"summary_en": "The Procuraduría General de la República issued a nonbinding legal opinion on Bill No. 25237, which would relax the National Parks Service Law to permit material removal and preventive or stabilization works in response to natural disasters and imminent danger. Although the bill is justified by landslides, falling trees, and accident risks along national route No. 32 within Braulio Carrillo National Park, the proposed amendment would apply to every national park and biological reserve. The Procuraduría explained that these protected wildlife areas form part of the State’s natural heritage and are subject to a special conservation regime. Under the constitutional principles of objective grounding of environmental protection, reasonableness, proportionality, progressivity, and non-regression, any reduction in their protection requires sufficient technical studies. It concluded that the general amendment lacks reasonable technical justification; even a measure confined to the specific park and highway would require clear studies addressing the necessary works, their location, degree of intervention, and environmental effects.",

A measure framed in that manner would lack reasonable technical justification.\n\nAlthough in certain cases, such as Braulio Carrillo National Park and highway No. 32, the interest in conserving the natural area may be weighed against the safety and lives of people traveling on the road, thereby allowing specific regulations for preventive and recovery actions, any proposed measures must have reasonable and proportionate technical justification. This means that there must be a connection between the proposed legislative measure and the specific situation it is intended to address.",

"body_en_text": "12 October 2026\n\nPGR-OJ-134-2026\n\nMs.\n\nCinthya Díaz Briceño\n\nLegislative Committees Area IV\n\nAsamblea Legislativa\n\nDear Madam:\n\nWith the approval of the Procurador General de la República, I refer to your unnumbered official letter of 19 February 2026, informing us that the Special Standing Committee on the Environment agreed to request our opinion on bill no. 25237, entitled “LAW TO PROVIDE FLEXIBILITY IN THE NATIONAL PARK SERVICE LAW, LEY N° 6084 OF 24 AUGUST 1977, IN THE EVENT OF NATURAL DISASTERS AND IMMINENT DANGER.”\n\nI. NATURE OF THIS OPINION.\n\nPursuant to Articles 1, 2, and 3(b) of our Organic Law (no. 6815 of 27 September 1982), the Procuraduría General de la República is the highest legal and technical advisory body of the Public Administration and, in that capacity, performs its function by issuing the legal opinions requested of it by the Public Administration.\n\nFor those purposes, the Asamblea Legislativa may be regarded as part of the Public Administration when it consults us on a matter in the exercise of its administrative function, but not when it requests our opinion on a matter of interest to the exercise of the legislative function.\n\nNotwithstanding the foregoing and the absence of any statutory provision to that effect, the Procuraduría has customarily responded to consultations submitted by the Asamblea Legislativa and its members, with the aim of assisting them in performing the important functions assigned to them by the Constitución Política. Accordingly, nonbinding legal opinions are issued concerning certain pending bills or legal matters that may be regarded as falling within the political oversight function and may reasonably be considered of general interest.\n\nOpinions issued by this advisory body concerning the scope and content of a bill or constitutional amendment do not have the binding force of opinions concerning matters arising from the exercise of the administrative function. For that reason, this opinion is issued as a nonbinding legal opinion intended to serve as an input for the Asamblea Legislativa in the performance of its important work.\n\nFurthermore, because this matter does not fall within the circumstances established in Article 157 of the Reglamento de la Asamblea Legislativa, this opinion is not subject to the eight-day period established therein. (In this regard, see, among many others, opinions OJ-009-2020 of 13 January 2020, OJ-055-2021 of 8 March 2021, OJ-122-2021 of 30 July 2021, PGR-OJ-031-2022 of 22 February 2022, and PGR-OJ-129-2022 of 6 October 2022).\n\nII. CONSIDERATIONS REGARDING THE BILL.\n\nThe explanatory statement of the bill presents information concerning hazards, landslides, falling trees and vegetation, and accidents on national route no. 32. It states that most landslides occur along a 14-kilometer section and that traveling on that road poses a risk to its users.\n\nIt states that, because part of the road crosses Parque Nacional Braulio Carrillo, the provisions of the Ley del Servicio de Parques Nacionales must be observed and that, consequently, legal impediments exist to work on the route, stabilize the slopes, and carry out the works necessary to minimize the risk.\n\nConsequently, with the ultimate aim of safeguarding human life in accordance with Article 21 of the Constitución Política, the bill proposes amending the Ley del Servicio de Parques Nacionales (no. 6084 of 24 August 1977) to permit the removal of stones, sand, gravel, or similar materials in the event of a natural disaster and when doing so does not cause ecological alterations, as well as the construction, reinforcement, and stabilization of slopes, reservoir areas, surface and underground drainage systems, retaining structures, and preventive infrastructure.\n\nIn analyzing and assessing an initiative such as the one proposed, it must be borne in mind that, under Article 58 of the Ley de Biodiversidad (no. 7788 of 30 April 1998), a protected wildlife area (área silvestre protegida) is a geographically delimited area comprising land, wetlands, and portions of the sea that is so designated because of the special significance of its ecosystems, the presence of threatened species, its importance for reproduction and other needs, and its historical and cultural significance; such areas are dedicated to conserving and protecting biodiversity, soil, water resources, cultural resources, and ecosystem services in general.\n\nArticle 32 of the Ley Orgánica del Ambiente (no. 7554 of 28 September 1995) identifies forest reserves, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments as types or management categories of protected wildlife areas.\n\nBased on Article 38 of the Ley Orgánica del Ambiente, Article 39(i) of the Ley Forestal (no. 7575 of 13 February 1996), and Article 2 of the Ley de Conservación de la Vida Silvestre (no. 7317 of 30 October 1992), we have repeatedly concluded that protected wildlife areas form part of the State’s natural heritage (patrimonio natural del Estado). (For example, see our opinions nos. OJ-069-2008 of 12 August 2008, C-134-2016 of 8 June 2016, OJ-088-2018 of 18 September 2018, and OJ-036-2019 of 20 May 2019, among others). The Constitutional Chamber (Sala Constitucional) has likewise so held, stating:\n\n“The State’s Natural Heritage is public-domain property whose conservation and administration are entrusted by law to the Ministerio del Ambiente y Energía through the Sistema Nacional de Áreas de Conservación (Ley Forestal, Arts. 6(a), 13, para. 2, and 14; Ley Orgánica del Ambiente, Article 32, para. 2). It consists of two major components: a) Protected Wildlife Areas, regardless of their management category, declared by statute or executive decree: forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments (Ley Forestal 7575, Arts. 1, para. 2, and 3(i); Ley Orgánica del Ambiente 7554, Article 32; Ley de Biodiversidad N° 7788, Arts. 22 et seq. and 58; Ley del Servicio de Parques Nacionales N° 6084, Article 3(d) and (f), in relation to the Ley Orgánica del MINAE N° 7152 and its Regulations; Ley de Conservación de la Vida Silvestre N° 7317, Article 82(a)). b) Other forests and State- and public-institution-owned forest land or land suitable for forestry (Article 13 of the Ley Forestal), which are immediately subject to statutory designation. With regard to the maritime-terrestrial zone, Ley 6043 itself (Article 73) excludes Protected Wildlife Areas from its scope and subjects them to their own legislation. The remaining coastal forested areas and land suitable for forestry are also administered by the Ministerio del Ambiente and governed by their specific regulations (Ley Forestal, Article 13 and related provisions).” (Vote no. 16975-2008 at 2:53 p.m. on 12 November 2008. Reiterated in votes nos. 17650-2008 at 12:23 p.m. on 5 December 2008, 16938-2011 at 2:37 p.m. on 7 December 2011, and 17397-2019 at 12:54 p.m. on 12 September 2019).\n\nThe inclusion of protected wildlife areas within the State’s natural heritage has important consequences. First, pursuant to Article 32, second paragraph, of the Ley Orgánica del Ambiente; Articles 6(a) and 13, second paragraph, of the Ley Forestal; and Articles 22 and 28 of the Ley de Biodiversidad, those areas must be administered by the Sistema Nacional de Áreas de Conservación, to the exclusion of any other public entity. (In this regard, see the above-cited Constitutional Chamber vote no. 17397-2019).\n\nSecond, because they form part of that heritage and pursuant to Article 18 of the Ley Forestal and Article 11 of its Regulations, the only activities that may be carried out in protected wildlife areas are training, research, and ecotourism activities, as provided in the corresponding management plan, as well as works for the use of water for human consumption. (See our opinions no. C-103-1998 of 8 June 1998, C-016-2002 of 15 January 2002, C-134-2016 of 8 June 2016, OJ-027-2018 of 28 February 2018, and OJ-036-2019 of 20 May 2019, among others).\n\nIn this regard, the Constitutional Chamber has held:\n\n“The protective regime established in the Ley Forestal for the State’s Natural Heritage entails the following: the land is inalienable; its possession by private parties ‘shall not create any right in their favor,’ and the State’s action to recover it is not subject to a limitation period; it may not be registered in the Registro Público through possessory-information proceedings (información posesoria); its invasion and occupation are punishable as criminal offenses; tree cutting, forest use, and land-use change (cambio de uso del suelo) are prohibited; and only research, training, and ecotourism activities may be authorized.” (Vote no. 12716-2012 at 4:01 p.m. on 12 September 2012. Bold added. Similarly, see votes no. 2020-2009 at 8:30 a.m. on 13 February 2009 and 1570-2011 at 10:41 a.m. on 4 November 2011).\n\nBased on the case law of the Constitutional Chamber, we have stated that the State’s natural heritage has a conservation purpose and that protected wildlife areas have a special legal status framed within a planning policy whose purpose is to preserve natural resources. (See our opinions nos. C-297-2004 of 19 October 2004, C-134-2016 of 8 June 2016, and OJ-027-2018 of 28 February 2018).\n\nWith regard to national parks and biological reserves, Article 58 of the Ley de Biodiversidad establishes that the prohibitions governing those areas are those set forth in the Ley de Creación del Servicio de Parques Nacionales. Articles 8, 10, and 12 of that law provide that any type of commercial, agricultural, or industrial activity is prohibited in those areas; that fishing is limited to artisanal and sport fishing when it has been shown not to cause ecological alterations; and that no concessions of any kind may be granted for the exploitation of products, nor may permits be issued for the establishment of facilities other than those of the Servicio de Parques Nacionales.\n\nArticle 3 of the Convención para la Protección de la Flora, Fauna y Bellezas Escénicas Naturales de los Países de América (approved by Ley no. 3763 of 19 October 1966) provides that the resources existing in national parks may not be commercially exploited.\n\nBased on these latter provisions, it has been held that National Parks and Biological Reserves are protected wildlife areas subject to absolute conservation. (Constitutional Chamber, vote no. 16975-2008 at 2:53 p.m. on 12 November 2008. See also our opinions no. C-228-1998 of 3 November 1998, C-297-2004 of 19 October 2004, OJ-236-2003 of 17 November 2003, OJ-093-2004 of 19 July 2004, OJ-069-2008 of 12 August 2008, OJ-027-2018 of 28 February 2018, PGR-OJ-071-2022 of 19 May 2022, and PGR-OJ-053-2026 of 23 March 2026).\n\nConsequently, under the constitutional principles of evidence-based environmental protection (objetivación de la tutela ambiental), reasonableness and proportionality, and progressivity and non-regression, the constitutionality of any amendment to the regime governing the State’s natural heritage and to the conservation regime established for National Parks that entails a reduction in the level of protection they currently enjoy depends on the existence of technical criteria supporting or justifying it. (See our legal opinions no. OJ-072-2018 of 24 July 2018, OJ-078-2021 of 12 April 2021, PGR-C-153-2023 of 7 August 2023, and PGR-OJ-137-2024 of 24 October 2024).\n\nWith regard to the principle of evidence-based environmental protection, the Chamber has understood that this principle:\n\n“…means that decisions in this field must be supported by technical studies, both as regards the actions of the Administration and provisions of general application—statutory and regulatory—from which arises the requirement of ‘adherence to science and technology,’ an element that provides a technical and scientific basis for the Administration’s decisions in this field and, by virtue thereof, limits and conditions the Administration’s discretion in its actions—under the terms established in Article 16 of the Ley General de la Administración Pública.” (Vote no. 2063-2007 at 2:40 p.m. on 14 February 2007).\n\nSimilarly, it is worth emphasizing that the Court has held that “the principle of reasonableness, in relation to the fundamental right to the environment, requires that rules issued on this subject be duly supported by rigorous technical studies...” (Vote no. 7294 at 4:15 p.m. on 13 October 1998).\n\nClosely connected with the latter, the Chamber has referred to progressivity and non-regression in environmental matters:\n\n“Principles of progressivity and non-regression of environmental protection. The first has been recognized in International Human Rights Law; among other international instruments, it is embodied in Article 2 of the International Covenant on Economic, Social and Cultural Rights, Articles 1 and 26 of the American Convention on Human Rights, and Article 1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights. Under these provisions, the State assumes the obligation to increase levels of human-rights protection in accordance with its capacities and development, with particular regard for rights that, like the right to the environment (Art. 11 of the Protocol), require multiple positive actions by the State for their protection and full enjoyment by all rights holders. Likewise, from the principle of progressive realization of human rights and the principle prohibiting the retroactive application of rules to the detriment of acquired rights and consolidated legal situations, embodied in Article 34 of the Constitution, arises the principle of non-regression or the irreversibility of benefits or protection already attained. This principle serves as a substantive guarantee of rights—in this case, the right to a healthy and ecologically balanced environment—under which the State is required not to adopt measures or policies, or enact legal rules, that, without reasonable and proportionate justification, worsen the level of rights protection attained up to that time. This principle does not entail absolute irreversibility, because all States experience national situations of an economic, political, or social nature, or caused by natural events, that adversely affect achievements attained up to that time and require the new level of protection to be reconsidered downward. In such cases, constitutional law and the principles under examination require that any reduction in levels of protection be justified in light of the constitutional parameters of reasonableness and proportionality (see judgment number 2012-13367 at 11:33 a.m. on 21 September 2012). We therefore find a relationship between the principle of reasonableness as a parameter of constitutionality and the right to the environment because, as this Court stated in judgment number 7294-1998, ‘the principle of reasonableness, in relation to the fundamental right to the environment, requires that rules issued on this subject be duly supported by rigorous technical studies, even if no other legal provision expressly establishes such a requirement.’\n\nIn summary, under these principles, the State is prohibited from taking measures that diminish the protection of fundamental rights, in this case the right to a healthy and ecologically balanced environment.” (Vote no. 17397-2019 at 12:54 p.m. on 11 September 2019, reiterated in vote 24147-2021 at 9:15 a.m. on 27 October 2021. Similarly, see votes no. 23239-2022, 26300-2024, and 8201-2025).\n\nThus, because this initiative seeks to amend or provide flexibility in—as the bill’s title itself indicates—the provisions of the Ley del Servicio de Parques Nacionales concerning activities and infrastructure prohibited in those protected natural areas, the constitutional legitimacy of that measure depends on the existence of sufficient technical criteria justifying the proposed change.\n\nIn that regard, the first point to be made is that the stated justification for introducing the bill is the need to implement preventive and remedial measures in Parque Nacional Braulio Carrillo to ensure the safety of users of route no. 32, given the particularly hazardous conditions of that road. Yet that specific and concrete justification concerning route no. 32 is invoked to support an amendment to the general regime applicable to all national parks and, as noted, to biological reserves.\n\nUnder the constitutional principles discussed above, it is not reasonable to amend provisions applicable to all national parks and biological reserves in order to address the road-safety problem on route no. 32 identified in the bill’s explanatory statement. A measure framed in that manner would lack reasonable technical justification.\n\nAlthough in certain cases, such as Parque Nacional Braulio Carrillo and highway no. 32, the interest in conserving the natural area may be weighed against the safety and lives of persons traveling on the road, thereby allowing specific regulations to be established for the implementation of preventive and remedial measures, any proposed measures must have reasonable and proportionate technical justification. This means that there must be a connection between the proposed legislative measure and the specific situation it is intended to address.\n\nThe same constitutional principles discussed above would apply if a legislative measure were proposed that applied only to the specific case of Parque Nacional Braulio Carrillo and the management of road-related risks on route no. 32. In that event, clear and precise technical studies concerning the highway and the area where it crosses the protected area would be required in order to determine the extent of the intervention required, whether the works would be carried out within the highway right-of-way (derecho de vía), the types of works needed, and other technical matters that would justify the proposed statutory amendments and permit an assessment of their reasonableness.\n\nIII. CONCLUSION.\n\nBased on the constitutional principles discussed above, it is the Procuraduría’s nonbinding opinion that it is not reasonable to amend provisions applicable to all national parks and biological reserves in the country in order to address the road-safety problem on route no. 32 identified in the bill’s explanatory statement. A measure framed in that manner would lack reasonable technical justification.\n\nYours sincerely,\n\nElizabeth León Rodríguez\n\nProcuradora\n\nELR/hmu\n\nCode 2133-2026\n\n--- SUMMARY ---\n\nPGR-OJ-134-2026.\n\nBILL NO. 25237. LAW TO PROVIDE FLEXIBILITY IN THE NATIONAL PARK SERVICE LAW, LEY N.° 6084 OF 24 AUGUST 1977, IN THE EVENT OF NATURAL DISASTERS AND IMMINENT DANGER.\n\nThe Asamblea Legislativa requested our opinion on bill no. 25237, entitled “LAW TO PROVIDE FLEXIBILITY IN THE NATIONAL PARK SERVICE LAW, LEY N° 6084 OF 24 AUGUST 1977, IN THE EVENT OF NATURAL DISASTERS AND IMMINENT DANGER.”\n\nThrough legal opinion no. PGR-OJ-134-2026 of 12 October 2026, the Procuraduría stated as follows:\n\nThe bill proposes amending the Ley del Servicio de Parques Nacionales to permit preventive and stabilization works in Parque Nacional Braulio Carrillo in view of the risks that national route no. 32 poses to its users.\n\nIt must be borne in mind that protected wildlife areas (áreas silvestres protegidas) form part of the State’s natural heritage (patrimonio natural del Estado) and are subject to a special conservation regime under the Ley Orgánica del Ambiente, the Ley Forestal, the Ley de Biodiversidad, and the Ley del Servicio de Parques Nacionales. National parks and biological reserves, in particular, are subject to strict restrictions on their use and intervention. Accordingly, any amendment that reduces their level of protection must be supported by sufficient technical studies justifying its necessity and proportionality, in accordance with the constitutional principles of environmental protection, reasonableness, progressivity, and non-regression.\n\nIn this specific case, the initiative is based on the need to address the road-related risks on route no. 32, but proposes providing flexibility in the legal regime applicable to all national parks and biological reserves. That extension does not appear reasonable if the justification is limited to a specific situation, since there must be a direct relationship between the problem to be resolved and the scope of the amendment. If a regulation limited to Parque Nacional Braulio Carrillo and route no. 32 were chosen, technical studies would likewise be necessary to determine the interventions required, their location in relation to the highway right-of-way (derecho de vía), the types of works, and their potential effects on the protected area.\n\nBased on the constitutional principles discussed above, it is not reasonable to amend provisions applicable to all national parks and biological reserves in the country in order to address the road-safety problem on route no. 32 identified in the bill’s explanatory statement. A measure framed in that manner would lack reasonable technical justification."
