica del Ambiente y con la Ley Reguladora del Contrato de Seguros (Ley no. 8956 de 17 de junio de 2011), mediante la incorporación de disposiciones específicas relativas al aseguramiento del daño ambiental.\n\n También, se hace referencia a experiencias de derecho comparado, particularmente de Argentina, Colombia, la Unión Europea y Estados Unidos, en las cuales se han implementado seguros, garantías financieras u otros mecanismos destinados a respaldar económicamente la responsabilidad derivada de daños ambientales.\n\n Con base en lo anterior, el proyecto propone incorporar el seguro ambiental como un instrumento complementario del régimen nacional de prevención, gestión y reparación del daño ambiental, mediante la adición de una Sección V al Capítulo II de la Ley Reguladora del Contrato de Seguros, así como de un artículo 21 bis a la Ley Orgánica del Ambiente.\n\n Como se indica en la exposición de motivos, la propuesta se sustenta, entre otros, en los principios de prevención, precaución y “quien contamina paga”, reconocidos por nuestro ordenamiento jurídico. Efectivamente, la regulación de la figura del seguro ambiental puede estimarse acorde a dichos principios, en tanto procura que los costos derivados de la afectación ambiental sean asumidos por quienes generan el riesgo o producen el daño, evitando, en la medida de lo posible, su traslado a la colectividad.\n\n No obstante, debe considerarse que la Ley Orgánica del Ambiente, ya contempla mecanismos de carácter preventivo vinculados con la evaluación de impacto ambiental, así como garantías de cumplimiento de las obligaciones ambientales, y atribuye competencias a la Secretaría Técnica Nacional Ambiental (SETENA) respecto de aquellas actividades, obras o proyectos susceptibles de generar impactos sobre el ambiente. De ahí que resulte necesario articular el seguro propuesto con los instrumentos de gestión y garantía ambiental existentes y delimitar con precisión las competencias que corresponderían a dicha Secretaría en relación con su implementación, seguimiento y eventual ejecución.\n\n En ese sentido, la iniciativa debe determinar con claridad cuáles actividades estarán sujetas obligatoriamente a la contratación del seguro ambiental y establecer criterios técnicos objetivos que permitan identificar y valorar el nivel de riesgo ambiental asociado a cada actividad.\n\n Asimismo, resulta necesario precisar la relación entre el seguro propuesto en el proyecto y la garantía de cumplimiento ya prevista en la legislación ambiental, determinando si ambos instrumentos operarán de manera complementaria, sustitutiva o independiente, así como sus respectivos alcances, condiciones y mecanismos de ejecución.\n\n Por otra parte, dado que la iniciativa pretende introducir disposiciones tanto en la Ley Orgánica del Ambiente como en la Ley Reguladora del Contrato de Seguros, resulta indispensable una adecuada articulación entre ambos cuerpos normativos. Mientras esta última establece el régimen jurídico general aplicable a los contratos de seguro, la Ley Orgánica del Ambiente constituye la normativa especial en materia ambiental y regula los instrumentos y la estructura institucional encargados de la evaluación y gestión ambiental. Por ello, debe valorarse cuáles aspectos corresponden propiamente a la regulación contractual y aseguradora y cuáles, por su naturaleza sustantivamente ambiental, deberían permanecer dentro de la legislación especial.\n\n En criterio de este órgano asesor, si bien la finalidad perseguida por el proyecto resulta acorde con los principios que informan el Derecho Ambiental, la propuesta requiere precisión y delimitación normativa, particularmente en cuanto a las actividades sometidas al seguro obligatorio, los criterios para determinar el nivel de riesgo ambiental, las competencias de las autoridades involucradas, la relación entre el seguro y las garantías ambientales existentes y la coordinación entre la normativa ambiental y la regulación propia de la actividad aseguradora.\n\n Asimismo, es necesario que quede claro si el seguro ambiental obligatorio será requerido únicamente a las actividades, obras o proyectos que deben someterse al procedimiento de evaluación de impacto ambiental o si también se pretende que resulte obligatorio para otras actividades ya en operación, caso en el cual, como se dijo, deben especificarse los criterios para determinar cuáles actividades quedarían contempladas y el modo de implementar esa exigencia.\n\n En fin, para el análisis del presente proyecto debe realizarse una revisión integral y una adecuada armonización de las reformas propuestas, a efecto de dotar a la iniciativa de un diseño normativo claro, coherente y preciso, que determine los sujetos y actividades comprendidos, delimite las competencias institucionales y establezca la forma en que el seguro ambiental se articulará con los mecanismos de prevención, control y garantía previstos en el ordenamiento jurídico vigente. Lo anterior, con el propósito de evitar duplicidades, contradicciones o vacíos regulatorios y garantizar la seguridad jurídica necesaria para su eventual implementación.\n\n III. LEY REGULADORA DEL CONTRATO DE SEGURO.\n\nLa Asamblea Legislativa requirió nuestro criterio sobre el proyecto de ley no. 25033, denominado “LEY DE SEGURO AMBIENTAL”.\n\nLa Procuraduría, mediante la opinión jurídica no. PGR-OJ-112-2026 de 19 de agosto de 2026, señaló lo siguiente:\n\nEl proyecto de ley pretende fortalecer el régimen de responsabilidad ambiental mediante la incorporación del seguro ambiental como instrumento preventivo y reparador, destinado a garantizar recursos para atender los daños derivados de actividades susceptibles de generar impactos ambientales. Para ello, propone un sistema mixto de aseguramiento, obligatorio para las actividades de alto riesgo ambiental y voluntario para aquellas de riesgo medio o bajo, considerando que los mecanismos financieros existentes, particularmente la garantía de cumplimiento prevista en el artículo 21 de la Ley Orgánica del Ambiente, Ley no. 7554, podrían resultar insuficientes frente a determinados daños ambientales.\n\nLa iniciativa propone adicionar una Sección V al Capítulo II de la Ley Reguladora del Contrato de Seguros, Ley no. 8956, y un artículo 21 bis a la Ley Orgánica del Ambiente, sustentándose en los principios de prevención, precaución y “quien contamina paga”. Si bien su finalidad resulta acorde con los principios que informan el Derecho Ambiental, debe considerarse que el ordenamiento vigente ya contempla mecanismos preventivos, garantías ambientales y competencias atribuidas a SETENA, por lo que resulta indispensable articular el seguro propuesto con dichos instrumentos.\n\nEn ese sentido, el proyecto debe delimitar las actividades sujetas al seguro obligatorio y establecer criterios técnicos objetivos para determinar su nivel de riesgo, así como precisar las competencias de las autoridades responsables de su implementación, seguimiento y ejecución. Asimismo, debe determinarse si el seguro operará de forma complementaria, sustitutiva o independiente respecto de la garantía de cumplimiento existente y definir si su aplicación se limitará a las actividades sometidas a evaluación de impacto ambiental o comprenderá otras actividades en operación.\n\nEn consecuencia, este órgano asesor estima necesario procurar una adecuada armonización entre la Ley Orgánica del Ambiente y la Ley Reguladora del Contrato de Seguros, mediante un diseño normativo claro que determine los sujetos y actividades comprendidos, delimite las competencias institucionales y precise la relación del seguro ambiental con los mecanismos de prevención, control y garantía existentes, a fin de evitar duplicidades, contradicciones o vacíos regulatorios y garantizar la seguridad jurídica para su eventual implementación.",

AL-CPEAM-4457-2026 of 23 April 2026, by which we were informed that the Permanent Special Environment Commission had agreed to request our opinion on bill no. 25033, entitled “ENVIRONMENTAL INSURANCE LAW.”\n\nI. NATURE OF THIS OPINION.\n\nUnder Articles 1°, 2° and 3(b) of our Organic Law (no. 6815 of 27 September 1982), the Procuraduría General de la República is the highest advisory legal and technical body of the Public Administration and, in that capacity, performs its function by issuing legal opinions requested by the Public Administration.\n\nFor these purposes, the Legislative Assembly may be considered part of the Public Administration when it consults us on a matter in the exercise of its administrative function, but not when it requests our opinion on a matter of interest to the exercise of its legislative function.\n\nDespite the foregoing, and despite the absence of a legal provision to that effect, the Procuraduría has customarily responded to consultations submitted by the Legislative Assembly and its Deputies, with the aim of assisting in the exercise of the important functions assigned to them by the Political Constitution. Accordingly, it issues nonbinding legal opinions on certain bills under consideration or on legal matters that may be regarded as falling within the political oversight function and may reasonably be considered of general interest.\n\nSince the procedure for consultations from the Legislative Assembly to the Procuraduría is not legally regulated, the admissibility of the consultations submitted is determined through interpretation by this advisory body.\n\nThus, as we have determined on other occasions, this form of assistance, which is not provided for by law, aims to help fulfill parliamentary functions through advice of a strictly legal nature.\n\nAccordingly, opinions issued by this advisory body regarding the scope and content of a bill or constitutional amendment do not have the binding force of opinions concerning matters arising from the exercise of the administrative function. For that reason, this opinion is issued as a nonbinding legal opinion intended to serve as input for the important work of the Legislative Assembly.\n\nMoreover, since this matter does not fall within the circumstances set out in Article 157 of the Legislative Assembly’s Rules of Procedure, this opinion is not subject to the eight-day deadline established there. CONSIDERATIONS ON THE BILL.\n\nAs stated in the explanatory memorandum, the bill is based on the premise that Costa Rica’s environmental liability framework should be strengthened by incorporating environmental insurance as a preventive, remedial, and deterrent instrument intended to ensure that financial resources are available to address damage arising from activities that may affect the environment.\n\nThe initiative starts from the view that, although Costa Rican law provides mechanisms intended to ensure environmental liability, it has limitations in the financial instruments available to ensure effective remediation of damage. In particular, it states that the performance bond provided for in Article 21 of the Organic Law of the Environment, Law no. 7554, is tied primarily to the value of the investment and not necessarily to the magnitude of the environmental risk, and may therefore be insufficient to cover the costs arising from particularly serious environmental damage.\n\nIn that context, the bill proposes establishing a mixed environmental insurance system: mandatory for activities technically classified as posing a high environmental risk, and voluntary, with possible incentives, for activities posing a medium or low risk. Coverage would include, among other things, costs related to preventing imminent damage, remedying damage and, where applicable, compensating third parties.\n\nThe proposal seeks to make this instrument complement existing environmental assessment and management mechanisms, so that the costs associated with risk and potential damage are borne by those carrying out activities capable of causing them. It also seeks to incorporate an approach to managing financial risk associated with environmental deterioration, on the grounds that environmental damage can create liabilities, affect assets, and have repercussions for companies’ economic stability.\n\nThe proposal states that the new framework is intended to be coordinated with the Organic Law of the Environment and the Law Regulating Insurance Contracts (Law no. 8956 of 17 June 2011), through the inclusion of specific provisions on insurance coverage for environmental damage.\n\nIt also refers to comparative-law experience, particularly in Argentina, Colombia, the European Union, and the United States, where insurance, financial guarantees, and other mechanisms have been implemented to provide financial backing for liability arising from environmental damage.\n\nOn that basis, the bill proposes incorporating environmental insurance as an instrument that complements the national framework for preventing, managing, and remedying environmental damage, by adding Section V to Chapter II of the Law Regulating Insurance Contracts and adding Article 21 bis to the Organic Law of the Environment.\n\nAs stated in the explanatory memorandum, the proposal is based, among other things, on the principles of prevention, precaution, and “the polluter pays,” which are recognized in our legal system. Indeed, regulating environmental insurance may be considered consistent with those principles, insofar as it seeks to ensure that the costs arising from environmental harm are borne by those who create the risk or cause the damage, preventing, to the extent possible, those costs from being shifted to the community.\n\nNevertheless, it must be considered that the Organic Law of the Environment already provides preventive mechanisms linked to environmental impact assessment, as well as performance guarantees for environmental obligations, and assigns responsibilities to the National Environmental Technical Secretariat (SETENA) with respect to activities, works, or projects that may affect the environment. It is therefore necessary to coordinate the proposed insurance with existing environmental management and guarantee instruments and to define precisely the responsibilities that would correspond to that Secretariat in relation to its implementation, monitoring, and potential enforcement.\n\nIn that regard, the initiative must clearly determine which activities will be subject to mandatory environmental insurance and establish objective technical criteria for identifying and assessing the level of environmental risk associated with each activity.\n\nIt is also necessary to clarify the relationship between the insurance proposed in the bill and the performance guarantee already provided for in environmental legislation, determining whether the two instruments will operate complementarily, as substitutes, or independently, as well as defining their respective scopes, conditions, and enforcement mechanisms.\n\nMoreover, since the initiative seeks to introduce provisions in both the Organic Law of the Environment and the Law Regulating Insurance Contracts, the two bodies of legislation must be properly coordinated. The latter establishes the general legal framework applicable to insurance contracts, while the Organic Law of the Environment is the special legislation on environmental matters and regulates the instruments and institutional structure responsible for environmental assessment and management. It should therefore be determined which matters properly belong in the regulation of insurance contracts and insurance activity, and which, by their substantive environmental nature, should remain in the special legislation.\n\nIn the opinion of this advisory body, although the purpose pursued by the bill is consistent with the principles underlying environmental law, the proposal requires greater precision and clear normative boundaries, particularly regarding the activities subject to mandatory insurance, the criteria for determining the level of environmental risk, the responsibilities of the authorities involved, the relationship between the insurance and existing environmental guarantees, and coordination between environmental legislation and the regulation of insurance activity.\n\nIt must also be clear whether mandatory environmental insurance will be required only for activities, works, or projects that must undergo the environmental impact assessment procedure, or whether it is also intended to be mandatory for other activities already in operation. In the latter case, as noted, the criteria for determining which activities would be covered and the manner of implementing that requirement must be specified.\n\nFinally, analysis of this bill requires a comprehensive review and proper harmonization of the proposed amendments, so that the initiative has a clear, coherent, and precise regulatory design that identifies the persons and activities covered, defines institutional responsibilities, and establishes how environmental insurance will be coordinated with the prevention, control, and guarantee mechanisms provided for in the current legal system. This is intended to avoid duplication, contradictions, or regulatory gaps and to ensure the legal certainty needed for its eventual implementation.\n\nIII. LAW REGULATING INSURANCE CONTRACTS.\n\nThe Legislative Assembly requested our opinion on bill no. 25033, entitled “ENVIRONMENTAL INSURANCE LAW.”\n\nIn legal opinion no. PGR-OJ-112-2026 of 19 August 2026, the Procuraduría stated the following:\n\nThe bill seeks to strengthen the environmental liability framework by incorporating environmental insurance as a preventive and remedial instrument intended to ensure resources for addressing damage arising from activities that may affect the environment. To that end, it proposes a mixed insurance system: mandatory for activities posing a high environmental risk and voluntary for those posing a medium or low risk. It considers that existing financial mechanisms, particularly the performance guarantee provided for in Article 21 of the Organic Law of the Environment, Law no. 7554, may be insufficient in the face of certain environmental damage.\n\nThe initiative proposes adding Section V to Chapter II of the Law Regulating Insurance Contracts, Law no. 8956, and Article 21 bis to the Organic Law of the Environment, on the basis of the principles of prevention, precaution, and “the polluter pays.” Although its purpose is consistent with the principles underlying environmental law, the current legal system already provides preventive mechanisms and environmental guarantees and assigns responsibilities to SETENA. The proposed insurance must therefore be coordinated with those instruments.\n\nAccordingly, the bill must define the activities subject to mandatory insurance and establish objective technical criteria for determining their risk level, as well as clarify the responsibilities of the authorities responsible for its implementation, monitoring, and enforcement. It must also be determined whether the insurance will operate complementarily to, as a substitute for, or independently of the existing performance guarantee, and whether it will apply only to activities subject to environmental impact assessment or also to other activities already in operation.\n\nConsequently, this advisory body considers it necessary to properly harmonize the Organic Law of the Environment and the Law Regulating Insurance Contracts through a clear regulatory design that identifies the persons and activities covered, defines institutional responsibilities, and clarifies the relationship between environmental insurance and existing prevention, control, and guarantee mechanisms, in order to avoid duplication, contradictions, or regulatory gaps and ensure the legal certainty needed for its eventual implementation."
